98-14Council File # I D ~ � Presented By RefeYred To Green Sheet # .7 � Q� RESOLUTION CITY OF SAINT PAUL, MINNESOTA � � n , Committee: Date PRELIMINARY AND FINAL PLAT FOR RAMSEY HILL TOWNHOMES ADDITION WHEREAS, Maui Pacific Inc. has submitted the attached preliminary and final plat for City Council approval; and WHEREAS, the appropriate city deparhnents have reviewed the plat and found it meets the requirements of Chapter 67 of the Zoning Code; and WHEREAS the common, interior "pariy walls" between units of the Ramsey Town homes are Two-Hour Fire-resistive wall assemblies which must maintain their structural and fire- resistance integrity to ensure the safety of the inhabitants; and WHEREAS, Maui Pacific, Inc. has proposed subdividing the properry which willlegally divide the units into separate land parcels with the property line located within common "party walls"; and WIIEREAS, alterations to said common, interior "party walls" must not be performed without proper approvals and permits from the Office of License, Ittspections and Environmental Protection (LIEP); and WIIEREAS, norice of the public hearing before the City Council was duly published in the official newspaper of the city and notices were mailed to each owner of affected property and property situated wholly of partly within 350 feet of the subject property; and WHEREAS, a public hearing before the City Council was held on November 12, 1997 at which all interested parties were heard, the Council having considered a11 the facts and recommendafions concerning the plat; NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and final plat for Ramsey Hill Townhomes Addition with the following conditions: l. That Maui Pacific Inc. sha11 file a copy of this Resolufion with the Ramsey County Recorder. Maui Pacific shall place a copy of this Resolution on each property deed withiu this development; and 2. That a copy of this Resolution shall be attached to and become part of the townhouse declaration for this development which shall be provided to each property purchaser and their successors; and 9 k-�� 3. This project is known as Ramsey Hill Townhomes. B. SITE & AREA CONDITIONS The Site is currently under construction and nearly completed of an 11-unit townhouse development. The property is located on Ramsey Street between Summit and Grand with 251 feet of frontage on Ramsey Street and a total lot area of approx. 34,190 square feet. The site has very steep slopes with the front of the property sloping down Ramsey Street from west to east and sloping from the front to the rear. The property is zoned RM-2 (residential multiple £amily). • C. BACKGROUND: The applicant is requesting the new plat to allow each new dwelling unit currently under construction to be sold separately and recorded with Ramsey County. The zoning code requires that the City Council approve a new plat prior to recording with the County. The proposed plat contains 11 new lots, one for each of the townhouse dwelling units, and a common area as an additional lot. The owner of each dwelling unit will own the property beneath their unit with the common property being owned in common by each property owner within the development. Each dwelling unit will have an attached 2-car garaqe at the rear of the dwelling. The garages will have access by a driveway from Grand Avenue throuqh the Wescern Avenue riaht-of-way. This requirement is necessary to correct past platting errors of the property and allow the new plat to be recorded correctly without error to both the plat and title of the property. As stated above, the applicant has requested the new plat to allow each new townhome unit on the property to be sold as separate units for ownership and recorded with Ramsey County. City Council approval o£ the plat is necessary to allow recording of the plat document. D. DISTRICT COUNCIL RECOD4dENDATION On April 22, 1997 the Zoning and Land Ose Committee of the Summit-Hill Association voted to support the development of the townhome project with the requested variance for the 11 unit on April 22. 1997. City staff have reviewed the proposed preliminary and final plat and determined that it meets all requirements and standards of the City. 2. The proposed subdi.vision will not be detrimental to the present and • potential surrounding land uses. The property can be developed with uses compatible to the area. 3. The area surrounding the subdivision can be planned and developed in coordination and compatibility with the proposed svbdivision. The surrounding area and the area of the proposed preliminary and final plat are compatible with respect to land uses. The area includes a mix of single family, duplex and multiple family dwellings. 4. The subdivision is in con£ozmance with the Comprehensioe Plan. Durinq that time most of the space between 345 Grand Avenue and 351 Grand Avenue has been a graveled parking lot, serving the homes at 343, 345, and 351 Grand Avenues, as well as 344 Ramsey Strest. All the space has been needed and used for parking, especially in the wlnter. Since July l, 1997, my park9ng spaces and �y access to 6rand Avenue have been obstructed, in Khole or in part, on numerous occasions, first by the damages caused by the .luly 1 flooding down Ramsey Street and subsequently by the construction activitles for the Ramsey Hill Townhomes. S1nce the outcome of the actess dlsputes and the boundary encroachments N111 Tikely affect all eleven units of the proposed subdivision. I request that finai approval of the propased subdivision be dela�yed until the above matters can be clarifled and resolved. I request that the City reyuire the developer to provide a survey certlfied by a licensed surveyor to show all the varlous easements, all boundary lines, and the lotation of improvements as constructed. Tf thls lnformation is not reQuired prior to subdivision approval, the City at a miniawm will not fiave accurate informatlon for future city maps. At worst, the City by approving the propased subdivision w111 be adding further complication to an already compiicated �ess. Moreover, whenever Maui Paclfic has done sometfiing which adversely affects the neighbors, they have indicated that they h�ve tity approval to do rhat they want to do, or that they don't need city approval to do what they want to do. Tfie role of the city in giving approval to constructton of improvements which encroach on neighboriog property w111 likely involve the city in costly litigation at some future date if those problems are not resolved now. The site has very steep slopes with the front of the property sloping down Ramsey Street from west to east and sloping from the front to the rear. The property is zoned RM-2 (residential multiple £amily). • C. BACKGROUND: The applicant is