WHEREAS, based upon utility easement Certificates of Intended Non-Use filed voluntarily on behalf
of U S West Communications, Inc. and the Department of Public Woxks, and made a part hexeof by
this reference and filed in the office of the City Clerk of Saint Paul, the City for itself and on behalf of
these corporations and departments, waives the right to utility easements in the vacated azeas as
described in the certificates incorporated herein.
NOW THEREFORE, BE TT RESOLVED, pursuant to Section 130.Ob of the Saint Paul Legislative
Code and on behalf of the Ciry of Saint Paul and those persons for whom the City has reserved
easements, the Council of the City of Saint Paul does hereby waive and release the retained Utility
Easements in the vacated public property as deseribed above.
BE IT FIJRTfIER RE50LVED, that upon passage of this resolution, the City Clerk is hereby
authorized and directed to record a copy of ths resolution in the office of the Registrar of Deeds,
Ramsey County, and that the City Clerk shall maintain a copy of all Certificates of Intended Non-Use
referenced in tlus resolution on file in the ofFice of Citizen Services.

This letter follows up on our conversation earlier today regazding the vacation of the alley
located in Block 5, City of St. Paul (St. Paul Proper). This alley was vacated by the St. Paul
City Council in September, 1971, as evidenced by the instruments recorded in the Ramsey
Counry Records as Documents No. 562121 and 562122. Copies of those documents aze
enclosed.

You will see from those documents that a portion of the public alley in Block 5 was vacated as
a public alley, subject to reservation of a specific sewer easement, a specific easement being
retained to protect the existing Western Union utilities, and a specific easement being retained
to protect the existing Northwestern Bell Telephone Company udliries.
we unaerstand from t�ie i,ity's Puolic Works Department tnat the sewer �vas abandoned in 1971.
We also understand that the abandonment was referenced by the St. Paul City Council
Resolution File No. 255248, dated August 10, 1977.
We request that your office obtain a Certificate of Intended Nonuse for all of these utilities and
