adhere to the rufes and regula6ons conceming the sa�e of alcoho� and tobaxo
products. Any abuse or misrepresentation of the privi�ege ta sel! alcoholic beverages
or tobacco produds can lead to fines for the person violafing any provision. For the
store, it coutd mean a revoked or suspended license or iicense might not be renewed
by the local liquor control commissioner.
The following is a list of rutes and regulafions you wilt be required to rem m �
wt�en selling alcohof: �
1. No person under 18 years old can � any alcoholic beverages. If you are 18 or
older, simply scan the ifem. If you are under the age of 18, you must call the Customer
Service Manager (CSM) to your register to scan the item for you. The laws will not
al(ow the customer to scan the item.
2. No person under the legal age of 21 years old can � any alcoholic beverages. If
a customer looks 25 years old or younger, you must ask for ident�cation for proof of
age. An acceptabfe�form of identification woutd be a�xe�valid drivers license with
a picture.
3. If a customer appears to be 25 years old or younger, picture identification will be
checked. When verifying the picture identification match the picture with the person
presenting the l.D. and check the expiratio� date. An expired drivers license is �i
acceptable. An altered 1.D. is not acceptable. Kowalskis policy states that the failure
to adhere to these procedures will result in severe disciplinary actions including
termination. You cannot sell liquor to any intoxicated person.
4. Alcoholic beverages may be so(cl4puc, during the foltowing hours: �

18 years is guilty of a gross misdemeanor." and '�vhoever furnishes tobacco or tobacco
reiated devices to person under the age of 18 years old is guitty of a misdemeanor." A
minor under the age of 18 years old who uses tobacco or tobacco related devices is
guilry of a petty misdemeanor, Minn. Stat. Ann. 609.685 Subd.la, 2 and 3. A gross
misdemeanor is punishable by a fine of not more fhan $3,000 and/or imprisonment for
nof more than one year. A misdemeanor is punishable by a fine of not more than
$700.00 andlor imprisonment for not more than 90 days, Minn..Stat. Mn. 609.03. A
petty misdemeanor is punishable by a fine of not more than $200.00. Minn. Sta#. Ann.
609.0331.

The information contained in this letter can heip you comply with a new Federal regulation about �
cigarettes and smokeless tobacco that gces into effect beginning this February. This rule will
directty affect your business if you sell these tobacco products or have in-store tobacco advertising.
As a retailer, you can make a significant difference in protecting children and adolescents from
tobacco use. More than 80 percent of people who smoke had theu first cigarette by their 18th
birthday. Tragically, of the nearly 3,000 youngsters who become regular smokers every day, 1,000
will die prematurely because of the'u smoking.
That is why last year President Clinton announced a new Federal regulation aimed at reducing
significanfly the nnmber of young people who smoke cigarettes or use smokeless tobacco.
Beginning February 28, 1997, it is a Federal violation for any retailer to sell these producu to
anyone under 18 years old. ('The minimum age may be higher in your state.) Further, to prevent
sales to youngsters under 18 wha look older than their age, retailers must verify the age of any
-. buyer under 27 by checldng a photo ID showing the date of birth. Addifional measures will take
effect on August 28, 1947 and are listed in the enclosed material.
The U.S. Food and Drug Administradon, in connection with State and local authorides, will actively
enforce this regulation. Throughout the year, unannounced compliance checks, typically involving
adolescents under 18, will be conducted to ensure that these measures are being observed. Retailers
found selling to minors risk civil money penalties of $250 or more and could be subject to other
sanctions. Retailers reported W have sold cigarettes or smokeless tobacco to someone under 27
without checking their photo ID risk compliance checks being conducted in the future.
To help you understand and comply with the new requ'uements, FDA wiil hold a national video
conference on February 18 and regional briefings around the country in February for retailers,
heaith officials, community groups, and others. Further, we have developed the enclosed
information to tell you and your employees about these briefings and the new regulation. If you
would like more information, FDA has established a toll-free number (1-888-FDA-4KIDS) and has
establishecl a tobacco web site an FDA's Internet home page (http:/Jwww.fda.gov).

