BE TT RESOLVED, that, upon the petition of David Ojeda, as documented in Finance Departmetn
File Number 15-96, public properties hereinafter described are hereby vacated and discontinued as
public properry: and, subject to the herein stated exceptions, the easements within those public
propertries are hereby released.
6 The properry to be vacated is described as follows:
that portion of Aowazd Street abutting I.ots 12, 13, 14, 15, Block 15 and I.ots 18 & 19, Block
17 all in Burlington Heights Division No. 2

11 Ttus vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
12 the Saint Paul Legislative Code as amended, and to the following condiuons:

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation wtuch is due and payable within 60 days of the effective date of tr►is
resolution.
That a permanent utility easement shall be retained within the vacated area to to protect the
interest of Northern States Power Company.

That any landscaping andlor grading of the vacated area is subject review and approval by
Northern States Power Company, the Ciry of Saint Paul Zoning Admuustrator and the Ciry of
Saint Paul Parks and Recreation Department.
That the existing bollards delineating the boundaries of Taylor Park muust remain in place.
That a 15 foot boulevard must be retained at the end of improved Howard Street.
24 6. That the petitioner's their successors, and assigns agree to indemnify, defend and save
30 hazmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
31 any character brought as a result of injuries or damages received or sustained by any person,
32 persons, or property on account of this vacation or petitioner's use of this properry, including
33 but not limited to a claim brought because of any act of omission, neglect, or misconduct of
34 said petitioner or because of any claims or liability arising from any violation of any law or
35 regulation made in accordance with the law, whether by the petitioner or any of their agents or
36 employees
