97-983Council File # 9*1-98'� Green Sheet # � \� r`. ` � ' RESOLUTION CITY OF SAINT PAU,l2 MINNESOTA /'� Presented By Referred To 1 2 3 4 5 6 Committee: Date RESOLVED, that, upon execurion and delivery of a release in full to the City of Saint Paul, the proper Ciry officers are hereby authorized and directed to pay from the Tort Liability Fund, 09081-0511, to American Family Insurance, far Dung Phan, the sum of $6,011.21 in full settlement of their indemnification claim for damages sustained on November 28, 1995 as a result of an accident with a City-owned vehicle at or near Munster Avenue and West Seventh Street. 7 The Minnesota No-Fault Automobile Insurance Act states that an insurer is entitled to collect 8 payments made on behalf of an insured if the at-fault vehicle weight exceeds 5,500 pounds. 4 The City's snow plow weighs in excess of 5,500 pounds. The snow plow driver was cited for 10 failure to yield the right-of-way. I settled this claim at 60 percent, based on the comparative 11 fault of the drivers.
