Sime West 7th Street Amoco 2526 7th Street West Saint Paul, Minnesota 55116 Re: Al1 licenses held by West 7th Street Amoco for the premises located at 2526 7th Street West, Saint Paul. Dear Mr. Sime: The Director of the Office of License, Inspections and Environmental Protection will recommend that adverse action be taken against all the licenses you hold at the above-named premises. This recommendation is based on the following: On November 7, 1992, a clerk or other employee sold cigarettes to a minor under the age of is years in the licensed premises. This is an offense under Minn. Stat. §609. 685 and Saint Paul Legislative Code §324.07. If you do not dispute the above facts, and send me a letter to that effect within 5 days, the case will be set before the City Council. You will have a chance to appear and make a statement before the Council as to the proper penalty, if any, to be imposed. If you do dispute the above facts, a hearing will be set before an Administrative Law Judge. At that hearing both you and the City will be able to appear and present witnesses, evidence and cross- examine the other's witnesses. The Council will ultimately decide the case. If this is your choice, please let me know within 5 days, and we will take the necessary steps to set up that ALJ hearing. Call me at 298-5121. Very truly yours, . • Philip B. On November 7, 1992, a clerk in my station did sell cigarettes to a person without properly checking ID. I want you to know that this is against my company policy. We have a very strict policy against selling tobacco products to minors. All of my employees are required to read the enclosed policy and to abide by it. I have been a small business person in St. Paul for over 26 years and have never had a license violation. I want you to know that I consider it a very serious matter and will step up my policy to control the sale of tobacco products. I will also take the necessary disciplinary actions with the employee involved. I hope that you understand that as a business we have been diligent in our efforts to comply with the state and city ordinances and that we do not willfully sell cigarettes to minors. I appreciate your understanding and only ask that, if there is a penalty involved, that we are treated fairly and with consideration. If I can answer any further questions, please fell free to give me a call. Respectfully, ert W. ime . • C _ : J3 '`'° .
