Committee: Date WHEREAS, The Divi n of Parks and Recreation's annual Gus Macker 3-on-3 Basketball Tournament will be held on the streets in the City's lowertown area on August 16 and 17, 1997, and; WHEREAS, The area near the intersection oP Sixth and Jackson Streets lacks adequate space to place the Volunteer/V.I.P. Tent for the Tournament, and; WHEREAS, Agri Bank F C B Incorporated is willing to allow the City to use its parking lot on the corner of Jackson and Sixth Streets for the duration of the Gus Macker Tournament as the site for the Tournament's Volunteer/V.I.P, teant and; WHEREAS, Agri Bank F C B has asked the City to indemnify and hold them harmless during the use o£ their lot, now, there£ore be it 11 RESOLVED, that the City Council of the City of Saint Paul on behalf of the City 12 of Saint Paul, hereby agrees to defend, indemnify and hold harmless the Agri Bank F C B 13 Incorporated, from all damaqes it may be required to pay as a result of suits, claims, 14 actions and judgements arising out of the use of the parkinq lot for the Volunteer/VIP 15 tent and Jor activities connected with such use, by reason of any act o£ negligence or 16 ommission by the City of Saint Paul, its, contractors, agents or employees; and be it 17 FURTHER RESOLVED that the foregoing defense and indemnification does not include: 18 1) injuries or damages arising £rom hidden traps or dangerous conditions in the parking 19 lot facility as to which Aqri Bank had actual or constructive notice; 2) injuries or 20 damages arising out of occurxences or events which are not a part o£ the use of the 21 tent as a Voluteer/VIP tentduring the hours the Gus Mackex Tournmament is takinq place 22 on August 16 & 17, 1997; and be it 23 FURTHER RESOLVED that nothing in the foregoing provisions shall be construed as a 24 waiver of the municipal tort liability limits as set forth in Minn.