requesting the new plat to allow each new dwelling unit currently under construction to be sold separately and recorded with Ramsey County. The zoning code requires that the City Council approve a new plat prior to recording with the County. The proposed plat contains 11 new lots, one for each of the townhouse dwelling units, and a common area as an additional lot. This requirement is necessary to correct past platting errors of the property and allow the new plat to be recorded correctly without error to both the plat and title of the property. As stated above, the applicant has requested the new plat to allow each new townhome unit on the property to be sold as separate units for ownership and recorded with Ramsey County. City Council approval o£ the plat is necessary to allow recording of the plat document. D. DISTRICT COUNCIL RECOD4dENDATION On April 22, 1997 the Zoning and Land Ose Committee of the Summit-Hill Association voted to support the development of the townhome project with the requested variance for the 11 unit on April 22. 1997. All the space has been needed and used for parking, especially in the wlnter. S1nce the outcome of the actess dlsputes and the boundary encroachments N111 Tikely affect all eleven units of the proposed subdivision. I request that finai approval of the propased subdivision be dela�yed until the above matters can be clarifled and resolved. I request that the City reyuire the developer to provide a survey certlfied by a licensed surveyor to show all the varlous easements, all boundary lines, and the lotation of improvements as constructed. Tf thls lnformation is not reQuired prior to subdivision approval, the City at a miniawm will not fiave accurate informatlon for future city maps. At worst, the City by approving the propased subdivision w111 be adding further complication to an already compiicated �ess. Moreover, whenever Maui Paclfic has done sometfiing which adversely affects the neighbors, they have indicated that they h�ve tity approval to do rhat they want to do, or that they don't need city approval to do what they want to do. Tfie role of the city in giving approval to constructton of improvements which encroach on neighboriog property w111 likely involve the city in costly litigation at some future date if those problems are not resolved now. The property is located on Ramsey Street between Summit and Grand with 251 feet of frontage on Ramsey Street and a total lot area of approx. 34,190 square feet. The site has very steep slopes with the front of the property sloping down Ramsey Street from west to east and sloping from the front to the rear. The property is zoned RM-2 (residential multiple £amily). • C. BACKGROUND: The applicant is requesting the new plat to allow each new dwelling unit currently under construction to be sold separately and recorded with Ramsey County. The zoning code requires that the City Council approve a new plat prior to recording with the County. The proposed plat contains 11 new lots, one for each of the townhouse dwelling units, and a common area as an additional lot. The owner of each dwelling unit will own the property beneath their unit with the common property being owned in common by each property owner within the development. Each dwelling unit will have an attached 2-car garaqe at the rear of the dwelling. The garages will have access by a driveway from Grand Avenue throuqh the Wescern Avenue riaht-of-way. This requirement is necessary to correct past platting errors of the property and allow the new plat to be recorded correctly without error to both the plat and title of the property. As stated above, the applicant has requested the new plat to allow each new townhome unit on the property to be sold as separate units for ownership and recorded with Ramsey County. City Council approval o£ the plat is necessary to allow recording of the plat document. D. DISTRICT COUNCIL RECOD4dENDATION On April 22, 1997 the Zoning and Land Ose Committee of the Summit-Hill Association voted to support the development of the townhome project with the requested variance for the 11 unit on April 22. 1997. City staff have reviewed the proposed preliminary and final plat and determined that it meets all requirements and standards of the City. 2. Until recent n�onths, I have en�oyed unobstructed use of the parking lot and drivewa�y between 3�5 and 351 Grand Avenue for parking of �y cars and access to Grand Avenue, pursuant to �y written lease with General Propertles. Durinq that time most of the space between 345 Grand Avenue and 351 Grand Avenue has been a graveled parking lot, serving the homes at 343, 345, and 351 Grand Avenues, as well as 344 Ramsey Strest. All the space has been needed and used for parking, especially in the wlnter. Since July l, 1997, my park9ng spaces and �y access to 6rand Avenue have been obstructed, in Khole or in part, on numerous occasions, first by the damages caused by the .luly 1 flooding down Ramsey Street and subsequently by the construction activitles for the Ramsey Hill Townhomes. In addition, � physical inspection of the retaining wall constructed between 356 Rainisey �nd 344 Ramsey w111 disclose that the wall was constructed with an encroacMnent tnto the property at 344 Ramsey Street, accordSng to the survey monuments placed by the developer's surveyor. A physical lnspection will also disclose that the driveway to the townhouse pro�act w�s constructed so as to encroach upon tfie property owned by General Propertles at 356 Grand Avenue, snd to cause surface water to run inte the garage for 356 GranA. S1nce the outcome of the actess dlsputes and the boundary encroachments N111 Tikely affect all eleven units of the proposed subdivision. I request that finai approval of the propased subdivision be dela�yed until the above matters can be clarifled and resolved. I request that the City reyuire the developer to provide a survey certlfied by a licensed surveyor to show all the varlous easements, all boundary lines, and the lotation of improvements as constructed. Tf thls lnformation is not reQuired prior to subdivision approval, the City at a miniawm will not fiave accurate informatlon for future city maps. At worst, the City by approving the propased subdivision w111 be adding further complication to an already compiicated �ess. Moreover, whenever Maui Paclfic has done sometfiing which adversely affects the neighbors, they have indicated that they h�ve tity approval to do rhat they want to do, or that they don't need city approval to do what they want to do. Tfie role of the city in giving approval to constructton of improvements which encroach on neighboriog property w111 likely involve the city in costly litigation at some future date if those problems are not resolved now.
