2 documented in Finance Department File Number 21-1997, public properties hereinafter described are hereby
3 vacated and discontinued as public property:

7 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
8 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall pay all costs and expenses for any reconstruction of the ends of the
vacated street to properly eliminate the appearance of a publ3c tharoughfare in accardance with
the plans approved by the Ciry of Sa1nt Paul.
That a permanent fifteen foot (15')wide subterranean easement, centered on the centerline of the
street to be vacated, shall be retained between elevations 70 and 85 City datum wiihin the vacated
area, on behalf of the Department of Public Works for the protection of the exisung sewer.
A permanent fifteen foot (15') wide surface easement, centered on the centerline of the street,
shall be retained on, over and across the vacated area, from the west line of 7ackson Street to 180
feet westerly, on behalf of the Ciry of Saint Paul, Department of Public Works, for the access to
and maintenance of the existing sewer, subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects that will prohibit normal access to utiliry facilities for maintenance
purposes other than those approved by Permit Number 171000, dated February 2, 1948, will
be permitted within the easement area.
b. Improvements in or upon the above described easement other than those approved by Pernut
Number 1710Q0, dated February 2, 1998, that do not prohibit the City from exercising its
reserved rights may be allowed by obtaining written permission from the Department of
Public Works Sewer Division with the understanding that the restoration and costs of such
improvements shall be the sole responsibility of the petitioner, its successors and assigns
in the event the City exercises its reserved easement rights.

a No change of grade other than that approved by Permit Number 171000, dated February 2,
1998, issued by the City of Saint Paul, will be permitted within the easement area without
written pemussion from the Department of Public Works.
d. No change in surfacing other than that approved by Permit Number 171000, dated February 2,
1998, issued by the City of Saint Paul, wili be permitted within the easement area without
written permission from the Department of Pubiic Works.
e. Peutioner shall be responsible for its own actions with respect to any injuries or damages
received or sustained by any person, persons, or property on account of this vacation or
petitioner's use of this property, including but not limited to a claim brought because of
any act of omission, neglect, or misconduct of said petitioner or because of any claims or
IiabIlity arising from any violation of any law or rea lation made in accordance with the
law, whether by the petitioner or any of their agents or employees.
That a twenty foot(20') wide utility easement, along the northwesterly rivenry feet (20') of the
Right-of-Way of Thirteenth Street from Robert Street to Jackson Streei, shall be retained under
the area to be vacated for the benefit of District Energy St. Paul, Inc., to maintain, inspect,
repair or reconstruct the existing utility or any part thereof and to enter upon said easement or
any portion at any time and from time to time.
Petitioner shall be responsible for its own actions with respect to any injuries or damages
received or sustained by any person, persons, or property on account of this vacation or
petirioner's use of this progerty, including but not limited to a claim btought because of any act
of omission, neglect, or misconduct of said petitioner or because of any claims or liability
arising from any violation of any law or regulation made in accordance with the law, whether by the
petitioner or any of their agents or employees.
That the petitioner's their successors, and assigns, sha11 within 6Q days of the effective date of
this resolution, file with the City Clerk an acceptance in writing of the conditions of this
resoluuon and shall within the period(s) specified in the terms and conditions of this
resolution, comply in all respects with these terms and conditions.

On February 25, 1998, Council File No. 98-145 was laid over to allow for additional changes to the
Council Resolution proposing the vacation of Thirteenth Street from Robert to Jackson Streets. The
new Council Resolution now contains language acceptable by both the City and the petitioner and
needs to be signed and routed for consideration at the March 4th CitY Council hearins.

Beginni at the point of intersection of the northwesterly side of Thirteenth Street with
the ea side of Robert Street, thence northeasterly along the northwesterly side of
Thi enth Sueet to the westerly side of Jackson Street; thence southeasterly along the
e nded westerly line of Jackson Street a distance of twenry (20) feet; thence
uthwesterly along a line twenry (20) feet southeasterly of and parallel with the
northeasterly line of Thirteenth Street to the extended easterly line of Robert Street;
thence northwesteriy to the point of beginning.
7. � hat the petiuoner agrees to maintain a minimum of two feet (2') of cover over the direct buried
facilities of District Energy St. Pau1, Inc. within the above-described surface access and
subsurface easement area unless special structure provisions are installed to protect the shallow
depth.

The Minnesota Depariments of Admuustrarion and Revenue plan to construct a building for the
Department of Revenue in the Capitol Area. The proposed site plan for the project includes 13th
St. between Jackson St. and Robert St. The west side of 13th St. will be part of the plaza which
connects the building to the surface pazking (including handicapped parking). The plaza is
incorporated into the building entry and the Dahl house as shown on the proposed site plan. The
east side of 13th St. wili be a private entrance for deliver vehicles and visitors to the Central Park
United Methodist Church. The grade at 13th St. has not been finalized but will be higher than
the e�sting grade. The new building will not e�ctend onto 13th St.

