WHEREAS, Public Health has requested the City Council to hold public hearings to consider
the advisability and necessity of ordering the repair or wrecking and removal of a two-story, wood
frame dwelling located on property hereinafter referred to as the "Subject Property" and commonly
known as 275 Harrison Avenue. This properry is legally described as follows, to wit:

of outlots to the town of Saint Paul
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Health on or before March 20, 1997, the following are the now
known interested or responsible parties for the Subject Property: State of Minnesota Trust Exempt,
620B Government Center West, SQ Kellogg Blvd. West, St. Paul, MN 55102; First Trust, Attn:
I.egal Dept., 350 Robert Street North, Ste. 495, St. Paul, MN 55101; Ann P. Hipp, 3835 Swift
Avenue, Apt. 314, San Diego, CA 92104-3174; Valley Paving Inc., 8800 13th Avenue East,
Shakopee, MN 55379; C�rt Potts (Currency Exchange), 981 Payne Avenue, St. Paul, MN 55101
WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the �
Saint Paui I,egislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
March 19, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Properry is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by April 18, 1997; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condiuon; subject to demolifion; and
WHEREAS, this nuisance condition has not been corrected and Public Health requested that
the City Clerk schedule public hearings before the Legislative Hearing O�cer of the City Council
and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, November 4, 1997 to hear testunony and evidence, and after receiving
testunony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental Co the public peace, health,
safety and welfaze and remove its blighting influence on the community by rehabilitating this
shucture in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitarion ar demolirion of the structure to be completed within �"�*°°���� after the

WHBREAS, a hearing was held befare the Saint Paul City Council on Wednesday,
November 12, 1997 and the testimony and evidence including the acuon taken by the I.egislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 275 Harrison Avenue:
1. That the 5ubject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. `Lhat the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct ffie deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantlNuisance Buildings
Code Enforcement Program.
8. That the lrnown interested parties and owners are as prev3ously stated in tlus
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrunental to the public peace, health, safery and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance BuIlding(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or

1 2. If the above correcfive action is not completed within this period of time the Pubiic Health,
2 Code Enforcement Program is hereby authorized to take whatever steps are necessary to
3 demolish and remove this structure, fill the site and charge the costs incurred against the
4 Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legisladve Code.

3. In ffie event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fiYtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Izgislative Code.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
Vacant lot at 5W comer of Londin Place and Londia Lane
Donald McCollough, owner of the boat parked on this property, stated that he has used this
winter storage space for two years. Before parking it there, he contacted the zoning office and
was informed that there would be no problem. Mr. McCollough asked for permission to leave
the boat there this winter, with the understanding that he will find another parking situation next
year.
Don Juenemann, Public Health, reported that the owner of the property is Thomas T.
Lingenfeiter. He also informed Mr. Lingenfelter with respect to the parking ordinance and
request for paving residential pazking spaces. Mr. Juenemann stated that the ordinance, which
was enacted in February, 1993, does aliow the pubiic five years to comply.
Mr. Strathman recommends denying the appeal and aliowing Mr. McCollough until May 1, 1998
to remove the boat from the property.
1050 Iglehart Avenue (Laid over from September 16�' )
Reneta Weiss, Public Health reported that more Sununary Abatements have been issued since
September 16 The property is stili owned by the State of Minnesota Trust ExemptlRamsey
County. HRA was informed of this hearing, however, has made no response. The property
continues to be a nuisance.
Gerry Strathman, Legislative Hearing Officer, recommends approval of the order to repair or
remove the building with fifteen (15) days.
275 Harrison Avenue (Laid over from November 12`" )
Reneta Weiss, Public Heaith, reported that she received a telephone call last week from a
genfleman who is purchasing the property. December 15`� he posted a$2,0�0 performance bond
and ordered a code compliance inspection. He requests six-months to rehabilitate the buiiding.
Gerry Strathman, Legislative Hearing Officer, recommends allowing the new owner six-months
to rehabilitate.

Employee Credit Union. No decision has beea made as to how they wiIl proceed with this
building. Reai Estate taYes aze unpaid in the amount of $2,980. Code Enforcement Inspectors
estimate the cost to repair is $50,000 - cost to demolish is $5,800. Public Health submitted
orders that the property owner repair or remove this structure within fifteen {15) days, otherwise
Public Health is authorized to demolish and assess tke cost to the property t�es.

