97-368T Council File # � " 1 � �(p� Green Sheet # O�\ RESOLUTION OF SAINT PAUL, MINNESOTA Presented Referred WIIEREAS, the City of Saint Paul, acting through and by its Department of Fire and Safety Services, hereinafter called the "City", desires to conduct various fire traiiung exercises at property commonly laiown as 6101 Stagecoach Ave, 5920 Penrose Avenue and 6146 Stagecoach Avenue, a11 of which are located in the City of Oak Park Heights, Washington County, Minnesota; and WIIEREAS, upon information and belief, the above described property is owned in fee by the State of Minnesota, the properiy having been acquired by the State Department of TransportaUon for the purpose of consttucting the proposed "new" bridge over the St. Croix River; and WHEREAS, the City has submitted to the State of Minnesota a proposal to conduct fire training exercises for new Fire Recruits on the following dates at the properties described above: 1. April 7& 8, 1997: 6101 Stagecoach Ave. Training in room fires and forcible entry/ventilation exercises. The structure will remain standing at the completion of the exercise and would be left for demolition. 2. May 16, 1997: 5920 Penrose Ave. Training burns from approximately 4 p.m. to ll pm. The structure will be left standing following the exercise. City of Bayport Fire may also train at the shucture on May 17, 1997. In the event City of Bayport Fire does not burn building down, City of Saint Paul will burn the building down on May 23, 1997. 3. May 22 & 23, 1997: 6046 Stagecoach Avenue. Training Burn. Building will be burned down. WHEREAS, the State of Minnesota has indicated a willingness to accept the City's proposal upon the signing of an agreement between the City and the State of Mimiesota wherein the City will save and hold harmless the State of Minnesota from any and all clauns of third parties as might be asserted as a result of the City's fire traiuing exercises conducted at the property described above; NOW THEREFORE BE IT RESOLVED, that the proper officials of the City are hereby authorized and directed to execute such an agreement with the State of Minnesota far the purposes of permitting fire training exercises at the properry commonly known as 6101 Stagecoach Avenue, 5920 Penrose Avenue and 6046 Stagecoach Avenue, Oak Park Heights, Minnesota; AND BE IT FURTHER �� 2' C! 6 7 8 9 10 � rl - 3 �8 RESOLVED, that the proper officials of the City are hereby authorized to enter into an agreement conta.iuiug language indexnnifying the State of Minnesota from claims for damages, actions or causes of action arising out of the use of the above described buildings for fire trauung exercises conducted by the City of Saint Paul except for the negligent acts of the State of Mimiesota, its agents and employees and for the negligent acts of the City of Oak Pazk Heights, Miunesota, its agents and employees and the negligent acts of the City of Bayport, Minuesota, and its agents and employees; AND BE IT FINALLY RESOLVED, that a copy of said agreement shall be filed and kept as a record in the Department of Finauce and Management Services of the Ciry of Saint Paul.
