98-1081City of St. Paul � RESOLUTION APPROVING AS3E35MENT AND FIXING TIME OF HEARING THEREON AND F27CING TIME OF FiEARING ON THE AWARD OF D1�.MAGES COUNCIL'FILE NO. �6 " IOS� By File No. _18875E �9 In the matter of condemning and taking easements near the intersection of Marillac Lane and Point Douglas Road described as follows_ A 2� foot wide permanent sewer easement over, under and across part of the north one half of the northeast one quarter of Section 23, Township 28 North, Range 22 West of the 4th Principal Meridian and part of Lots 8 and 9, Block 1, St. Joseph's Hill, Ramsey County, Minnesota, the centerline of said sewer easement being described as follows: Commencing at the northeast corner of said Section 23; POAP(.4{1Ff9 thence west along the north line of said Section 23, a distance of 1725.58 feet to the east line of Point �Q� 21999 Douglas Road; thence southeasterly along the east line of said Point Douglas Road, at an angle of 72 degrees 25 minutes 03 seconds to the right, a distance of 1,042.62 feet to the point of beginning; thence deflecting to the left 73 degrees 10 minutes 04 seconds, a distance of 242.71 feet; thence deflecting to the left 43 degrees 04 minutes 12 seconds, a distance of 81.�0 feet; thence deflecting to the left 18 degrees 59 minutes 37 seconds, a distance of 75.00 feet; thence deflecting to the right 25 degrees 35 minutes 35 seconds, a distance of 129.00 feet; thence deflecting to the right 10 degrees 14 minutes 05 seconds, a distance of 68.00 £eet; thence deflecting to the right 35 degrees 15 minutes 36 seconds, a distance of 89.00 feet; thence deflecting to the right 18 degrees 31 minutes 00 seconds, a distance of 23,00 feet; thence deflecting to the left 87 degrees 10 minutes 35 seconds, a distance of 40.00 feet; thence deflecting to the right 68 degrees 21 minutes 35 seconds, a distance of 37.00 feet more less to the intersection with the Marillac Lane cul-de-sac and there terminating. Said intersection being 40.00 feet north of and measured at a right angle to the north line of said Lot 9, Block l, St. Joseph's Hill. The side easement lines are to be shortened to terminate on the east right of way line of Trunk Highway No. 61 and prolonged or shortened to terminate on the most easterly side of the Marillac Lane cul-de-sac. Also, a temporary construction easement being 10 feet in width and adjoining both sides of the above described permanent sewer easement. Said temporary construction easement to terminate on °l�'lo�l June 30, 1999, or at the completion of the project, whichever occurs first. Said temporary easement lines are to be shortened to terminate on the east right of way line of Trunk Highway No. 61 and prolonged or shortened to terminate on the most easterly side of Marillac Lane cul-de-sac. Preliminary Order 98-736 approved August 12, 1998 Final Order 98-913 approved October 7, 199 The Director of Technology having submitted his report in the above matter as to the amount of damages awarded for the taking of the land or easements therein appropriated for the above improvement and to whom payable; and also having submitted his assessment of benefits to property from the making of said improvement, therefore be it RESOLVED, That the said assessment of benefits be and the same is hereby approved. RESOLVED FURTHER, That a public hearing be had before the Council upon said report and for a confirmation of the award of damages made by the Director of Technology and also upon the said assessment of benefits; at the Council Chamber, in the Court House in the City of St. Paul on the 27th dav of Januarv, 1999, at the hour of 5:30 o'clock P.M. and that the Director of Technology be and he is directed to give notice of said hearing as prescribed by the Charter.