Provisions Affecting Retailers and Their Employees
Starting February 28, 1997:
Do not sell cigarettes or smokeless tobacco to anyone under 18. •
• Check photo ID for anyone under 27.
Starting August 28, 1997:
• Sell products only in a direct, face-to-face exchange. (No vending machines or self-service
displays pemutted except in places that never have anyone under 18 present.)
� Do not sell single cigarettes ("loosies") or packs with fewer than 20 cigarettes ("kiddie packs").
• Only accept coupons for redemption from adults at the store, not tluough the mail.
• Do not give out any free samples of cigazettes or smokeless tobacco.
• Inside your store: I3ave all tobacco ads and promotional material that have any pictures or
colors removed. Use only ads or material with black text on a white background. (Exception:
Inside places that never have anyone under 18 present, pictures or colors are permitted if the ads
are not visible from the outside and cannot be removed.)
• Outside your store: Have all outdoor tobacco ads and promotional material ('including on store
windows) that are within 1,000 feet of a school or public playgound removed. Beyond 1,000
feet, use oniy ads or material with black text on a white background.
• Do not give hats, t-shirts, or any other gift or item to anyone in exchange for a tobacco proof-
of-purchase or as part of a sale of cigarettes or smokeless tobacco.

The New Federal Tobacco Rule:
A Retailer's Guide to the Age and ID Requirements
The Rule
In the Federal Register of August 28, 1996, the Food and Dmg Administrauon (FDA) published a final nile to restrict the
sale and disuibution of cigazettes and smokeless tobacco to protect children and adolescenu. The rule is intended to decrease the
number of children and adolescents who use cigarettes and smokeless tobacco and, by doing so, to reduce the death and disease
caused by tobacco products. As a retailez, the final rule creates legally binding requiremenu or obligadons on you.
As of February 28,1997, Federal law prohibiu retailers from selling cigarettes, cigarette tobacco, or smokeless tobacco to
anyone under the age of 18. (T'he age may be higher in your state.) Additionally, retailers must request to see a customer's photo ID
bearing the customer's date of birth before selling cigarettes, cigarette tobacco, or smokeless tobacco to anyone who has not yet
reached his or her 27th birthday.
WEiAT and WHO is Covered by the Rule?
WHAT— the rule covers three kinds of products that contain nicotine:
Cigazettes
Cigazette tobacco
Smokeless tobacco (Smokeless tobacco includes loose leaf chewing tobacco, piug
chewing tobacco, twist chewing tobacco, moist snuff, and dry snuff.)
The rule does NOT cover cigars, little cigazs, or pipe tobacco.
WHO— the rule covers three classes of people or businesses who make, distribute or sell cigarettes, cigazette tobacco, or
smokeless tobacco:

Am I a Retailer?
You are a retailer if you sell cigazettes or smokeless tobacco to individuais for the'u personal consumption. For example,
retailers include, but aze not limited to, �ocery stores, phumacies, convenience stores, gas sta6ons, bazs, restauranu, and other
businesses that sell cigazettes or smokeless tobacco. You aze also a retailer if you own or have a vending machine in your store.
Answers to Questions Asked by Retailers

Environmental Protection will recommend that adverse action be
taken against your cigarette license held at the above-named
premises. This recommendation is based on the following:
On December 28, 1996, you or another employee sold
cigarettes to a minor uader the age of 18 yeara in the
licensed premises. This is an offense uader Mina. Stat.
§609.685 and Saint Paul Legislative Code §324.07.
If you do not dispute the above facts, and send me a letter to that
effect within 5 days, the case will be set before the City Council.
You will have a chance to appear and make a statement before the
Council as to the proper penalty, if any, to be imposed.
If you do dispute th= above £acts, a hearing will be set before an
Administrative Law Judge. At that hearing both you and the City
will be able to apoear and present witnesses, evidence and cross-
examine the other's witnesses. The Council will ultimately decided
the case. If this is your choice, please advise my legal assistant,
Peter Pangborn, within 5 days, and we will take the necessary steps

establishment has been scheduled for 4:30 p.m., Wednesday, April 2,
1997 in the City Council Chambers, Third Floor, Saint Paul City

3. If a customer appears to be 25 years old or younger, picture identification will be
checked. When verifying the picture identification match the picture with the person
presenting the l.D. and check the expiratio� date. An expired drivers license is �i
acceptable. An altered 1.D. is not acceptable. Kowalskis policy states that the failure
to adhere to these procedures will result in severe disciplinary actions including
termination. You cannot sell liquor to any intoxicated person.