Chuck Votel, Public Health, reported that tlus pmperty is owned by Mid America Bank.
Mr. Votel advised that the bank is undecided as to how they will proceed with tlus building.
Real Estate tal�es are unpaid in the amount of $1,382. Code Bnforcement Inspectors estimate the
cost to repair is $60,000 - cost to demolish is $1Q000. Mr. Votel stated that Public Health has
received many complaints from Riverview Crime Prevention and neighborhood associations
with respect to this property. Public Health submitted orders that the property owner repair or
remove this structure within fxfteen (15) days, otherwise Public Heaith is authorizad to demolish
and assess the cost to the property taxes.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
Vacant lot at 5W comer of Londin Place and Londia Lane
Donald McCollough, owner of the boat parked on this property, stated that he has used this
winter storage space for two years. Before parking it there, he contacted the zoning office and
was informed that there would be no problem. Mr. McCollough asked for permission to leave
the boat there this winter, with the understanding that he will find another parking situation next
year.
Don Juenemann, Public Health, reported that the owner of the property is Thomas T.
Lingenfeiter. He also informed Mr. Lingenfelter with respect to the parking ordinance and
request for paving residential pazking spaces. Mr. Juenemann stated that the ordinance, which
was enacted in February, 1993, does aliow the pubiic five years to comply.
Mr. Strathman recommends denying the appeal and aliowing Mr. McCollough until May 1, 1998
to remove the boat from the property.
1050 Iglehart Avenue (Laid over from September 16�' )
Reneta Weiss, Public Health reported that more Sununary Abatements have been issued since
September 16 The property is stili owned by the State of Minnesota Trust ExemptlRamsey
County. HRA was informed of this hearing, however, has made no response. The property
continues to be a nuisance.
Gerry Strathman, Legislative Hearing Officer, recommends approval of the order to repair or
remove the building with fifteen (15) days.
275 Harrison Avenue (Laid over from November 12`" )
Reneta Weiss, Public Heaith, reported that she received a telephone call last week from a
genfleman who is purchasing the property. December 15`� he posted a$2,0�0 performance bond
and ordered a code compliance inspection. He requests six-months to rehabilitate the buiiding.
Gerry Strathman, Legislative Hearing Officer, recommends allowing the new owner six-months
to rehabilitate.

estimate the cost to repair is $50,000 - cost to demolish is $5,800. Public Health submitted
orders that the property owner repair or remove this structure within fifteen {15) days, otherwise

Mr. Votel advised that the bank is undecided as to how they will proceed with tlus building.
Real Estate tal�es are unpaid in the amount of $1,382. Code Bnforcement Inspectors estimate the
cost to repair is $60,000 - cost to demolish is $1Q000. Mr. Votel stated that Public Health has
received many complaints from Riverview Crime Prevention and neighborhood associations
with respect to this property. Public Health submitted orders that the property owner repair or
remove this structure within fxfteen (15) days, otherwise Public Heaith is authorizad to demolish
and assess the cost to the property taxes.

1. That the 5ubject Property comprises a nuisance condition as defined in Saint Paul

2. `Lhat the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct ffie deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacantlNuisance Buildings
Code Enforcement Program.
8. That the lrnown interested parties and owners are as prev3ously stated in tlus
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe

Saint Paul Public Health has declued this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then knorvn
responsible parties to eliminate this nuisance condition by conecting the deficiencies or by
razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this properiy. It is
the recommendation of Public Health that the City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Heaith to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
Vacant lot at 5W comer of Londin Place and Londia Lane
Donald McCollough, owner of the boat parked on this property, stated that he has used this
winter storage space for two years. Before parking it there, he contacted the zoning office and
was informed that there would be no problem. Mr. McCollough asked for permission to leave
the boat there this winter, with the understanding that he will find another parking situation next
year.
Don Juenemann, Public Health, reported that the owner of the property is Thomas T.
Lingenfeiter. He also informed Mr. Lingenfelter with respect to the parking ordinance and
request for paving residential pazking spaces. Mr. Juenemann stated that the ordinance, which
was enacted in February, 1993, does aliow the pubiic five years to comply.
Mr. Strathman recommends denying the appeal and aliowing Mr. McCollough until May 1, 1998
to remove the boat from the property.

Reneta Weiss, Public Health reported that more Sununary Abatements have been issued since
September 16 The property is stili owned by the State of Minnesota Trust ExemptlRamsey
County. HRA was informed of this hearing, however, has made no response. The property
continues to be a nuisance.
Gerry Strathman, Legislative Hearing Officer, recommends approval of the order to repair or
remove the building with fifteen (15) days.
275 Harrison Avenue (Laid over from November 12`" )
Reneta Weiss, Public Heaith, reported that she received a telephone call last week from a
genfleman who is purchasing the property. December 15`� he posted a$2,0�0 performance bond
and ordered a code compliance inspection. He requests six-months to rehabilitate the buiiding.
Gerry Strathman, Legislative Hearing Officer, recommends allowing the new owner six-months
to rehabilitate.

Employee Credit Union. No decision has beea made as to how they wiIl proceed with this
building. Reai Estate taYes aze unpaid in the amount of $2,980. Code Enforcement Inspectors
estimate the cost to repair is $50,000 - cost to demolish is $5,800. Public Health submitted
orders that the property owner repair or remove this structure within fifteen {15) days, otherwise
Public Health is authorized to demolish and assess tke cost to the property t�es.

Mr. Votel advised that the bank is undecided as to how they will proceed with tlus building.
Real Estate tal�es are unpaid in the amount of $1,382. Code Bnforcement Inspectors estimate the
cost to repair is $60,000 - cost to demolish is $1Q000. Mr. Votel stated that Public Health has
received many complaints from Riverview Crime Prevention and neighborhood associations
with respect to this property. Public Health submitted orders that the property owner repair or
remove this structure within fxfteen (15) days, otherwise Public Heaith is authorizad to demolish
and assess the cost to the property taxes.
