97-972Council File # _��g C3reen Sheet # 3 �118' G RESOLUTION CITY OF SAINT PAUL, MINNESOTA �t� /' (It._. - Presented Referred To Committee: Date 1 2 3 4 5 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate 6 the sub}ect of noise in the City of Saint Paul; and 7 8 WHEREAS, §29311 provides for the granring of variances from the sound level 9 limitations contained in §293.09, upon a finding by the City council that full compliance with 10 Chapter 293 would constitute an unreasonable hardship on an applicant, other persons ar on 11 the community; and 12 13 WIIEREAS, the City of Saint Paul has been given the opportunity, as one of seven 14 ciries throughout the nation, to offer Movies in the Park featuring Walt Disney movies; and 15 16 WHEREAS, the D'avision of Pazks and Recreation, represented by Robert Piram, has 17 applied for a variance to a11ow presentation of these Walt Disney movies at Como Park's 18 McMurray Fields on August 7, August 8, August 9, and August 10, 1997; and 19 20 WHEREAS, the Division intends to present one ninety minute Disney movie on each 21 of the four nights, open to the public without fee, and will need to have sound for the films 22 amplified; and 23 24 WEIEREAS, applicant is seeking a variance for the hours of 8:45 pm. to 10:15 pm. ZS on each of the four consecufive days; and 26 27 WHEREAS, if applicant is not granted a vaziance it will not be able to present the 28 movies and the citizens of Saint Paul will not have the opportunity to attend a family event 29 free of charge; now therefore, be it 30 31 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to the 32 Division of Parks and Recrearion, subject to the following condifions: 33 34 1) The variance shall be for the hours of 8:45 p.m. to 10:15 pm. 35 on each of the four successive nights. 36 37 2) All electronically powered equipment used in conjuncfion with 38 the event shall not exceed 90 dBA as measured at the sound mix. 39 40 3) The applicant shali provide personnel and equipment who sha11 41 provide continuous sound level monitoring between 8:45 p.m. 42 and 10:15 pm. on all four dates to ensure compliance with 43 Condition #2. 1 2 3 4 5 6 7 By: �...
