The properiy to be vacated is described as follows: Territorial Road lying between the westerly Saint Paul city limits and the west line of Berry Street extended. This vacation shall be subject to the terms and condiuon of Chapter 130, codified March 1, 1981, of the Saint Faul L,egislative Code as amended, and to the following conditions: 1. That the petitioner's, their successars and assigns shall pay $500.00 as an admiiustrative fee for this vacation which is due and payable within 60 days of the effective date of this resolution. 2. That the petitioner shall be responsible to reconstruct the street at both ends of the vacation to the sadsfaction of the Saint Paul Department of Public Works, including, but not limited to, new curbing, drainage structures, sidewalk, boulevard, and signage, to remove all appearances of public right-of-way. k? C� 5 All costs to perpetuate survey monuments and irons within the vacated area shall be the responsibility of the petitioner. That a permanent utility easement shall be retained within the vacated area to to protect the interest of Northern States Power Company. That a pennanent utility easement sha11 be retained within the vacated area to protect the interest of U.S. West Communication, Inc.
