recommendations on punishment are a suspension of Mr. Grindland's competency card for six (6)
months and recommended retesting of all bacldlow preventer tests performed by Mr. Grindtand

The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against the above-referenced competency card based on the
following information:
On October 16, 1996, you were to perform a
backflow preventer test at 2210 Marshall
Avenue, in the City of Saint Paul. You
completed a test report certifying that you
had done the annual testing required by Saint
Paul Legislative Code § 94.18, without having
actually performed the necessary tests.
If you do not dispute that the above facts, please send me a letter
so that the matter can be scheduled before the City Council for a
hearing on what penalty, if Gny, to impose. You will be allowed to
speak on your behalf at tha� hearing. The recommendation of the
Office of LIEP will be for sLSpension of your competency card, and

suspension, be retested by a approved tester and these reports be submitted to Mr. Paul Thurstin,

SUBJECT: Plumbin� Code Violation
As we discussed on Monday, December 9, 1996, the Utility has been informed of an apparent
violation of Section 94.18-Backflow Preventers, of the St. Paul Legislative Code (copy attached).
Section 94.18 requires the installation, maintenance and testing of backflow preventers by a
licensed plumber or noncontract staff that have backflow testing certification. As you know,
these devices are installed to prevent potable water from becoming contaminated with non-
potable water.
At 2210 Marshall Avenue, the plumbing contractor, Peterson Plumbing, (Mr. Dave Grindland)
was to perform a backflow preventer test. The building owner, Mr. Lester Benson, apparently
video taped the plumbers actions while doing the test. It has been alleged by Mr. Benson that, in
fact, no test was performed and the test results were falsified; test report at[ached. The Water
Utility's Inspector, Mr. Paul Thurstin and Mr. Glenn Crain have viewed the video tape and
confirm that it appeazs no test was performed and the test was falsified. A copy of the video tape
has been requested from Mr. Benson.
It does not appear that the Boazd of Water Commissioners has in piace a defined set of
procedures that would be able to be applied to this situation in a timely fashion. The City of St.
Paul licenses plumbers through the Licensing, Inspection and Environmental Inspection (LIEP).
As we discussed, I am requesting the Department of LIEP act on the Board's behalf in this matter
of the code violation. Of course, if any further gathering of information, etc. is required the
Utility will do this work at your request. Please keep me informed of the status of this matter.

Chapter 95. Water Code—General
Provisions
Sec. 95.01. �oIation by licensed plumber.
In case of ��olation, by a licensed plumber, of
any of the pro��isions of the Water Code (Chapters
85 through 9 i), the boazd of water commissioners
may cancel the bond of such plumber and reiuse
to grant a new licence for a period not to exceed
one (1) year.

Sec. 95.02. Approcal of building plans.
(a) It shall be required that plans or specifica-
tions of all proposed buildings, structures or parts
thereof, and alterations to existing buildings, struc-
ture; or parts thereof showing proposed water
installations or alterations, be submitted to and
approved by the water utility insofar as water
piping and appurtenances aze concerned, before
approval and granting of building permit by 'the
building official, and before the board of water
commissioner's permit is issued.
(b) The above clause shall not void, alter or
amend other clauses in these chapters relating to
permits required,

Sec. 95.03. Minnesota Plumbing Code to ap-
ply.
The provisions of the Minnesota Plumbing Code,
latest revision, pertaining to water supply mate-
rials, fixtures and distribution are hereby adopted
by reference. The administrative authority re-
ferred to in such provisions of the code shalI be
the board ofwater commissioners. One (1) copy of
said plumbing code shall be mazked as the official
copy and filed for use and egamination by the
public in the office of the city clerk, and the clerk
shall fiarnish a copy of this ordinance and said
code at cost to any person upon request.

Environmental Protection will recommend that adverse action be
taken against the above-referenced competency card based on the
following information:
On October 16, 1996, you were to perform a
backflow preventer test at 2210 Marshall
Avenue, in the City of Saint Paul. You
completed a test report certifying that you
had done the annual testing required by Saint
Paul Legislative Code § 94.18, without having
actually performed the necessary tests.
If you do not dispute that the above facts, please send me a letter
so that the matter can be scheduled before the City Council for a
hearing on what penalty, if Gny, to impose. You will be allowed to
speak on your behalf at tha� hearing. The recommendation of the
Office of LIEP will be for sLSpension of your competency card, and