The Department of Public Works has completed a review of the above referenced
proposal and has no objects subject to the following comments andlor requirements.
1. The petitioner shall pay afl costs and expenses for any reconstruction of the ends of
the vacated street, to properly eliminate the appearance of a public thoroughfare,
incfuding but not limited to, costs for new curbs, sidewalks, boulevards, storm drains,
and street sign removal, all to the satisfaction of the Department of Public Works.
2. The petitioner shall pay all costs and expenses related to the removal ofi two Nema
head street lights which wil{ be removed from wood NSP poles by the Department of
Public Works.
3. A 15 foot sewer easement, centered on the centerline of the street, shall be
retained on, over, under and across the vacated area, on behalf of the Department of
Public Works to maintain, inspect, repair or reconstruct the existing sewer.

SITBJECT: Finance Depariment File Number 21-97 (13th Street, Robert to Jackson)
The Water Utility has an 8-inch waxer main in that part of Thirteenth Street, between Robert and
Jackson Street proposed for vacation. To provide for continued access to our facility, the Water
Utility requires an easement be retained over the entire area petitioned for vacation.
Restrictions witlun the area are as follows:
1. No buiidings, structures ar trees are permitted wathin the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilitles for maintenance purposes without written
permission from the Water Ufility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utiliry.
3. Should it be necessazy that the petirioner's works or improvements be removed or
damaged as a result of Water Utility operations, ail removal, replacement or
modification costs sha11 be borne solely by the petifioner.
4. That the petitioner, its successors and assigns shall fully indemnify, defend and
save harmless the Board of Water Commissioners, its officers, agents, employees
and servants from ali suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any acfion
or negligence of the petitioner, its employees, agents or business invitee.

2 documented in Finance Department File Number 21-1997, public properties hereinafter described are hereby

7 This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the
8 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall pay all costs and expenses for any reconstruction of the ends of the
vacated street to properly eliminate the appearance of a publ3c tharoughfare in accardance with
the plans approved by the Ciry of Sa1nt Paul.
That a permanent fifteen foot (15')wide subterranean easement, centered on the centerline of the
street to be vacated, shall be retained between elevations 70 and 85 City datum wiihin the vacated
area, on behalf of the Department of Public Works for the protection of the exisung sewer.
A permanent fifteen foot (15') wide surface easement, centered on the centerline of the street,
shall be retained on, over and across the vacated area, from the west line of 7ackson Street to 180
feet westerly, on behalf of the Ciry of Saint Paul, Department of Public Works, for the access to
and maintenance of the existing sewer, subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects that will prohibit normal access to utiliry facilities for maintenance
purposes other than those approved by Permit Number 171000, dated February 2, 1948, will
be permitted within the easement area.
b. Improvements in or upon the above described easement other than those approved by Pernut
Number 1710Q0, dated February 2, 1998, that do not prohibit the City from exercising its
reserved rights may be allowed by obtaining written permission from the Department of
Public Works Sewer Division with the understanding that the restoration and costs of such
improvements shall be the sole responsibility of the petitioner, its successors and assigns
in the event the City exercises its reserved easement rights.

a No change of grade other than that approved by Permit Number 171000, dated February 2,
1998, issued by the City of Saint Paul, will be permitted within the easement area without
written pemussion from the Department of Public Works.
d. No change in surfacing other than that approved by Permit Number 171000, dated February 2,
1998, issued by the City of Saint Paul, wili be permitted within the easement area without
written permission from the Department of Pubiic Works.
e. Peutioner shall be responsible for its own actions with respect to any injuries or damages
received or sustained by any person, persons, or property on account of this vacation or
petitioner's use of this property, including but not limited to a claim brought because of
any act of omission, neglect, or misconduct of said petitioner or because of any claims or
IiabIlity arising from any violation of any law or rea lation made in accordance with the
law, whether by the petitioner or any of their agents or employees.
That a twenty foot(20') wide utility easement, along the northwesterly rivenry feet (20') of the
Right-of-Way of Thirteenth Street from Robert Street to Jackson Streei, shall be retained under
the area to be vacated for the benefit of District Energy St. Paul, Inc., to maintain, inspect,
repair or reconstruct the existing utility or any part thereof and to enter upon said easement or
any portion at any time and from time to time.
Petitioner shall be responsible for its own actions with respect to any injuries or damages
received or sustained by any person, persons, or property on account of this vacation or
petirioner's use of this progerty, including but not limited to a claim btought because of any act
of omission, neglect, or misconduct of said petitioner or because of any claims or liability
arising from any violation of any law or regulation made in accordance with the law, whether by the

