CHURCH FROM CLAIMS CAUSED BY THE RENTAL OF CAURCH FACII.ITIES BY TFIE
S'MORE FUN PROGRAM OF THE DIVISION OF PARKS AND RECREATION. WITNESSETH:
WHEREAS, City manages a school-aged childcare program at Nordiwest Como Recreation
Center; and
W��REAS, Northwest Como Reczeation Center, a joint use facility with Saint Paul Schools, will
be closed for maintenace from 7une 23 to 3uly 11, 1997; and
WHEREAS, Como Pazk Lutheran Church has agreed to rent space to the City, but requests
indemnification for use of the space.
NOW, THEREFORE BE IT RESOLVED, that the City agrees to defend, indemnify and hold
haz•mless the Como Park Lutheran Church from any and all damages it may be required to pay as a result
of suits, claims, acdons, and judgements arising out of the use of the facilities pursuant to this agreement,
by reason of any contractors, agents or employees. Such indemnification shall not include any injuries or
damages arising from hidden traps or dangerous conditions attributable to causes under the control of ihe
Como Pazk Luthexan Church, nor shall the forgoing provisions be conshved as a waiver of the municipal
tort liability limits set forth in Minn. Stat. 466.01 et. seq.
