WHEREAS, Department of Fire and Safety Services, Division of Code Enforcement has
requested the City Council to hold public hearings to consider the advisability and necessity of
ordering the repair or wrecking and removal of a one-story, wood frame structure with a detached,
one-stall, wood frame garage with attached shed located on property hereinafter referred to as the
"Subject Properry" and commonly known as 977 Burr Street. This properry is legally described as
follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Division of Code Enforcement on or before November 17, 1997, the
following aze the now known interested or responsible parties for the Subject Property: Belinda
G.Vela, 977 Burr Street, St. Paul, MN 55101-3905; Firstar Mortgage Services, 809 South 60th
Street, Ste.210, West Allis, WI 53214; Best & Flanagan, PLLP, 601 Second Avenue South, 4000
First Bank Place, Mpls., MN 55402
WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul L,egislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated December 8, 1997; and
WHEREAS, this order informed the then known interested ar responsible parties that the
structure located on the Subject Properiy is a nuisance building(s) pursuant to Chapter 45; and
WEiEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by January 7, 1998; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condiuon; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the L.egislative Heazing
Officer of the City CouncIl and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, March 3, 1998 to hear testimony and evidence, and after receiving testimony
and evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Subject Property safe and not detrimental to the public peace, health, safery and
welfare and remove its blighting influence on the community by rehabilitating this structure in
accordance with all applicable codes and ordinances, or in the alternauve by demolishing and
removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the structure to be completed within fifteen (15) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday, March
11, 1998 and the testimony and evidence including the action taken by the L,egislarive Hearing
Off'icer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 977 Burr Street:
1. That the Subject Properry comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible
parties to correct the deficiencies or to demolish and remove the building(s).
S. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Enforcement, VacanUNuisance Buildings.
8. That the l�own interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incuned
against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul
I.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fistures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal properry is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

Division of Code Enforcement has declared this buiiding(s) to constitute a"nuisance" as
defined by I.egislative Code, Chapter 45. Division of Code Enforcement has issued an order
to the then known responsible parties to eliminate this nuisance condition by correcting the
deficiencies or by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this properry. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsible parties to either repair, or demolish and remove this bui?dir.� in a
timely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removal, and to assess the costs incurred against the real estate as a special
assessment to be collected in the same manner as taxes.

Resolution ordering the owner to remove or repair the building located at 202 Charles
Avenue. If the owner fails to comply with the resolution, Public Health is ordered to remove
the building.
The Legislative Hearing Officer recommends laying this matter over to June 2,1998.
2. Resolution ordering the owner to remove or repair the building located at 977 Burr Street. If
the owner fails to comply with the resolution, Public Health is ordered to remove the
building.
The Legislative Hearing Officer recommends approval.
3. Resolution ordering the owner to remove or repair the building located at 26 Acker Street
West. If the owner fails to comply with the resolution, Public Health is ordered to remove the
building.
The Legislative Hearing Officer recommends allowing the owner six months to
complete rehabilitation, provided a Code Compliance application be filed and a$2,000
Bond be posted by Noon, Wednesday, March 11�`.
4. Summary Abatement appeal for 842 Edmund Avenue; JoAnne Nixon and David Tonnar,

Gerry Strathman, Lzgislative Hearing Officer, called the meeting to order at 10:00 a.m.

Chuck Votel, Public Health, advised that this structure was condemned in June, 1997 and
has been vacant since July, 1997. The current property owner is the State of Minnesota Trust
Exempt. Vacant building fees are due and owing. Estimated cost to repair is $60,000 - cost to
demolish, $9,300.
Richard Wendt and Kris Kujala, representing Ramsey County appeared. Mr. Wendt
stated that there are interested buyers who aze willing to renovate the property. On two previous
occasions, HRA asked to have this pazcel removed from the auction list. HRA has now released
their interest in this property. On May 28�' another auction will be held, at which time Ramsey
County would like to auction this property to the interested buyers.
Gerry Strathman, Legislative Hearing Officer, recommends laying this matter over to
June 2, 1998, allowing the county an opportunity to put the property up for auction on May 28`",
with the hope that a responsible buyer wiil rehabilitate.
977 Burr Street
Chuck Votel, Public Health, advised that this structure has been vacant since October,
1997. Vacant Building registration fees are due and owing. Real Estate tazes are paid.
Estimated cost to repair is $35,000 - cost to demolish, $6,900.
The owner did not appeaz.
Gerry Strathman, recommends approval of the order to repair or remove this building
within fif[een (15) days.

