1 WHEREAS the St. Paul City Council passed a Resolution (C.F.#98-148) regarding the
2 abatement of a nuisance building located at 774 Ashland Avenue in the City of St. Paul, a
3 resolution which was adopted on February 25, 1998 and which provided in pertinent part that the
4 Department of Fire & Safety Services, Division of Code Enforcement would demolish the
5 structure if the property owners did not make all repairs necessary for code compliance within six
6 months of said resolution; now therefore
8 BE IT RESOLVED that Resolution Council File Number 98-148 requiring the
9 rehabilitation or demolition of the properiy located at 774 Ashland Avenue within six months

shall be amended in part as follows;

The Saint Faul City Council hereby makes the following order:
The above-referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and weifare and remove its
blighting influence on the community by rehabilitating this structure and cortecting a11
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the shucture sha11 be completed within six (6) months
after the �assin�of this resolution.
The owner of subject property shall be responsible for any and all demolifion costs which
have been incurred, to date, by the City of St. Paul on 774 Ashland Avenue.

1 BE IT FURTHER RESOLVEA that, in the event that the owner of subject property fails
2 to complete the rehabilitation of subject property and to bring the property into compliance
3 with all applicable codes within six (6) months, the St. Paul City Council requests that the
4 St. Paul Departrnent of Planuing and Economic Development explore the feasibility of
5 acquiring subject property by eminent domain or funding the acquisition of subject
6 property by a third party.
