1 WHEREAS, Department of Fire and Safety Services, Division of Code Enforcement has
2 requested the City Council to hold public hearings to consider the advisability and necessity of
3 ordering the repair or wrecking and removal of a two-story, wood frame structure located on
4 properry hereinafter referred to as the "Subject Properry" and commonly l�own as 26 Acker Street
5 West. This property is legally described as follows, to wit:

9 WHEREAS, based upon the records in the Ramsey Counry Recorder's Off'ice and
10 information obtained by Division of Code Enforcement on or before November 17, 1997, the
11 following are the now l�own interested or responsible parties for the Subject Property: Steven B.
12 Roettger, 26 Acker Street West. St. Paul, MN 55117-5561; AVCO Financial Services, %
13 American General Finance, 2400 Central Avenue N.E., Mpls., MN 55418;

15 WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
16 Chapter 45 of the Saint Paul L.egislative Code an order identified as an "Order to Abate Nuisance
17 Building(s)" dated December 8, 1997; and

19 WHEREAS, this order informed the then known interested or responsible parties that the
20 structure located on the Subject Properry is a nuisance building(s) pursuant to Chapter 45; and
21
22 WHEREAS, this order informed the interested or responsible parties that they must repair or
23 demolish the structure located on the Subject Property by 7anuary 7, 1998; and
24
25 WHEREAS, the enforcement officer has posted a placard on the Subject Properry declaring
26 this building(s) to constitute a nuisance condition; subject to demolition; and
27
28 WHEREAS, this nuisance condition has not been cosected and Division of Code
29 Enforcement requested that the Ciry Clerk schedule public hearings before the Legislative Hearing
30 Officer of the City Council and the Saint Paul City Council; and

32 WHEREAS, the interested and responsible parties have been served notice in accordance
33 with the provisions of Chapter 45 of the Saint Paul I.egislative Code, of the time, date, place and
34 purpose of the public hearings; and
35
36 WHEREAS, a hearing was held before the L.egislative Hearing Officer of the Saint Paul City
37 Council on Tuesday, Mazch 3, 1998 to hear testimony and evidence, and after receiving testunony
38 and evidence, made the recommendation to approve the request to order the interested or responsible
39 parties to make the Subject Property safe and not detrimental to the public peace, health, safety and
40 welfare and remove its blighting influence on the community by rehabilitating this structure in
41 accordance with all applicable codes and ordinances, or in the alternative by demolishing and
42 removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or
43 demolition of the structure to be completed within fifteen (15) days after the date of the Council
44 Hearing; and

WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday, March
11, 1998 and the testimony and evidence including the acrion taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul Ciry Council hereby adopts the following Findings and
Order concerning the Subject Property at 26 Acker Street West:
1. Tbat the S�bject Property comprises a nuisance condition as defined in Saint Paul
I.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitared by the Department of Fire and Safety
Services, Division of Code Enforcement, VacanUNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notificauon requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfaze and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordina�ces, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above correcrive action is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Properry pursuantto the provisions of Chapter 45 of the Saint Paul
Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properiy by the responsible parties by the end of this tune period.
If all personal properry is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properiy as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.

Division of Code Enforcement has declared this building(s) to constitute a"nuisance" as
defined by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order
to the then known responsible parties to eliminate this nuisance condition by correcting the
deficiencies or by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsibie parties to either repair, or demolish and remove this building in a
tunely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removal, and to assess the costs incurred against the real estate as a special
assessment to be collected in the same manner as taxes.

Avenue. If the owner fails to comply with the resolution, Public Health is ordered to remove

The Legisiative Hearing Officer recommends laying this matter over to June 2,1998.
2. Resolution ordering the owner to remove or repair the building located at 977 Burr Street. If
the owner faiis to comply with the resolution, Public Health is ordered to remove the
building.
The Legislative Hearing Officer recommends approval.

West. If the owner fails to comply with the resolution, Public Heaith is ordered to remove the

The Legislative Hearing Officer recommends altowing the owner suc months to

Gerry Strathman, Legislative Hearing Officer, called the meering to order at 10:00 am.

