1 WHEREAS, the Council of the City of Saint Paul, upon the petition of Kenneth Tschida and Mike
2. Nicklaus, as contained in Finance Department File No.23-1994 did, by that resolution stated in
3 Councit File #95-729, a copy of which is attached hereto, approved the peution to vacate and
4 discondnue as public properry the land described in said Council File f{45-729; and
6 WHEREAS, a change in wording in one of the condidons, oudined in said Council File No. 95-729,
7 is necessary; and

9 WHEREAS, the petitioner and the City of Saint Paul Depariment of Public Works have requested
10 this change be made; NOW THEREFORE,

12 BE IT RESOLVED, that Council File No. 95-729 is hereby amended with the following changes:

successors and assigns shall dedicate a permanent drainage easement, on, over, under and
across the above referenced vacated area, to the City of Saint Paui, Department of

retained, within the vacated area, by the City of Saint Paul Department of Public
Works," ...
21 ANll BE IT FLJRTFiER RESOLVED, that all other terms and conditions set forth in Council File