On February 25, 1998, Council File No. 98-145 was laid over to allow for additional changes to the
Council Resolution proposing the vacation of Thirteenth Street from Robert to Jackson Streets. The
new Council Resolution now contains language acceptable by both the City and the petitioner and
needs to be signed and routed for consideration at the March 4th CitY Council hearins.

the ea side of Robert Street, thence northeasterly along the northwesterly side of
Thi enth Sueet to the westerly side of Jackson Street; thence southeasterly along the
e nded westerly line of Jackson Street a distance of twenry (20) feet; thence
uthwesterly along a line twenry (20) feet southeasterly of and parallel with the
northeasterly line of Thirteenth Street to the extended easterly line of Robert Street;
thence northwesteriy to the point of beginning.
7. � hat the petiuoner agrees to maintain a minimum of two feet (2') of cover over the direct buried
facilities of District Energy St. Pau1, Inc. within the above-described surface access and
subsurface easement area unless special structure provisions are installed to protect the shallow
depth.

Reason for Vacation
The Minnesota Depariments of Admuustrarion and Revenue plan to construct a building for the
Department of Revenue in the Capitol Area. The proposed site plan for the project includes 13th
St. between Jackson St. and Robert St. The west side of 13th St. will be part of the plaza which
connects the building to the surface pazking (including handicapped parking). The plaza is
incorporated into the building entry and the Dahl house as shown on the proposed site plan. The
east side of 13th St. wili be a private entrance for deliver vehicles and visitors to the Central Park
United Methodist Church. The grade at 13th St. has not been finalized but will be higher than
the e�sting grade. The new building will not e�ctend onto 13th St.

The Department of Public Works has completed a review of the above referenced
proposal and has no objects subject to the following comments andlor requirements.
1. The petitioner shall pay afl costs and expenses for any reconstruction of the ends of
the vacated street, to properly eliminate the appearance of a public thoroughfare,
incfuding but not limited to, costs for new curbs, sidewalks, boulevards, storm drains,
and street sign removal, all to the satisfaction of the Department of Public Works.
2. The petitioner shall pay all costs and expenses related to the removal ofi two Nema
head street lights which wil{ be removed from wood NSP poles by the Department of
Public Works.
3. A 15 foot sewer easement, centered on the centerline of the street, shall be
retained on, over, under and across the vacated area, on behalf of the Department of
Public Works to maintain, inspect, repair or reconstruct the existing sewer.

SITBJECT: Finance Depariment File Number 21-97 (13th Street, Robert to Jackson)
The Water Utility has an 8-inch waxer main in that part of Thirteenth Street, between Robert and
Jackson Street proposed for vacation. To provide for continued access to our facility, the Water
Utility requires an easement be retained over the entire area petitioned for vacation.
Restrictions witlun the area are as follows:
1. No buiidings, structures ar trees are permitted wathin the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilitles for maintenance purposes without written
permission from the Water Ufility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utiliry.
3. Should it be necessazy that the petirioner's works or improvements be removed or
damaged as a result of Water Utility operations, ail removal, replacement or
modification costs sha11 be borne solely by the petifioner.
4. That the petitioner, its successors and assigns shall fully indemnify, defend and
save harmless the Board of Water Commissioners, its officers, agents, employees
and servants from ali suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any acfion
or negligence of the petitioner, its employees, agents or business invitee.

That the petitioners, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That the petitioner shall pay all costs and expenses for any reconstruction of the ends of the
vacated street to properly eliminate the appearance of a publ3c tharoughfare in accardance with
the plans approved by the Ciry of Sa1nt Paul.
That a permanent fifteen foot (15')wide subterranean easement, centered on the centerline of the
street to be vacated, shall be retained between elevations 70 and 85 City datum wiihin the vacated
area, on behalf of the Department of Public Works for the protection of the exisung sewer.
A permanent fifteen foot (15') wide surface easement, centered on the centerline of the street,
shall be retained on, over and across the vacated area, from the west line of 7ackson Street to 180
feet westerly, on behalf of the Ciry of Saint Paul, Department of Public Works, for the access to
and maintenance of the existing sewer, subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects that will prohibit normal access to utiliry facilities for maintenance
purposes other than those approved by Permit Number 171000, dated February 2, 1948, will
be permitted within the easement area.
b. Improvements in or upon the above described easement other than those approved by Pernut
Number 1710Q0, dated February 2, 1998, that do not prohibit the City from exercising its
reserved rights may be allowed by obtaining written permission from the Department of
Public Works Sewer Division with the understanding that the restoration and costs of such
improvements shall be the sole responsibility of the petitioner, its successors and assigns
in the event the City exercises its reserved easement rights.

