WHEREAS, upon petition by the Salvation Army, the Council approved on April 3, 1996 a
resolution (CF#96-326) vacating and discontinuing as public properry the area described as follows:

Except the Westerly 179.52 feet, that part of the alley in Block 4, I,eech's Addition to Saint
Paul and C.L. Lain's Rearrangement of part of Block 4, Leech's Addition lying Westerly of
the Northwesterly line of West Seventh Street; and
s That part of Lot 1, C. L. Lain's Rearrangement of part of part of Block 4, Leech's Addiuon
s lying East of a line perpendicular to and intersecung the Northwesterly line of West Seventh
io Street at a point 5 feet Southwesterly of its intersection with the Northerly line of said I.ot 1;

is WHEREAS, the above referenced vacation was sub,}ect to certain conditions including the dedication
ia by the petitioner of access and drainage easements and a right-of-way easement for a turn lane across
is part of the east ten feet of Lot 1, Block 4, Leech's Addition; and

WFIEREAS, the site plan developed by the petitioner's architect does not allow for the dedication of
the full ten foot right-of-way easement; and
WI�REAS, the Depattment of Public Works would like to recover the paving bricks to be removed
from the vacated portion of the alley;
TI�REFORE BE TT RESOLVED, that the said resolution, CF# 96-326, be hereby amended as
follows:
Condition 1. shall be amended to read:
zs That, in lieu of the $500.00 administrative fee for this vacation, otherwise due and payable
zv within 60 days of the effective date of this resolution, the petirioner shall dedicate to the City
so of Saint Paul, for the purpose of widening Smith Avenue to accommodate a turn lane, a
si permanent right-of-way easement over and across the following described lands:

sa lying northwesterly of the northwest line of West Seventh Street and southeasterly of

easterly line of I.ot 1 lying 20.00 feet southerly of the said northeast comer of
Lot 1.

io attached hereto and made a part hereof, for an access easement dedicated by the petitioner as directed

i2 County Registrar of Deeds.
