WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Health on or before February 7, 1997, the following are the now
lrnown interested or responsible parties for the Subject Property: Janice Orr, 3549 71st Street East,

WHEREAS, Public Health has served in accordance with the provisions of ChapYer 45 of the
Saint Paul I.egislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated
February 5, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Properiy is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order anformed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by February 20, 1997; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Properry declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Public Health requested that
the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council
and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, March 18, 1997 to hear testimony and evidence, and after receiving testimony
and evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the communiry by rehabilitating this structure in
accordance with all applicable codes and ordinances, or in the alternarive by demolishing and
removing the structure in accordance with all applicable codes and ordinances. The rehabilitauon or

2 the advisability and necessity of ordering the repair or wrecking and removal of a two-story, wood
3 frame dwelling located on property hereinafter referred to as the "Subject Property" and commonly
4 known as 777-779 Aurora Avenue. This propeny is legally described as follows, to wit:

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 777-779 Aurora Avenue:

'I'hat the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of tYris building(s) is estimated to exceed
three thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violauons at
the Subject Properiy.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been conected.
That Public Aealth has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
That this building has been routinely monitored by the VacanUNuisance Buildings
Code Enforcement Program,
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safery and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
ali applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accardance w3th all applicable codes and ordinances. The rehabilitation ar
demolition and removal of the structure must be completed wiThin-��days after the
date of the Council Hearing.

2. If the above conective acuon is not completed within this period of time the Public Health,
Code Enforcement Progtam is hereby authorized to take whatever stegs are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuantto the provisions of Chagter 45 of the Saint Paul I.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personai properiy or fxtures of any kind which interfere with the demolirion and removal
shall be removed from the properiy by the responsible parties by the end of tYris time period.
If all personal properiy is not removed, it shall be considered to be abandoned and the Ciry
of 5aint Paul shall remove and dispose of such property as provided by law.
4. It is fiuther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L.egislative Code.

Getry Strathman, Legislative Hearing Officer, called the meeting to order at 10:05 a.m.
1. Summary abatement appeal for 1274 Sherburne Avenue; Audrey Petschen, appellant.
Chuck Votel, Public Aealth, presented pictures of the property.
The property owner did not appear.
Gerry Strathman, Legislative Aearing Officer, reviewed the pictures of the property. Since the owner did
not appear, he denied the appeal.
2. Resolution ordering the owner to remove or repair the referenced building, ►ocated at 777-779
Aurora Avenue. If the owner fails to comply with the resolution, Public Health is ordered to
remove the bi�ilding.
Mr. Votel reviewed the staff report. The building had been vacant since December, 1994 and the city had
issued eight summary abatement notices since that time. The city also had to board the building on four
occasions. The vacant building registration fee was due and owning. A code compliance inspection was
done in July, 1996 and permits were obtained. The owner also had posted the $2,000 pezformance bond,
however, that bond was forfeited on January 31, 1997 as a substantial amount of the repairs had not been
completed. The estimated cost to repair the building was approximately $35,Od0 and the estimated cost
to demolish was approximateIy $8,000.
Janice On, progerty owner, appeared and stated that she intended to repair the building. She was injured
in a car accident and had been unable to work for a period of time in 1996 and subsequently had not been
able to continue making the regairs to the building. Although she had suffered financial difficulties, she
continued to keep her mortgage payments current. She stated that she believed she had completed a
substantial amount of work on the building. She requested additional time to complete the repairs to the
building.
Larry Zelke, representing Aome Side Lending, appeared and stated it was uncustomary for a lender to take
an 3nteregY in a properry where the mortgage had been current, which was the case with this progerty.
However, sin�e the lender had a security anterest in the property, they wanted to be aware of the future of
this property.
Mr. Strathman questioned whether this property was an active nuisance to the neighborhood. Mr. Votel
responded that he did not consider the property to be troublesome, however, they were seeking a
commitrnent from the owner to make the necessary repairs to the building.
Mr. Strathman stated that he would grant the owner 180 days Yo complete the necessary zepairs to the
building provided the $2,000 bond was posted and the vacant building registration fee was paid by
Wednesday, March 2b, 1997.

