WHEREAS, Department of Fire and Safety Services, Division of Code Enforcement has
requested the City Council to hold public hearings to consider the advisabiliry and necessity of
ordering the repair or wrecking and removal of a two-story, wood frame structure located on
property hereinafter referted to as the "Subject Property" and commonly known as 882 Greenbrier
5treet. This properry is legally described as follows, to wit:
L,ot 10, Munger's Subdivision of Block 33 Arlington Hills Addition to the City of St.
Paul.
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Division of Code Enforcement on or before October 14, 1997, the
following are the now known interested or responsible parties for the Subject Property: State of
Minnesota Trust Exempt, 620B Government Center West, 50 Kellogg Blvd. West, St. Paul, MN
55102; Valley Paving Inc., 8800 13th Avenue East, Shakopee, MN 55379; Curt Potts (Cunency
Exchange), 981 Payne Avenue, St. Paul, MN 55101; Metro Contracting, Inc., 3150 County Rd.
90, Maple Plain, MN 55359; Margaret Bichsel, % Alf E. Sivertson, Attorney, 1465 Arcade Street,
St. Paul, MN 55106, Re: Judgment vs. State of MN
WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul I.egislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated November 5, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Properiy is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by December 5, 1997; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WFIEREAS, this nuisance condition has not been corrected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the Legislative Hearing
Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I,egislative Code, of the time, date, place and
purpose of the public hearings; and

'QVHEREAS, a hearing was held before the L.egislative Hearing Officer of the Saint Paui City
Council on Tuesday, February 17, 1998 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the pubiic peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternaflve by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the Council Hearing; and
WFIEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February
25, 1998 and the testimony and evidence including the action taken by the L,egislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 882 Greenbrier Street:
1. That the Subject Property comprises a nuisance condition as de6ned in Saint Paul
I,egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to conect the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Bnforcement, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the S�bject Property safe
and not detrimental to the public peace, health, safety and welfaze and remove its blighting
influence on the community by rehabilitating this structure and conecting all de£iciencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicahle codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

1 2. If the above corrective action is not completed within this period of time the Fire and Safety
2 Services, Division of Code Enforcement is hereby authorized to take whatever steps are
3 necessary to demolish and remove this structure, fill the site and charge ffie costs incurred
4 against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul
5 Legislative Code.
7 3. In the event the building is to be demolished and removed by the City of Sainz Paul, all
8 personal property or fixtures of any kind which interfere with the demolition and removal
9 shall be removed from the property by the responsible parties by the end of this time period.
10 If all personal proper[y is not removed, it shall be considered to be abandoned and the City
11 of Saint Paul shall remove and dispose of such property as provided by law.

13 4. It is fiuther ordered, that a copy of this resolution be maIled to the owners and interested
14 parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.

Division of Code Enforcement has declared this building(s) to constitute a"nuisance" as
defined by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order
to the then known responsible parties to eliminate this nuisance condition by correcting the
deficiencies or by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Councii pass a resolution
ordering the responsible parties to either repair, or demolish and remove this building in a
tunely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removal, and to assess the costs incurred against the real estate as a special
assessment to be coilected in the same manner as taxes.

Avenue West. If the owner fails to comply with the resolution, Public Health is ordered to
remove the building.
The Legislarive Hearing Officer recommends approval of the 15 day order to repair or
remove the building.
2. Resolution ordering ihe owner to remove or repair the building located at 774 Ashland
Avenue. If the owner fails to comply with the resolution, Public Heaith is ordered to
remove the bui]ding.
'The Legislative Hearing Officer recommends 6 months to rehabilitate the building on
condition that a code compliance inspection is done and a$2,QQ0 bond is posted by noon of
February 25, 1998.
3. Resolution ordering the owner to remove or repair the building located at 882 Greenbrier