Chuck Votel, Public Health, advised that this structure was condemned in June, 1997 and
has been vacant since July, 1997. The current property owner is the State of Minnesota Trust
Exempt. Vacant building fees aze due and owing. Estimated cost to repair is $60,000 - cost to
demolish, $9,300.
Richazd Wendt and Kris Kujala, representing Ramsey County appeared. Mr. Wendt
stated that there are interested buyers who aze wiliing to renovate the property. On two previous
occasions, HRA asked to have this parcel removed from the auction list. HRA has now released
their interest in this property. On May 28`� another auction will be held, at which time Ramsey
County would like to auction this property to the interested buyers.
Gerry Suathman, Legislative Hearing Officer, recommends laying this matter over to
June 2, 1998, allowing the county an opportunity to put the property up for auction on May 28�',
with the hope that a responsible buyer will rehabilitate.
977 Burr Street
Chuck Votel, Public Health, advised that this structure has been vacant since October,
1997. Vacant Buiiding registration fees are due and owing. Real Estate taxes aze paid.
Estimated cost to repair is $35,000 - cost to demolish, $6,900.
The owner did not appear.
Gerry Strathman, recommends approval of the order to repair or remove this building
within fifteen (15) days.

3teven B. Roettger, owner, appeared. Mr. Roettger presented photographs of neighboring
homes which he feels aze in much worse shape than his. He advised that he presenfly has an
attorney who is attempting to collect workers compensation for the past four yeazs. As soon as
he receives that, he will rehabilitate the structure.
Gerry Strathman, I.egislative Hearing Officer, recommends allowing Mr. Roettger six
months to rehabilitate the structure, provided that he applies for a Code Compiiance Inspection
and posts a$2,000 performance bond by Noon, Wednesday, March 11�'. Otherwise, Mr.
Strathman recommends demolishing the building.

Chuck Votel, Public Health, advised that this structure was condemned in June, 1997 and
has been vacant since July, 1997. The current property owner is the State of Minnesota Trust
Exempt. Vacant building fees aze due and owing. Estimated cost to repair is $60,000 - cost to
demolish, $9,300.
Richazd Wendt and Kris Kujala, representing Ramsey County appeared. Mr. Wendt
stated that there are interested buyers who aze wiliing to renovate the property. On two previous
occasions, HRA asked to have this parcel removed from the auction list. HRA has now released
their interest in this property. On May 28`� another auction will be held, at which time Ramsey
County would like to auction this property to the interested buyers.
Gerry Suathman, Legislative Hearing Officer, recommends laying this matter over to
June 2, 1998, allowing the county an opportunity to put the property up for auction on May 28�',
with the hope that a responsible buyer will rehabilitate.

Estimated cost to repair is $35,000 - cost to demolish, $6,900.

homes which he feels aze in much worse shape than his. He advised that he presenfly has an
attorney who is attempting to collect workers compensation for the past four yeazs. As soon as
he receives that, he will rehabilitate the structure.
Gerry Strathman, I.egislative Hearing Officer, recommends allowing Mr. Roettger six
months to rehabilitate the structure, provided that he applies for a Code Compiiance Inspection
and posts a$2,000 performance bond by Noon, Wednesday, March 11�'. Otherwise, Mr.
Strathman recommends demolishing the building.

37 Council on Tuesday, Mazch 3, 1998 to hear testimony and evidence, and after receiving testunony
38 and evidence, made the recommendation to approve the request to order the interested or responsible
39 parties to make the Subject Property safe and not detrimental to the public peace, health, safety and
40 welfare and remove its blighting influence on the community by rehabilitating this structure in
41 accordance with all applicable codes and ordinances, or in the alternative by demolishing and
42 removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or

WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday, March
11, 1998 and the testimony and evidence including the acrion taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul Ciry Council hereby adopts the following Findings and
Order concerning the Subject Property at 26 Acker Street West:
1. Tbat the S�bject Property comprises a nuisance condition as defined in Saint Paul
I.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitared by the Department of Fire and Safety
Services, Division of Code Enforcement, VacanUNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notificauon requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfaze and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordina�ces, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above correcrive action is not completed within this period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Properry pursuantto the provisions of Chapter 45 of the Saint Paul
Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properiy or fixtures of any kind which interfere with the demolition and removal
shall be removed from the properiy by the responsible parties by the end of this tune period.
If all personal properry is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properiy as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.
