98-101Council File ORIGINAL Presented By Referred to RESOLUTION OF PAUL, MINNESOTA Green Sheet # 98-�0/ # �3 3�`1 ii Co�aittee: Date 1 WHEREAS, the City of Saint Paul, Division of Pazks & Recrearion provides a variety of 2 activities to youth including track & field; and 3 WI�REAS, Macalester College of Saint Paul owns land at 1600 Grand Avenue; and 4 5 WEIEREAS, the land includes an athletic track; and 6 WAEREAS, Saint Paul Parks and Recreation is in need of space for its growing program; 7 and 8 WHEREAS, Macalester College gave permission to Parks and Recreation to use the field 9 space for track from April 1 to August 15 1998; and lo il 12 13 14 15 16 17 NOW THEREFORE BE IT RESOLVED, that the City of Saint Paul shall defend and hold hazmless Macalester College when using the field space for the City's track program. This indemnification dces not include injuries or damages arising from hidden traps or dangerous conditions of the track itself. It is the understanding of the parties that the defenses immunities provided the City and Macalester College by Minn. Statute 466.01 et. sq�e not waived by virtue of this agreement.