STAFF PRESENT: Chuck Votel and Guy Willits, Public Health
Gerry Strathman called the meeting to order at 10:00 a.m.
774 Ashland Avenue
Chuck Votel reported the property has been vacant since February 1997. The current properiy
owner is Fieet Mortgage. The owner is currently doing minima] repairs and intends to convey
the property to Housing and Urban Development (HUD). The City has issued four summary
abatement notices and has boazded the building against trespass. The real estate taxes are paid.
The inspectors were unab]e to estimate the cost to repair because they have not gained access to
the interior. It appeazs to be severely water damaged. The cost to demolish is $5,890.
Beth Asmussen, F7eet Mortgage, stated they would ]ike extra time. They have paid the $100 fee
to have the code compliance completed. The bond will be posted and they would like six months
to find a buyer and make the necessazy repairs. Fleet Mortgage is planning to convey the
building to HUD.
Gerry Strathman recommends 6 months to rehabilitate the building on condition that a code
compliance inspection is applied for and a$2,000 bond is posted by noon of February 25, 1998.
579 Forest Street
Charlene Hessler stated she has started to clean the garage over the summer. The sides have been
cleaned. The cazs are in running order. The ptoperty has been reinspected and new issues were
found Some of ihe issues have been taken caze of such as the tires being removed. Ms. Hessier
was told she needed a permit for two or more rabbits and she now has the applications for the
permits. The yard should be cleaned up by the end of the month with the wanner weather. Gerry
Strathman asked why it takes until the end of the month. Ms. Hessler responded there is metal
frozen in the ground that needs to be pulied up and they have been salting it and working on it
everyday.
Guy Wi11iYs reported this started in November. Chazlene Hessier has been given some
extensions. An inspector went there Friday and saw fans blowing on the rabbit feces for
unknown reasons. Chazlene Hessler explained it was to dry it out. Mr. Willits went on to say
refuse is stored in a boat, the backyard has four vehicles, scattered refuse, and a three foot high
pile of rabbit feces. The stench is awful.
Gerry Strathman recommends denying the appeal.

Chuck Votel reported this has been vacant since September 1997. The City has boarded the
building. The owner has.been tagged for failure to pay fees and for unlawful occupancy. In
December, the owner obtained a code compliance inspection. The cost to repair is $40,000. The
owner has been uncooperative.
Gerry Strathman recommends approval of the 15 day order to repair or remove the building.

Chuck Vote] reported this building was condemned in 3uly 1997 and has been vacant since then.
The cunent properry owner is State of Minnesota Trust Exempt. The City has issued five
summary abatement notices. The cost to repair is $45,000 and the cost to demolish is $8,725.
Gregozy Von Rothkirch, Ramsey County Tax Forfeit and Land, appeazed and stated the property
was forfeited in August 1997. They have had possesslon since September. They would like to
offer the building at auction, however the Housing and Redevelopment Authority (HRA) wants
the property and has the right to obtain it first. The site is difficult topographically. If the house
is demolished, the lot will probably not be redeveloped. The house has been boarded three times
and is in an isolated location.
Gerry Strathman stated this property is in a serious state of disrepair and asked has it been a
prob]em. Chuck Votel responded it is repeatedly broken into, which is the primary problem.
Gregory Von Rothkirch stated May 28 is the next scheduled auction and there aze only two
auctions a yeaz.
Gerry Strathman recommends approvai of the 15 day order to repair or remove the buiiding. Mr.
Strathman urged Gregory Von Rothkirch to atiend the February 25 Council meeling to discuss
the matter with the City Council members who aze also the HRA.
The meeting was adjourned at 10:15 a.m.

defined by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order
to the then known responsible parties to eliminate this nuisance condition by correcting the
deficiencies or by razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Councii pass a resolution
ordering the responsible parties to either repair, or demolish and remove this building in a
tunely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removal, and to assess the costs incurred against the real estate as a special
assessment to be coilected in the same manner as taxes.

