RESOLUTION
CITY OF SAINT PAUL, MINNESOTA �

WHEREAS, on May 6, 1998 the Council approved Final Order CF#98-352, thereby acquiring
permanent slope easements for the realignment of Prosperity Avenue; and
WHEREAS, the majority of grading work for the said realignment having been completed, the
Department of Public Works has no further need for the acquired slope easements; and
WHEREAS, the Department of Public Works has negotiated an agreement with Jerry's Enterprises that
requires release of the said slope easements by February 11, 1999;
io THEREFORE BE IT RESOLVED, that the slope easements acquired by CF#98-352, as shown on the
i i attached drawing, are hereby released.

The majority of the grading work on the above referenced project has been completed.
We have an agreement with Jerry's Enterprises that requires that the slope easements
on their property be released by February 11, 1999. I would also like to release the
other slope easements we took in order to clear up the titie of the parcels for future
development.
Please proceed with the release of the slope easements which are highlighted on the
attached drawing.

northwesterly of the northwest right-of-way line of Prosperity Avenue, as
established by Council File No. 180711, adopted by the Council on December
11, 1956, and all of Lot 20, Block 3, Kiefer Park; and
• temporary construction easements, to expire on December 31, 1999, on, over

A public hearing having been had upon the above improvement upon due
notice, and the Council having heard all persons, objections and
recommendations relative thereto, and having fully considered the same;
therefore, be it

improvement to be made