Saint Paul Public Health has declazed this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate trus nuisance condition by conecting the deficiencies or by
razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Health that the City Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building ]n a timely
manner, and failing that, authorize Pubiic Health to proceed to demolition and removal, and

Getry Strathman, Legislative Hearing Officer, called the meeting to order at 10:05 a.m.
1. Summary abatement appeal for 1274 Sherburne Avenue; Audrey Petschen, appellant.
Chuck Votel, Public Aealth, presented pictures of the property.
The property owner did not appear.
Gerry Strathman, Legislative Aearing Officer, reviewed the pictures of the property. Since the owner did
not appear, he denied the appeal.
2. Resolution ordering the owner to remove or repair the referenced building, ►ocated at 777-779
Aurora Avenue. If the owner fails to comply with the resolution, Public Health is ordered to
remove the bi�ilding.
Mr. Votel reviewed the staff report. The building had been vacant since December, 1994 and the city had
issued eight summary abatement notices since that time. The city also had to board the building on four
occasions. The vacant building registration fee was due and owning. A code compliance inspection was
done in July, 1996 and permits were obtained. The owner also had posted the $2,000 pezformance bond,
however, that bond was forfeited on January 31, 1997 as a substantial amount of the repairs had not been
completed. The estimated cost to repair the building was approximately $35,Od0 and the estimated cost
to demolish was approximateIy $8,000.
Janice On, progerty owner, appeared and stated that she intended to repair the building. She was injured
in a car accident and had been unable to work for a period of time in 1996 and subsequently had not been
able to continue making the regairs to the building. Although she had suffered financial difficulties, she
continued to keep her mortgage payments current. She stated that she believed she had completed a
substantial amount of work on the building. She requested additional time to complete the repairs to the
building.
Larry Zelke, representing Aome Side Lending, appeared and stated it was uncustomary for a lender to take
an 3nteregY in a properry where the mortgage had been current, which was the case with this progerty.
However, sin�e the lender had a security anterest in the property, they wanted to be aware of the future of
this property.
Mr. Strathman questioned whether this property was an active nuisance to the neighborhood. Mr. Votel
responded that he did not consider the property to be troublesome, however, they were seeking a
commitrnent from the owner to make the necessary repairs to the building.
Mr. Strathman stated that he would grant the owner 180 days Yo complete the necessary zepairs to the
building provided the $2,000 bond was posted and the vacant building registration fee was paid by
Wednesday, March 2b, 1997.

razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Health that the City Council pass a resolution ordering the

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Health on or before February 7, 1997, the following are the now
lrnown interested or responsible parties for the Subject Property: Janice Orr, 3549 71st Street East,

WHEREAS, Public Health has served in accordance with the provisions of ChapYer 45 of the
Saint Paul I.egislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated
February 5, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the

and evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the communiry by rehabilitating this structure in
accordance with all applicable codes and ordinances, or in the alternarive by demolishing and

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 777-779 Aurora Avenue:

'I'hat the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of tYris building(s) is estimated to exceed
three thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violauons at
the Subject Properiy.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been conected.
That Public Aealth has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
That this building has been routinely monitored by the VacanUNuisance Buildings
Code Enforcement Program,
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safery and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
ali applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accardance w3th all applicable codes and ordinances. The rehabilitation ar
demolition and removal of the structure must be completed wiThin-��days after the
date of the Council Hearing.

2. If the above conective acuon is not completed within this period of time the Public Health,
Code Enforcement Progtam is hereby authorized to take whatever stegs are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuantto the provisions of Chagter 45 of the Saint Paul I.egislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personai properiy or fxtures of any kind which interfere with the demolirion and removal
shall be removed from the properiy by the responsible parties by the end of tYris time period.
If all personal properiy is not removed, it shall be considered to be abandoned and the Ciry
of 5aint Paul shall remove and dispose of such property as provided by law.
4. It is fiuther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L.egislative Code.