The information contained in this letter can heip you comply with a new Federal regulation about �
cigarettes and smokeless tobacco that gces into effect beginning this February. This rule will
directty affect your business if you sell these tobacco products or have in-store tobacco advertising.
As a retailer, you can make a significant difference in protecting children and adolescents from
tobacco use. More than 80 percent of people who smoke had theu first cigarette by their 18th
birthday. Tragically, of the nearly 3,000 youngsters who become regular smokers every day, 1,000
will die prematurely because of the'u smoking.
That is why last year President Clinton announced a new Federal regulation aimed at reducing
significanfly the nnmber of young people who smoke cigarettes or use smokeless tobacco.
Beginning February 28, 1997, it is a Federal violation for any retailer to sell these producu to
anyone under 18 years old. ('The minimum age may be higher in your state.) Further, to prevent
sales to youngsters under 18 wha look older than their age, retailers must verify the age of any
-. buyer under 27 by checldng a photo ID showing the date of birth. Addifional measures will take
effect on August 28, 1947 and are listed in the enclosed material.
The U.S. Food and Drug Administradon, in connection with State and local authorides, will actively
enforce this regulation. Throughout the year, unannounced compliance checks, typically involving
adolescents under 18, will be conducted to ensure that these measures are being observed. Retailers
found selling to minors risk civil money penalties of $250 or more and could be subject to other
sanctions. Retailers reported W have sold cigarettes or smokeless tobacco to someone under 27
without checking their photo ID risk compliance checks being conducted in the future.
To help you understand and comply with the new requ'uements, FDA wiil hold a national video
conference on February 18 and regional briefings around the country in February for retailers,
heaith officials, community groups, and others. Further, we have developed the enclosed
information to tell you and your employees about these briefings and the new regulation. If you
would like more information, FDA has established a toll-free number (1-888-FDA-4KIDS) and has
establishecl a tobacco web site an FDA's Internet home page (http:/Jwww.fda.gov).

Provisions Affecting Retailers and Their Employees
Starting February 28, 1997:
Do not sell cigarettes or smokeless tobacco to anyone under 18. •
• Check photo ID for anyone under 27.
Starting August 28, 1997:
• Sell products only in a direct, face-to-face exchange. (No vending machines or self-service
displays pemutted except in places that never have anyone under 18 present.)
� Do not sell single cigarettes ("loosies") or packs with fewer than 20 cigarettes ("kiddie packs").
• Only accept coupons for redemption from adults at the store, not tluough the mail.
• Do not give out any free samples of cigazettes or smokeless tobacco.
• Inside your store: I3ave all tobacco ads and promotional material that have any pictures or
colors removed. Use only ads or material with black text on a white background. (Exception:
Inside places that never have anyone under 18 present, pictures or colors are permitted if the ads
are not visible from the outside and cannot be removed.)
• Outside your store: Have all outdoor tobacco ads and promotional material ('including on store
windows) that are within 1,000 feet of a school or public playgound removed. Beyond 1,000
feet, use oniy ads or material with black text on a white background.
• Do not give hats, t-shirts, or any other gift or item to anyone in exchange for a tobacco proof-
of-purchase or as part of a sale of cigarettes or smokeless tobacco.

The Rule
In the Federal Register of August 28, 1996, the Food and Dmg Administrauon (FDA) published a final nile to restrict the
sale and disuibution of cigazettes and smokeless tobacco to protect children and adolescenu. The rule is intended to decrease the
number of children and adolescents who use cigarettes and smokeless tobacco and, by doing so, to reduce the death and disease
caused by tobacco products. As a retailez, the final rule creates legally binding requiremenu or obligadons on you.
As of February 28,1997, Federal law prohibiu retailers from selling cigarettes, cigarette tobacco, or smokeless tobacco to
anyone under the age of 18. (T'he age may be higher in your state.) Additionally, retailers must request to see a customer's photo ID
bearing the customer's date of birth before selling cigarettes, cigarette tobacco, or smokeless tobacco to anyone who has not yet
reached his or her 27th birthday.
WEiAT and WHO is Covered by the Rule?
WHAT— the rule covers three kinds of products that contain nicotine:
Cigazettes
Cigazette tobacco
Smokeless tobacco (Smokeless tobacco includes loose leaf chewing tobacco, piug
chewing tobacco, twist chewing tobacco, moist snuff, and dry snuff.)
The rule does NOT cover cigars, little cigazs, or pipe tobacco.
WHO— the rule covers three classes of people or businesses who make, distribute or sell cigarettes, cigazette tobacco, or
smokeless tobacco:

