2 RESOLVED, that the Licensee, Speedy Markets, Inc., (License ID# 18559), for
3 the premises at 589 Dale Street North in Saint Paul is hereby ordered to pay a fine of
4 $400 for the violation of sale of tobacco products to a minor.

6 Said fine shall be paid to the Off'ice of License, Inspections and Environmental
7 Protection within thirty days of publication of this resolution as adopted.

9 This Resolution and the action taken above are based upon the facts contained in
10 the attached notice of complaint, dated November 18, 1992. The facts as outlined in this
11 letter are not contested by the licensee, as evidenced by the attached letter, dated
12 November 23, 1992, signed by Carl W. C�mmins, Attorney for the licensee. The action
13 taken is also based on the fact that this is a second offense. The licensee has appeared
14 before the Council on July 7, 1992, for the violation of sale of tobacco products to a
15 minor. This action is also based on the circumstances and arguments presented by and
16 on behalf of the licensee during the Public Hearing.

Re: All licenses held by Speedy Markets, Inc. for the premises
located at 589 Dale Street North, Saint Paul.
Dear Manager:
The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against all the licenses you hold at the above-named
premises. This recommendation is based on the following:
On November 7, 1992, a clerk or other employee sold
cigarettes to a minor under the aqe of 18 years in the
licensed premises. This is an offense under Minn. Stat.
§609 . 685 and Saint Paul Legislative Code §324. 07.
If you do not dispute the above facts, and send me a letter to that
effect within 5 days, the case will be set before the City Council.
You will have a chance to appear and make a statement before the
Council as to the proper penalty, if any, to be imposed.
If you do dispute the above facts, a hearing will be set before an
Administrative Law Judge. At that hearing both you and the City
will be able to appear and present witnesses, evidence and cross-
examine the other's witnesses. The Council will ultimately decide
the case. If this is your choice, please let me know within 5 days,
and we will take the necessary steps to set up that ALJ hearing.

Dear Mr. Byrne:
As I advised you in our recent phone conversation I am the attorney
. for Speedy Markets, Inc. I have investigated the representation that a
clerk at the Speedy Markets, Inc, store located at 589 North Dale Street
did, in fact, sell cigarettes to an apparent minor and determined that it
is true.
The clerk in question, Robert R. Loeffler, has been severely
reprimanded and has been suspended from his employment for two days
without pay.
Attached hereto are two forms that Speedy uses in its stores. The
one that starts out "It Is Illegal To Sell" is posted in all stores
adjacent to the cash register. The second form is one that is given to
each new employee with instructions to read the warning and to sign the
form.
Speedy Markets, Inc, takes this matter very seriously and is
presently re-indoctrinating every employee as to his or her obligation to
verify the age of any persons purchasing cigarettes and to refuse to sell
to any who cannot prove their majority.
I understand that a hearing will be scheduled and would appreciate
at least several days notice as to when and where you would like us to
appear.

2 RESOLVED, that the Licensee, Speedy Markets Inc., dba Speedy Market, for the
3 premises at 589 Dale Street North in Saint Paul is hereby ordered to pay a fine of $200
4 for the violation of "Sale of Cigarettes" to a minor.

6 Said fine shall be paid to the License and Inspections Division within thirty days
7 of publication of this resolution as adopted.

9 This Resolution and the action taken above are based upon the facts contained in
10 the attached notice of violation, dated May 12, 1992. The facts as outlined in this letter
11 are not contested by the licensee, as evidenced by the attached letter signed by Carl J.
12 Schroeder, President on behalf of the licensee. The action taken is also based on the
13 facts, circumstances and arguments presented by and on behalf of the licensee during the
14 Public Hearing.
FURTHER RESOLVED, That the licensee is required to post,� in
a conspicuous location next to the check out counter, a sign �prepared
by the Office of License, Inspections and Environmental Protection
which clearly explains the law concerning the sale of tobacco products
to minors.

3 the premises at 589 Dale Street North in Saint Paul is hereby ordered to pay a fine of
4 $400 for the violation of sale of tobacco products to a minor.

6 Said fine shall be paid to the Office of License, Inspections and Environmental
7 Protection within thirty days of publication of this resolution as adopted.

9 This Resolution and the action taken above are based upon the facts contained in
10 the attached notice of complaint, dated November 18, 1992. The facts as outlined in this
11 letter are not contested by the licensee, as evidenced by the attached letter, dated
12 November 23, 1992, signed by Carl W. C�mmins, Attorney for the licensee. The action
13 taken is also based on the fact that this is a second offense. The licensee has appeared
14 before the Council on July 7, 1992, for the violation of sale of tobacco products to a
15 minor. This action is also based on the circumstances and arguments presented by and
16 on behalf of the licensee during the Public Hearing.