Gerry Strathman called the meeting to order at 10:00 a.m.
774 Ashland Avenue
Chuck Votel reported the property has been vacant since February 1997. The current properiy
owner is Fieet Mortgage. The owner is currently doing minima] repairs and intends to convey
the property to Housing and Urban Development (HUD). The City has issued four summary
abatement notices and has boazded the building against trespass. The real estate taxes are paid.
The inspectors were unab]e to estimate the cost to repair because they have not gained access to
the interior. It appeazs to be severely water damaged. The cost to demolish is $5,890.
Beth Asmussen, F7eet Mortgage, stated they would ]ike extra time. They have paid the $100 fee
to have the code compliance completed. The bond will be posted and they would like six months
to find a buyer and make the necessazy repairs. Fleet Mortgage is planning to convey the
building to HUD.
Gerry Strathman recommends 6 months to rehabilitate the building on condition that a code
compliance inspection is applied for and a$2,000 bond is posted by noon of February 25, 1998.
579 Forest Street
Charlene Hessler stated she has started to clean the garage over the summer. The sides have been
cleaned. The cazs are in running order. The ptoperty has been reinspected and new issues were
found Some of ihe issues have been taken caze of such as the tires being removed. Ms. Hessier
was told she needed a permit for two or more rabbits and she now has the applications for the
permits. The yard should be cleaned up by the end of the month with the wanner weather. Gerry
Strathman asked why it takes until the end of the month. Ms. Hessler responded there is metal
frozen in the ground that needs to be pulied up and they have been salting it and working on it
everyday.
Guy Wi11iYs reported this started in November. Chazlene Hessier has been given some
extensions. An inspector went there Friday and saw fans blowing on the rabbit feces for
unknown reasons. Chazlene Hessler explained it was to dry it out. Mr. Willits went on to say
refuse is stored in a boat, the backyard has four vehicles, scattered refuse, and a three foot high
pile of rabbit feces. The stench is awful.
Gerry Strathman recommends denying the appeal.

The cunent properry owner is State of Minnesota Trust Exempt. The City has issued five
summary abatement notices. The cost to repair is $45,000 and the cost to demolish is $8,725.
Gregozy Von Rothkirch, Ramsey County Tax Forfeit and Land, appeazed and stated the property
was forfeited in August 1997. They have had possesslon since September. They would like to
offer the building at auction, however the Housing and Redevelopment Authority (HRA) wants
the property and has the right to obtain it first. The site is difficult topographically. If the house
is demolished, the lot will probably not be redeveloped. The house has been boarded three times
and is in an isolated location.
Gerry Strathman stated this property is in a serious state of disrepair and asked has it been a
prob]em. Chuck Votel responded it is repeatedly broken into, which is the primary problem.
Gregory Von Rothkirch stated May 28 is the next scheduled auction and there aze only two
auctions a yeaz.
Gerry Strathman recommends approvai of the 15 day order to repair or remove the buiiding. Mr.
Strathman urged Gregory Von Rothkirch to atiend the February 25 Council meeling to discuss
the matter with the City Council members who aze also the HRA.

WHEREAS, Department of Fire and Safety Services, Division of Code Enforcement has
requested the City Council to hold public hearings to consider the advisabiliry and necessity of
ordering the repair or wrecking and removal of a two-story, wood frame structure located on
property hereinafter referted to as the "Subject Property" and commonly known as 882 Greenbrier
5treet. This properry is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Division of Code Enforcement on or before October 14, 1997, the
following are the now known interested or responsible parties for the Subject Property: State of
Minnesota Trust Exempt, 620B Government Center West, 50 Kellogg Blvd. West, St. Paul, MN

WHEREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul I.egislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated November 5, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Properiy is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by December 5, 1997; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WFIEREAS, this nuisance condition has not been corrected and Division of Code
Enforcement requested that the City Clerk schedule public hearings before the Legislative Hearing
Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul I,egislative Code, of the time, date, place and
purpose of the public hearings; and

'QVHEREAS, a hearing was held before the L.egislative Hearing Officer of the Saint Paui City
Council on Tuesday, February 17, 1998 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the pubiic peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternaflve by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the Council Hearing; and
WFIEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February
25, 1998 and the testimony and evidence including the action taken by the L,egislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 882 Greenbrier Street:
1. That the Subject Property comprises a nuisance condition as de6ned in Saint Paul
I,egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to conect the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Bnforcement, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the S�bject Property safe
and not detrimental to the public peace, health, safety and welfaze and remove its blighting
influence on the community by rehabilitating this structure and conecting all de£iciencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicahle codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

1 2. If the above corrective action is not completed within this period of time the Fire and Safety
2 Services, Division of Code Enforcement is hereby authorized to take whatever steps are
3 necessary to demolish and remove this structure, fill the site and charge ffie costs incurred
4 against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul
5 Legislative Code.
7 3. In the event the building is to be demolished and removed by the City of Sainz Paul, all
8 personal property or fixtures of any kind which interfere with the demolition and removal
9 shall be removed from the property by the responsible parties by the end of this time period.
10 If all personal proper[y is not removed, it shall be considered to be abandoned and the City
11 of Saint Paul shall remove and dispose of such property as provided by law.

13 4. It is fiuther ordered, that a copy of this resolution be maIled to the owners and interested
14 parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.