Am I a Retailer?
You are a retailer if you sell cigazettes or smokeless tobacco to individuais for the'u personal consumption. For example,
retailers include, but aze not limited to, �ocery stores, phumacies, convenience stores, gas sta6ons, bazs, restauranu, and other
businesses that sell cigazettes or smokeless tobacco. You aze also a retailer if you own or have a vending machine in your store.
Answers to Questions Asked by Retailers
How do I comply with rhe rrile?
In brief, you wi11 comply with the ptovisions that will become effective in February 1997 if you:

The rule requires you to ensure c}sat yout customer is at least 18 by checking his or her ID for the customer's photo and date
of birth. The reguiafion dces not specify the type of ID that you may accept, but the mos[ reliaGle forms of ID cards are:

Military identification cazds, if they have the customer's photo and date of birth
Passports
Do I have to check everyone's ID?

least 1 S. In other words, if you have a regulaz customer whom you ]�ow is 18 or over because he or she has presented a valid ID card
in Ihe past, you do not need to ask for proof of age every tune the customer wants to buy a tobacco product
What if I do not comply with tke rule?

The following is a list of rutes and regulafions you wilt be required to rem m �

1. No person under 18 years old can � any alcoholic beverages. If you are 18 or
older, simply scan the ifem. If you are under the age of 18, you must call the Customer
Service Manager (CSM) to your register to scan the item for you. The laws will not
al(ow the customer to scan the item.
2. No person under the legal age of 21 years old can � any alcoholic beverages. If
a customer looks 25 years old or younger, you must ask for ident�cation for proof of
age. An acceptabfe�form of identification woutd be a�xe�valid drivers license with
a picture.
3. If a customer appears to be 25 years old or younger, picture identification will be
checked. When verifying the picture identification match the picture with the person
presenting the l.D. and check the expiratio� date. An expired drivers license is �i
acceptable. An altered 1.D. is not acceptable. Kowalskis policy states that the failure
to adhere to these procedures will result in severe disciplinary actions including
termination. You cannot sell liquor to any intoxicated person.

guilry of a petty misdemeanor, Minn. Stat. Ann. 609.685 Subd.la, 2 and 3. A gross
misdemeanor is punishable by a fine of not more fhan $3,000 and/or imprisonment for
nof more than one year. A misdemeanor is punishable by a fine of not more than
$700.00 andlor imprisonment for not more than 90 days, Minn..Stat. Mn. 609.03. A
petty misdemeanor is punishable by a fine of not more than $200.00. Minn. Sta#. Ann.

The information contained in this letter can heip you comply with a new Federal regulation about �
cigarettes and smokeless tobacco that gces into effect beginning this February. This rule will
directty affect your business if you sell these tobacco products or have in-store tobacco advertising.
As a retailer, you can make a significant difference in protecting children and adolescents from
tobacco use. More than 80 percent of people who smoke had theu first cigarette by their 18th
birthday. Tragically, of the nearly 3,000 youngsters who become regular smokers every day, 1,000
will die prematurely because of the'u smoking.
That is why last year President Clinton announced a new Federal regulation aimed at reducing
significanfly the nnmber of young people who smoke cigarettes or use smokeless tobacco.
Beginning February 28, 1997, it is a Federal violation for any retailer to sell these producu to
anyone under 18 years old. ('The minimum age may be higher in your state.) Further, to prevent
sales to youngsters under 18 wha look older than their age, retailers must verify the age of any
-. buyer under 27 by checldng a photo ID showing the date of birth. Addifional measures will take
effect on August 28, 1947 and are listed in the enclosed material.
The U.S. Food and Drug Administradon, in connection with State and local authorides, will actively
enforce this regulation. Throughout the year, unannounced compliance checks, typically involving
adolescents under 18, will be conducted to ensure that these measures are being observed. Retailers
found selling to minors risk civil money penalties of $250 or more and could be subject to other
sanctions. Retailers reported W have sold cigarettes or smokeless tobacco to someone under 27
without checking their photo ID risk compliance checks being conducted in the future.
To help you understand and comply with the new requ'uements, FDA wiil hold a national video
conference on February 18 and regional briefings around the country in February for retailers,
heaith officials, community groups, and others. Further, we have developed the enclosed
information to tell you and your employees about these briefings and the new regulation. If you