SUBJECT: Plumbin� Code Violation
As we discussed on Monday, December 9, 1996, the Utility has been informed of an apparent
violation of Section 94.18-Backflow Preventers, of the St. Paul Legislative Code (copy attached).
Section 94.18 requires the installation, maintenance and testing of backflow preventers by a
licensed plumber or noncontract staff that have backflow testing certification. As you know,
these devices are installed to prevent potable water from becoming contaminated with non-
potable water.
At 2210 Marshall Avenue, the plumbing contractor, Peterson Plumbing, (Mr. Dave Grindland)
was to perform a backflow preventer test. The building owner, Mr. Lester Benson, apparently
video taped the plumbers actions while doing the test. It has been alleged by Mr. Benson that, in
fact, no test was performed and the test results were falsified; test report at[ached. The Water
Utility's Inspector, Mr. Paul Thurstin and Mr. Glenn Crain have viewed the video tape and
confirm that it appeazs no test was performed and the test was falsified. A copy of the video tape
has been requested from Mr. Benson.
It does not appear that the Boazd of Water Commissioners has in piace a defined set of
procedures that would be able to be applied to this situation in a timely fashion. The City of St.
Paul licenses plumbers through the Licensing, Inspection and Environmental Inspection (LIEP).
As we discussed, I am requesting the Department of LIEP act on the Board's behalf in this matter
of the code violation. Of course, if any further gathering of information, etc. is required the
Utility will do this work at your request. Please keep me informed of the status of this matter.

Chapter 95. Water Code—General
Provisions
Sec. 95.01. �oIation by licensed plumber.
In case of ��olation, by a licensed plumber, of
any of the pro��isions of the Water Code (Chapters
85 through 9 i), the boazd of water commissioners
may cancel the bond of such plumber and reiuse
to grant a new licence for a period not to exceed
one (1) year.

Sec. 95.02. Approcal of building plans.
(a) It shall be required that plans or specifica-
tions of all proposed buildings, structures or parts
thereof, and alterations to existing buildings, struc-
ture; or parts thereof showing proposed water
installations or alterations, be submitted to and
approved by the water utility insofar as water
piping and appurtenances aze concerned, before
approval and granting of building permit by 'the
building official, and before the board of water
commissioner's permit is issued.
(b) The above clause shall not void, alter or
amend other clauses in these chapters relating to
permits required,

Sec. 95.03. Minnesota Plumbing Code to ap-
ply.
The provisions of the Minnesota Plumbing Code,
latest revision, pertaining to water supply mate-
rials, fixtures and distribution are hereby adopted
by reference. The administrative authority re-
ferred to in such provisions of the code shalI be
the board ofwater commissioners. One (1) copy of
said plumbing code shall be mazked as the official
copy and filed for use and egamination by the
public in the office of the city clerk, and the clerk
shall fiarnish a copy of this ordinance and said
code at cost to any person upon request.

Sec. 94.18. Bac�'low precenters.
Installation, maintenance and testing ofbackflow

duced pressure zone backflow preventers is re-
quired. lipon receipt of notice for annual testing

backtlow testing certification or by permanent

Chapter 95. Water Code—General
Provisions
Sec. 95.01. �oIation by licensed plumber.
In case of ��olation, by a licensed plumber, of
any of the pro��isions of the Water Code (Chapters
85 through 9 i), the boazd of water commissioners
may cancel the bond of such plumber and reiuse
to grant a new licence for a period not to exceed
one (1) year.

Sec. 95.02. Approcal of building plans.
(a) It shall be required that plans or specifica-
tions of all proposed buildings, structures or parts
thereof, and alterations to existing buildings, struc-
ture; or parts thereof showing proposed water
installations or alterations, be submitted to and
approved by the water utility insofar as water
piping and appurtenances aze concerned, before
approval and granting of building permit by 'the
building official, and before the board of water
commissioner's permit is issued.
(b) The above clause shall not void, alter or
amend other clauses in these chapters relating to
permits required,

Sec. 95.03. Minnesota Plumbing Code to ap-
ply.
The provisions of the Minnesota Plumbing Code,
latest revision, pertaining to water supply mate-
rials, fixtures and distribution are hereby adopted
by reference. The administrative authority re-
ferred to in such provisions of the code shalI be
the board ofwater commissioners. One (1) copy of
said plumbing code shall be mazked as the official
copy and filed for use and egamination by the
public in the office of the city clerk, and the clerk
shall fiarnish a copy of this ordinance and said
code at cost to any person upon request.

Chapter 96. �i'ater Code—Connection of Air
Conditioning Equipment to City Water
Sec. 96.01. Scope.
The following regulations shall be applicable to
all water-cooled air conditioning equipment which
is connected in any manner to the publio water
supply system, but shall not apply to process
cooling which is designed to be for siaty-five (65)
Supp. 'Co. 31 J$2
