WFIEREAS, city employee and former City Council Member Dino Guerin is named
as a defendant in the case of Dennis C Kessler v. Citv of 5t. Paul, St. Paul Fire and Safety
Department, Dino Philip Guerin, and Timothv K. Fuller; and
WHEREAS, there are special or unusual circumstances in this matter, to-wit:
The CiTy Attorney asked Mr. Guerin to waive potential conflicts of interest to allow
joint defense of all defendants by the City Attorney. Such joint defense would lead to
substantial cost savings for the City. The City Attorney recognized that Mr. Guerin
may need independent counsel to advise him on this so the City Attorney stated he
would recommend to the Mayor and Council that the City pay reasonable attorney's
fees for this purpose. Mr. Guerin did seek independent advice from Mr. Joseph
O'Neill of the law firxn of O'Neill, Crrills & O'Nei1L Mr. Guerin thereafter did
consent to joint representation; and
WIIEAEAS, the City Attarney now recommends that reasonable attorney's fees be
paid to Mr. O'Neill.
NOW THEREFORE, Mr. 7osegh O'Neill of the law firm of O'Neill, Grills & O'Neill
is appointed counsel for Mr. Guerin for the sole purpose of advising Mr. Guerin regarding the
potential conflicts associated with the joint defense; and
FURTHER RESOLVED, the fees for said service shall not exceed $5,000.00, which
shall be paid from the outside counsel account, GL-001-09073-0218.
