WHBREAS, Division of Code Enforcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislauve Code an order idenufied as an "Order to Abate Nuisance
Building(s)" dated November 14, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, tkus order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by December 15, 1997; and

WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Faul Legislative Code, of the tnne, date, place and
purpose of the public hearings; and

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 774 Ashland Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
L,egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00�.
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Enforcement, VacantlNuisance Buildings.
8. That the laiown interested parties and owners are as previously stated in this
resoluflon and that the notification requirements of Chapter 45 have been fulfilled,
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the communiry by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within ' after the

2. If the above corrective action is not completed within tlus period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul
L.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fiYtures of any kind which interfere with the demolition and removai
shall be removed from the properry by the responsible parties by the end of this time period.
If all personal properry is not removed, it shall he considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Pau1 Legislative Code.

Avenue West. If the owner fai]s to comply with the resolution, Public Health is ordered to
remove the building.
The Legislative Hearing Officer recommends approval of the I S day order to repair or
remove the buiiding.
2. Resolution ordering the owner to remove or repair the building located at 774 Ashland
Avenue. If the owner fails to compiy with the resolution, Pubiic Health is ordered to
remove the building.
The Legis]aUve Hearing Officer recommends 6 months to rehabilitate the building on
condition that a code compliance inspection is done and a$2,000 bond is posted by noon of
February 25, 1998.

Gerry Strathman called the meeting to order at 10:00 a.m.
774 Ashland Avenue
Chuck Votel reported the property has been vacant since February 1997. The current property
owner is Fleet Mortgage. 'I`he owner is currently doing minimal repairs and intends to convey
the properiy to Housing and Urban Development (HUD). The City has issued four summary
abatement notices and has boazded the building against trespass. The real estate taxes aze paid.
The inspectors were unable to estimate the cost to repair because they have not gained access to
the interior. It appears to be severely water damaged. The cost to demolish is $5,890.
Beth Asmussen, Fleet Mortgage, stated they would like extra time. They have paid the $100 fee
to have the code compliance completed. The bond will be posted and they would like six months
to find a buyer and make the necessary repairs. Pleet Mortgage is planning to convey the
building to HUD.
Gerry Strathman recommends 6 months to rehabilitate the bui]ding on condirion that a code
compliance inspection is applied for and a$2,000 bond is posted by noon of February 25, 1998.
579 Forest Street
Chazlene Hessler stated she has started to clean the gazage over the snmmer. The sides have been
cleaned. The cars are in running order. The property has been reinspected and new issues were
found. Some of the issues have been taken caze of such as the tires being removed. Ms. Hessler
was told she needed a permii for two or more rabbits and she now has the applications for the
permits. The yazd should be cleaned up by the end of the month with the warmer weather. Gerry
Strathman asked why it takes unti] the end of the month. Ms. Hessler responded there is metal
frozen in the ground that needs to be pulled up and they have been salting it and working on it
everyday.
Guy Willits reported this started in November. Chazlene Hessler has been given some
extensions. An inspector went there Friday and saw fans blowing on the rabbit feces for
unknown reasons. Chazlene Hessier explained it was to dry it out. Mr. Wiliits went on to say
refuse is stored in a boat, the backyazd has four vehicles, scattered refuse, and a three foot high
pile of rabbit feces. The stench is awfui.
Gerry Strathman recommends denying the appeal.

