WF�REAS, Miim. Stat. § 462353, Subd. 4 provides municipalities with the
authority to prescribe fees by ordinance for the purpose of defraying costs incurred when
investigating and administering matters related to zoning and planning activities
authorized by Minn. Stat. §§ 462351 - 462364; and
Wf1EREAS, Saint Paul Legislative Code §§ 64.204 and 64.206 authorize the City
Council to establish those fees permitted under Minn. Stat. § 462.353, Subd. 4 by
resolution.
Wf�REAS, the City Council, in Council File No. 94-1609, established zoning
and environmental review fees and made certain provisions far the refund of such fees
under the circumstances specified; NOW, TF�REFORE, BE IT
RESOLVED, that Council File No. 94-1609, paragraphs 12 and 13 shall be
amended to read as follows:

funds to citizen particip tion projects including neighborhood district councils in the sum of
$669,177. According , the City Council finds that it is not necessary to require neighborhood
district councils to y the fees set forth in paragraphs 12 and 13 of Council File No. 94-1609 in
those cases where e neighborhood district council appeals from a decision of the zoning
administrator, board of zoning appeals or the plaiming commission as the source of the
appellate fees e public dollars provided by the City; NOW, THEREFORE, BE IT