Chuck Votel, Public Health, advised that this buiiding was condemned in July, 1997 and
has been vacant since October, 1997. Vacant Building registraUon fees are due and owing. Real
Estate taa�es for 1996 and 1997 aze unpaid. Estimated cost to repair is $25,�0 - cost to
demolish, $6,535.
Steven B. Roettger, owner, appeazed. Mr. Roettger presented photographs of neighboring
homes which he feels ate in much worse shape than his. He advised that he presently has an
attomey who is attempting to collect workers compensation for the past four yeazs. As soon as
he receives that, he wil] rehabilitate the structure.
Gerry Strathman, Legislative Hearing Officer, recommends allowing Mr. Roettger six
months to rehabilitate the structure, provided that he applies for a Code Compliance Inspection
and posts a$2,000 performance bond by Noon, Wednesday, Mazch 11 Otherwise, Mr.
Strathman recommends demolishing the building.

Chuck Votel, Public Health, advised that this structure was condemned in June, 1997 and
has been vacant since July, 1997. The current property owner is the State of Minnesota Trust
Exempt. Vacant building fees are due and owing. Estimated cost to repair is $60,000 - cost to
demolish, $9,300.
Richard Wendt and Kris Kujala, representing Ramsey County appeared. Mr. Wendt
stated that there are interested buyers who aze willing to renovate the property. On two previous
occasions, HRA asked to have this pazcel removed from the auction list. HRA has now released
their interest in this property. On May 28�' another auction will be held, at which time Ramsey
County would like to auction this property to the interested buyers.
Gerry Strathman, Legislative Hearing Officer, recommends laying this matter over to
June 2, 1998, allowing the county an opportunity to put the property up for auction on May 28`",
with the hope that a responsible buyer wiil rehabilitate.

homes which he feels ate in much worse shape than his. He advised that he presently has an
attomey who is attempting to collect workers compensation for the past four yeazs. As soon as
he receives that, he wil] rehabilitate the structure.

months to rehabilitate the structure, provided that he applies for a Code Compliance Inspection
and posts a$2,000 performance bond by Noon, Wednesday, Mazch 11 Otherwise, Mr.

requested the City Council to hold public hearings to consider the advisability and necessity of
ordering the repair or wrecking and removal of a one-story, wood frame structure with a detached,
one-stall, wood frame garage with attached shed located on property hereinafter referred to as the
"Subject Properry" and commonly known as 977 Burr Street. This properry is legally described as
follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Division of Code Enforcement on or before November 17, 1997, the
following aze the now known interested or responsible parties for the Subject Property: Belinda
G.Vela, 977 Burr Street, St. Paul, MN 55101-3905; Firstar Mortgage Services, 809 South 60th
Street, Ste.210, West Allis, WI 53214; Best & Flanagan, PLLP, 601 Second Avenue South, 4000

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul L,egislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated December 8, 1997; and
WHEREAS, this order informed the then known interested ar responsible parties that the
structure located on the Subject Properiy is a nuisance building(s) pursuant to Chapter 45; and
WEiEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by January 7, 1998; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condiuon; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the L.egislative Heazing
Officer of the City CouncIl and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, March 3, 1998 to hear testimony and evidence, and after receiving testimony
and evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Subject Property safe and not detrimental to the public peace, health, safery and
welfare and remove its blighting influence on the community by rehabilitating this structure in
accordance with all applicable codes and ordinances, or in the alternauve by demolishing and
removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the structure to be completed within fifteen (15) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday, March
11, 1998 and the testimony and evidence including the action taken by the L,egislarive Hearing
Off'icer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 977 Burr Street:
1. That the Subject Properry comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown responsible
parties to correct the deficiencies or to demolish and remove the building(s).
S. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Enforcement, VacanUNuisance Buildings.
8. That the l�own interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incuned
against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul
I.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fistures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal properry is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.