Chuck Votel reported this has been vacant since September 1997. The City has boazded the
building. The owner has been tagged for faiiure to pay fees and fot unlawful occupancy. In
December, the owner obtained a code compiiance inspecrion. The cost to repair is $40,000. The
owner has been uncooperative.
Gerry Strathman recommends approval of the 15 day order to repair or remove the building.
882 Greenbrier Street
Chuck Votel reported this building was condemned in July 1997 and has been vacant since then.
The current property owner is State of Minnesota Trust Exempt. The Ciry has issued five
summary abatement notices. The cost to repair is $45,000 and the cost to demolish is $8,725.
Gregory Von Rothkirch, Ramsey County Tax Forfeit and Land, appeazed and stated the property
was forfeited in August 1997. They have had possession since 5eptember. They would like to
offer the building at auction, however the Housing and Redevelopment Authority (HRA) wants
the property and has the right to obtain it first. The site Ss difficult topographicaily. If the house
is demolished, the lot wiil probably not be redeveloped. The house has been boarded three times
and is in an isolated location.
Gerry Strathman stated this property is in a serious state of disrepair and asked has it been a
prob3em. Chuck Votel responded it is repeatedly broken into, which is the primary problem.
Gregory Von Rotbkirch stated May 28 is the next scheduled auction and there aze only two
auctions a year.
Gerry Strathman recommends approva] of the 15 day order to repair or remove the building. Mr.
Strathman urged Gregory Von Rothkirch to attend the February 25 Council meeting to discuss
the matter with the City Council members who are also the HRA.

Gerry Strathman called the meeting to order at 10:00 a.m.
774 Ashland Avenue
Chuck Votel reported the property has been vacant since February 1997. The current property
owner is Fleet Mortgage. 'I`he owner is currently doing minimal repairs and intends to convey
the properiy to Housing and Urban Development (HUD). The City has issued four summary
abatement notices and has boazded the building against trespass. The real estate taxes aze paid.
The inspectors were unable to estimate the cost to repair because they have not gained access to
the interior. It appears to be severely water damaged. The cost to demolish is $5,890.
Beth Asmussen, Fleet Mortgage, stated they would like extra time. They have paid the $100 fee
to have the code compliance completed. The bond will be posted and they would like six months
to find a buyer and make the necessary repairs. Pleet Mortgage is planning to convey the
building to HUD.

Chazlene Hessler stated she has started to clean the gazage over the snmmer. The sides have been
cleaned. The cars are in running order. The property has been reinspected and new issues were
found. Some of the issues have been taken caze of such as the tires being removed. Ms. Hessler
was told she needed a permii for two or more rabbits and she now has the applications for the
permits. The yazd should be cleaned up by the end of the month with the warmer weather. Gerry
Strathman asked why it takes unti] the end of the month. Ms. Hessler responded there is metal
frozen in the ground that needs to be pulled up and they have been salting it and working on it
everyday.
Guy Willits reported this started in November. Chazlene Hessler has been given some
extensions. An inspector went there Friday and saw fans blowing on the rabbit feces for
unknown reasons. Chazlene Hessier explained it was to dry it out. Mr. Wiliits went on to say
refuse is stored in a boat, the backyazd has four vehicles, scattered refuse, and a three foot high
pile of rabbit feces. The stench is awfui.

Gregory Von Rothkirch, Ramsey County Tax Forfeit and Land, appeazed and stated the property
was forfeited in August 1997. They have had possession since 5eptember. They would like to
offer the building at auction, however the Housing and Redevelopment Authority (HRA) wants
the property and has the right to obtain it first. The site Ss difficult topographicaily. If the house
is demolished, the lot wiil probably not be redeveloped. The house has been boarded three times
and is in an isolated location.
Gerry Strathman stated this property is in a serious state of disrepair and asked has it been a
prob3em. Chuck Votel responded it is repeatedly broken into, which is the primary problem.
Gregory Von Rotbkirch stated May 28 is the next scheduled auction and there aze only two
auctions a year.

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 774 Ashland Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
L,egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00�.
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the Department of Fire and Safety
Services, Division of Code Enforcement, VacantlNuisance Buildings.
8. That the laiown interested parties and owners are as previously stated in this
resoluflon and that the notification requirements of Chapter 45 have been fulfilled,

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the communiry by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within ' after the

2. If the above corrective action is not completed within tlus period of time the Fire and Safety
Services, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fill the site and charge the costs incurred
against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul
L.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fiYtures of any kind which interfere with the demolition and removai
shall be removed from the properry by the responsible parties by the end of this time period.
If all personal properry is not removed, it shall he considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested

Strathman urged Gregory Von Rothkirch to attend the February 25 Council meeting to discuss
the matter with the City Council members who are also the HRA.
