WIIEREAS, the City of Saint Paul (City) entered into a"Corrective Plan AgreemenY' regarding the
Institutional Network with Continental Cablevision of Saint Paul, Ina (d.b.a. MediaOne) on December 22,
1997 (Council File 97-1552); and
WHEREAS, the Correcrive Plan Agreement incorporates the Corrective Plan dated December 18, 1997; and
5 WHEREAS, the Corrective Plan states that the upgrade will be completed by August 1, 1998, uniess the time
6 for completion is extended in accordance with the Corrective Plan Agreement; and
7 WHEREAS, the City may extend the upgrade deadline beyond August 1, 1998; and
8 WHEREAS, the City previously agreed to extend the date for completion of the upgrade until November 15,
9 1998 (Council File 98-700); and
10 WHEREAS, MediaOne has requested that the date for completion of the upgrade be further extended to
11 December 31, 1998; now, therefore, be it
12 RESOLVED, the City agrees to extend the date for completion ofthe Corrective Plan upon the following terms:
13 1. MediaOne will accept responsibility for the costs of I-Net drops for which the City had previously
14 accepted responsibility having a value of approximately $25,000.
15 2. MediaOne will provide internal wiring for buildings designated by the City in the amount of
16 $10,000.
17 3. In the event that the Corrective Plan construction is not completed by December 31, 1998,
18 MediaOne agrees to pay liquidated damages to the City in the amount of $5,000 for each week or part
19 of week beyond December 31, 1998 that construction of the upgraded I-Net is not completed.
20 4. In the event that the upgraded I-Net does not meet the acceptance test requirements ofthe Corrective
21 Plan, MediaOne agrees to pay liquidated damages to the City in the amount of $5,000 far each week
22 or part of a week, following the 30 day acceptance period and a subsequent 90 day operation review
23 period, until such time as the upgraded I-Net meets acceptance test requirements.
24 5. MediaOne agrees to make a grant to the City for purposes of I-Net development in the amount of
25 $65,000; and be it
26 FINALLY RESOLVED, that appropriate City ofFicials aze authorized to enter into an agreement, in a form
27 approved by the City Attorney, containing the provisions stated herein, eatending the completion date for the
28 I-Net upgrade to be December 31, 1998.