a No change of grade other than that approved by Permit Number 171000, dated February 2,
1998, issued by the City of Saint Paul, will be permitted within the easement area without
written pemussion from the Department of Public Works.
d. No change in surfacing other than that approved by Permit Number 171000, dated February 2,
1998, issued by the City of Saint Paul, wili be permitted within the easement area without
written permission from the Department of Pubiic Works.
e. Peutioner shall be responsible for its own actions with respect to any injuries or damages
received or sustained by any person, persons, or property on account of this vacation or
petitioner's use of this property, including but not limited to a claim brought because of
any act of omission, neglect, or misconduct of said petitioner or because of any claims or
IiabIlity arising from any violation of any law or rea lation made in accordance with the
law, whether by the petitioner or any of their agents or employees.
That a twenty foot(20') wide utility easement, along the northwesterly rivenry feet (20') of the
Right-of-Way of Thirteenth Street from Robert Street to Jackson Streei, shall be retained under
the area to be vacated for the benefit of District Energy St. Paul, Inc., to maintain, inspect,
repair or reconstruct the existing utility or any part thereof and to enter upon said easement or
any portion at any time and from time to time.
Petitioner shall be responsible for its own actions with respect to any injuries or damages
received or sustained by any person, persons, or property on account of this vacation or
petirioner's use of this progerty, including but not limited to a claim btought because of any act
of omission, neglect, or misconduct of said petitioner or because of any claims or liability
arising from any violation of any law or regulation made in accordance with the law, whether by the

On February 25, 1998, Council File No. 98-145 was laid over to allow for additional changes to the
Council Resolution proposing the vacation of Thirteenth Street from Robert to Jackson Streets. The
new Council Resolution now contains language acceptable by both the City and the petitioner and
needs to be signed and routed for consideration at the March 4th CitY Council hearins.

Thi enth Sueet to the westerly side of Jackson Street; thence southeasterly along the
e nded westerly line of Jackson Street a distance of twenry (20) feet; thence
uthwesterly along a line twenry (20) feet southeasterly of and parallel with the
northeasterly line of Thirteenth Street to the extended easterly line of Robert Street;
thence northwesteriy to the point of beginning.

subsurface easement area unless special structure provisions are installed to protect the shallow

Reason for Vacation
The Minnesota Depariments of Admuustrarion and Revenue plan to construct a building for the
Department of Revenue in the Capitol Area. The proposed site plan for the project includes 13th
St. between Jackson St. and Robert St. The west side of 13th St. will be part of the plaza which
connects the building to the surface pazking (including handicapped parking). The plaza is
incorporated into the building entry and the Dahl house as shown on the proposed site plan. The
east side of 13th St. wili be a private entrance for deliver vehicles and visitors to the Central Park
United Methodist Church. The grade at 13th St. has not been finalized but will be higher than
the e�sting grade. The new building will not e�ctend onto 13th St.

The Department of Public Works has completed a review of the above referenced
proposal and has no objects subject to the following comments andlor requirements.
1. The petitioner shall pay afl costs and expenses for any reconstruction of the ends of
the vacated street, to properly eliminate the appearance of a public thoroughfare,
incfuding but not limited to, costs for new curbs, sidewalks, boulevards, storm drains,
and street sign removal, all to the satisfaction of the Department of Public Works.
2. The petitioner shall pay all costs and expenses related to the removal ofi two Nema
head street lights which wil{ be removed from wood NSP poles by the Department of
Public Works.
3. A 15 foot sewer easement, centered on the centerline of the street, shall be
retained on, over, under and across the vacated area, on behalf of the Department of
Public Works to maintain, inspect, repair or reconstruct the existing sewer.

SITBJECT: Finance Depariment File Number 21-97 (13th Street, Robert to Jackson)
The Water Utility has an 8-inch waxer main in that part of Thirteenth Street, between Robert and
Jackson Street proposed for vacation. To provide for continued access to our facility, the Water
Utility requires an easement be retained over the entire area petitioned for vacation.
Restrictions witlun the area are as follows:
1. No buiidings, structures ar trees are permitted wathin the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilitles for maintenance purposes without written
permission from the Water Ufility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utiliry.
3. Should it be necessazy that the petirioner's works or improvements be removed or
damaged as a result of Water Utility operations, ail removal, replacement or
modification costs sha11 be borne solely by the petifioner.
4. That the petitioner, its successors and assigns shall fully indemnify, defend and
save harmless the Board of Water Commissioners, its officers, agents, employees
and servants from ali suits, actions or claims which shall arise from any injuries or
damages received or sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any acfion
or negligence of the petitioner, its employees, agents or business invitee.