Starting February 28, 1997:
Do not sell cigarettes or smokeless tobacco to anyone under 18. •
• Check photo ID for anyone under 27.
Starting August 28, 1997:
• Sell products only in a direct, face-to-face exchange. (No vending machines or self-service
displays pemutted except in places that never have anyone under 18 present.)
� Do not sell single cigarettes ("loosies") or packs with fewer than 20 cigarettes ("kiddie packs").
• Only accept coupons for redemption from adults at the store, not tluough the mail.
• Do not give out any free samples of cigazettes or smokeless tobacco.
• Inside your store: I3ave all tobacco ads and promotional material that have any pictures or
colors removed. Use only ads or material with black text on a white background. (Exception:
Inside places that never have anyone under 18 present, pictures or colors are permitted if the ads
are not visible from the outside and cannot be removed.)
• Outside your store: Have all outdoor tobacco ads and promotional material ('including on store
windows) that are within 1,000 feet of a school or public playgound removed. Beyond 1,000
feet, use oniy ads or material with black text on a white background.
• Do not give hats, t-shirts, or any other gift or item to anyone in exchange for a tobacco proof-
of-purchase or as part of a sale of cigarettes or smokeless tobacco.

The New Federal Tobacco Rule:
A Retailer's Guide to the Age and ID Requirements
The Rule
In the Federal Register of August 28, 1996, the Food and Dmg Administrauon (FDA) published a final nile to restrict the
sale and disuibution of cigazettes and smokeless tobacco to protect children and adolescenu. The rule is intended to decrease the
number of children and adolescents who use cigarettes and smokeless tobacco and, by doing so, to reduce the death and disease
caused by tobacco products. As a retailez, the final rule creates legally binding requiremenu or obligadons on you.
As of February 28,1997, Federal law prohibiu retailers from selling cigarettes, cigarette tobacco, or smokeless tobacco to
anyone under the age of 18. (T'he age may be higher in your state.) Additionally, retailers must request to see a customer's photo ID
bearing the customer's date of birth before selling cigarettes, cigarette tobacco, or smokeless tobacco to anyone who has not yet
reached his or her 27th birthday.
WEiAT and WHO is Covered by the Rule?
WHAT— the rule covers three kinds of products that contain nicotine:
Cigazettes
Cigazette tobacco
Smokeless tobacco (Smokeless tobacco includes loose leaf chewing tobacco, piug
chewing tobacco, twist chewing tobacco, moist snuff, and dry snuff.)
The rule does NOT cover cigars, little cigazs, or pipe tobacco.
WHO— the rule covers three classes of people or businesses who make, distribute or sell cigarettes, cigazette tobacco, or
smokeless tobacco:

Am I a Retailer?
You are a retailer if you sell cigazettes or smokeless tobacco to individuais for the'u personal consumption. For example,
retailers include, but aze not limited to, �ocery stores, phumacies, convenience stores, gas sta6ons, bazs, restauranu, and other
businesses that sell cigazettes or smokeless tobacco. You aze also a retailer if you own or have a vending machine in your store.

Dear Mr. Kowalski:
Our office sent you a letter dated January 3, 1997, in which you
were notified of a violation involving the sale of cigarettes to a
minor on December 28, 1996, at the licensed establishment. The
letter asked that you contact this office to let us know whether
you disputed that fact.
If we have not heard from you in writing by Friday, February 14;
1997, we will assume that you do not intend to dispute the
violation. We will then schedule this matter for hearing before
the Saint Paul City Council to determine what penalty will be
imposed.

DeaY Mr. Kowalski:
The Director of the Office of License, Inspections and
Environmental Protection will recommend that adverse action be
taken against your cigarette license held at the above-named
premises. This recommendation is based on the following:
On December 28, 1996, you or another employee sold
cigarettes to a minor uader the age of 18 yeara in the
licensed premises. This is an offense uader Mina. Stat.
§609.685 and Saint Paul Legislative Code §324.07.
If you do not dispute the above facts, and send me a letter to that
effect within 5 days, the case will be set before the City Council.
You will have a chance to appear and make a statement before the
Council as to the proper penalty, if any, to be imposed.
If you do dispute th= above £acts, a hearing will be set before an
Administrative Law Judge. At that hearing both you and the City
will be able to apoear and present witnesses, evidence and cross-
examine the other's witnesses. The Council will ultimately decided
the case. If this is your choice, please advise my legal assistant,
Peter Pangborn, within 5 days, and we will take the necessary steps
to set up that Pr,J �earing. we can be reached at 266-8710.
