WAEREA5, based upon the records in the Ramsey Counry Recorder's Office and information obtained by Division of Code Enforcement on or before November 10, 1997, the following are the now known interested or responsible parties for the Subject Properiy: Gregory T. Ryan, John P. Ryan, 811 University Avenue West, 5t. Paul, MN 55104 WHEREAS, Division of Code Enforcement has served in accordance with the provisions of Chapter 45 of the Saint Paul L,egislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated November 24, 1997; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by December 26, 1997; and WHEREAS, the enforcement officer has posted a placard on the Subject Properry declaring this building(s) to constitute a nuisance condition; subject to demoliflon; and WHEREAS, this nuisance condiflon has not been corrected and Division of Code Enforcement requested that the City Clerk schedule public hearings before the I,egislauve Hearing Officer of the Ciry Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the grovisions of Chapter 45 of the Saint Paul I.egislative Code, of the time, date, place and purpose of the public hearings; and q� -150 WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, February 17, 1448 to hear testimony and evidence, and after receiving tesrimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this shucture in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February 25, 1998 and the testimony and evidence including the action taken by the L,egislative Hearing Off'icer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testunony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 815 University Avenue West: 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul L.egislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estunated to exceed three thousand dollars ($3,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Division of Code Enforcement has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by the Department of Fire and Safety Services, Division of Code Enforcement, Vacant/Nuisance Buildings. 8. That the laiown interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hexeby makes the foilowing order: 1. The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this siructure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. If all personal property is not removed, it shail be considered to be abandoned and the Ciry of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. The Legislative Hearing Officer recommends denying the appeal. ��. yS� MINUTES OF Tf� LEGISLATTVE HEARING February 17, 1998 Room 300, City Hall Gerry Strathman, Legislative Hearing Officer STAFF PRESENT: Chuck Votel and Guy Willits, Public Health Gerry Strathman called the meeting to order at 10:00 am. 774 Ashland Avenue Chuck Votel reported the property has been vacant since February 1997. The current property owner is F1eet Mortgage. The owner is cunently doing minimal repairs and intends to convey the property to Housing and Urban Development (HUD). The City has issued four summary abatement notices and has boarded the building against trespass. The real estate ta�ces are paid. The inspectors were unable to estimate the cost to repair because they have not gained access to the interior. It appeazs to be severely water damaged. 'I`he cost to demolish is $5,890. Beth Asmussen, Fleet Mortgage, stated they would like extra time. They have paid the $100 fee to have the code compliance completed. The bond wiil be posted and they would like six months to find a buyer and make the necessary repairs. Fleet Mortgage is planning to convey the building to HUD. Gerry Strathman recommends 6 months to rehabilitate the building on condition that a code compliance inspection is applied for and a$2,000 bond is posted by noon of February 25, 1998. 579 Forest Street Charlene Hessler stated she has started to clean the garage over the summer. The sides have been cleaned. The cars aze in running order. '1`he property has been reinspected and new issues were found. Some of the issues have been taken caze of such as the tires being removed. Ms. Hessler was told she needed a pertnit for two or more rabbits and she now has the applications for the permits. The yazd should be cleaned up by the end of the month with the wanner weather. Gerry Strathman asked why it takes until the end of the month. Ms. Hessler responded there is metal frozen in the ground that needs to be pulled up and they have been salting it and working on it everyday. Guy Willits reported this started in November. Chazlene Hessler has been given some extensions. An inspector went there Friday and saw fans blowing on the rabbit feces for unknown reasons. Charlene Hessler explained it wzs to dry it out. Mr. Willits went on to say refuse is stored in a boat, the backyard has four vehicles, scattered refuse, and a three foot high pile of rabbit feces. The stench is awful. Gerry Strathman recommends denying the appeal. �g ' � MINLIT'ES OF THE LEGISLATIVE HEARING, 2-17-98 815 Universitv Avenue West Page 2 Chuck Votel reported this has been vacant since September 1997. The City has boarded the building. The owner has been tagged for failure to pay fees and for unlawfui occupancy. In December, the owner obtained a code compliance inspection. The cost to repair is $40,000. The owner has been uncooperative, Gerry Strathman recommends approval of the 15 day order to repair or remove the building. 882 Greenbrier Street Chuck Votel reported this building was condemned in July 1997 and has been vacant since then. The current property owner is State of Minnesota Trust Exempt. The City has issued five summary abatement notices. The cost to repair is $45,000 and the cost to demolish is $8,725. Gregory Von Rothkirch, Ramsey County Ta�c Forfeit and Land, appeazed and stated the property was forfeited in August 1997. They have had possession since September. They would like to offer the building at auction, however the Housing and Redevelopment Authority (HRA) wants the property and has the right to obtain it first. The site is difficult topographically. If the house is demolished, the lot will probably not be redeveloped. The house has been boazded three times and is in an isolated location. Gerry Strathman stated this property is in a serious state of disrepair and asked has it been a problem. Chuck Votel responded it is repeatedly broken into, which is the primary problem. Gregory Von Rothkirch stated May 28 is the next scheduled auction and there aze only two auctions a year. Gerry Strathman recommends approval of the 15 day order to repair or remove the building. Mr. Strathman urged Gregory Von Rothkirch to attend the February 25 Council meeting to discuss the matter with the City Council members who are also the HRA. The current property owner is F1eet Mortgage. The owner is cunently doing minimal repairs and intends to convey the property to Housing and Urban Development (HUD). The City has issued four summary abatement notices and has boarded the building against trespass. The real estate ta�ces are paid. The inspectors were unable to estimate the cost to repair because they have not gained access to the interior. It appeazs to be severely water damaged. 'I`he cost to demolish is $5,890. Beth Asmussen, Fleet Mortgage, stated they would like extra time. They have paid the $100 fee to have the code compliance completed. The bond wiil be posted and they would like six months to find a buyer and make the necessary repairs. Fleet Mortgage is planning to convey the building to HUD. The sides have been cleaned. The cars aze in running order. '1`he property has been reinspected and new issues were found. Some of the issues have been taken caze of such as the tires being removed. Ms. Hessler was told she needed a pertnit for two or more rabbits and she now has the applications for the permits. The yazd should be cleaned up by the end of the month with the wanner weather. Ms. Hessler responded there is metal frozen in the ground that needs to be pulled up and they have been salting it and working on it everyday. Guy Willits reported this started in November. Chazlene Hessler has been given some extensions. An inspector went there Friday and saw fans blowing on the rabbit feces for unknown reasons. Charlene Hessler explained it wzs to dry it out. Mr. Willits went on to say refuse is stored in a boat, the backyard has four vehicles, scattered refuse, and a three foot high pile of rabbit feces. The stench is awful. The current property owner is State of Minnesota Trust Exempt. The City has issued five summary abatement notices. The cost to repair is $45,000 and the cost to demolish is $8,725. Gregory Von Rothkirch, Ramsey County Ta�c Forfeit and Land, appeazed and stated the property was forfeited in August 1997. They have had possession since September. They would like to offer the building at auction, however the Housing and Redevelopment Authority (HRA) wants the property and has the right to obtain it first. The site is difficult topographically. If the house is demolished, the lot will probably not be redeveloped. The house has been boazded three times and is in an isolated location.
