I am a resident of Saint Paul at the noted address since 2008,and certify that the information provided herein is true and correct. FACTS Snow emergency was declared 2/io/13 by the City.I received notice via text and e-mail from the City.I accordingly moved my two vehicles from in front of my residence that afternoon(Doswell is an east-west night plow street)on the afternoon of 2/io.Because the garage was temporarily full of project materials,I drove down my alley behind the house and parallel to Doswell and parked on the west side of Hythe near poswell.I then walked over half the block of Hythe,noting other cars parked on the street,and noting that there were no(zero, none)signs indicating a night plow street.So,I had both cars parked on Hythe overnight February io. The cars were ticketed and towed between 6:go and�:ooam,arriving at the City impound lot at�:o6am. I discovered the loss of the vehicles at 7:45am when I went to move the vehicles back in front of my residence. EXHIBITS The following is provided to assist in the documentation of this claim: • Exhibit i is a map of the neighborhood printed from Google Maps,and highlighted in pencil with approximate alley and parking locations.The location of my cars that are noted as boxes i and g on Hythe near poswell. Box 2 was another car that was not ticketed and towed that was between my two vehicles as illustrated.At the north end of the Hythe block is a circle indicating the location of a street sign noting "snow emergency—no night parking"noted as Si.The distance between the cars towed and this sign Si is over 50o feet and around a bend in the street.As can be observed,it is possible to traverse the alley behind the 2i3i Doswell residence,turn left/south on Hythe,and never see a"snow emergency—no night parking"sign.Further,it is clear that my walking the block over half way north would not provide visibility to the posting. ... ; . • . ``t,� � . I walked to this sign on the afternoon of 2/io/i3 and noted no night emergency sign present in mid block. • F,xhibit 6 is a picture taken by the writer on 2/li/i3 of the parking sign posting on Hythe near poswell.It will be observed that no snow emergency night parking prohibition is present.This sign is immediately adjacent to where my cars were towed. • Exhibit�is a picture taken by the writer 2/ii/i3 of the location where one of my cars were towed,from immediately behind the silver car in the picture.This vehicle still shows snow cover.At 7:45 am there was no disturbance of the front windshield except for the marks in the fresh snow where I looked for a snow emergency ticket(there was none). • Exhibit 8 is a picture taken by the writer 2/ii/i3 of the location immediately in front of the silver car in E�ibit�,showing the location from which my second car was towed.It also documents that towing the car was done too late in the time interval to allow plowing.In other words,towing the cars did not enable the city to plow the street prior to shifting to day snow plow protocol,and the continued presence of the noted silver colored vehicle(and other vehicles also parked on the west side of Hythe overnight that were not tagged and towed)meant the towing resulted in no plowing in any event. • Exhibits 9 and io are the copies of the tag and tow costs for each vehicle referenced above. FACTS DOCUMENTED BY THE EXHIBITS Facts documented by these exhibits include that there is only one night parking snow emergency sign on Hythe,a north-south street.The sign is over 500'from where the towing occurred.Additionally,it is possible to enter the parking location without the necessity to pass this single sign.Further,a resident attempting to follow the snow emergency guidelines in good faith must rely upon the sign postings,which are not visible to those who look within 300'of their parking location as did the writer. Not documented in these pictures but observable today is that streets parallel to Hythe contain two or three snow emergency signs per block. INVESTIGATION OF CTTY SIGN POSTING PRACTICES Investigation of the city sign posting practices by the writer indicates that there are many thousands of street signs.In speaking on Tuesday 2/12 with Monica Beeman,city engineer,she indicated some concern about a single sign.She indicated that due to the distance,bend in the street and other factors that she would likely recommend that multiple signs be posted on this 600'super-block. She pointed out that at one time there may have been multiple signs in place,perhaps not,but that her preliminary opinion would likely see that additional signs were posted on Hythe based on the facts represented to her in that conversation. 2 6 Dan Carnicom BASIS FOR CLAIM TO THE CITY OF SAINT PAUL FOR REIMBURSEMENT (i)The area of the city street from which the tag and tow occurred was not marked as a night snow plow—no parking within 500'. A city resident who made a good faith effort to comply with city ordinances for snow emergency parking is unable to rely on city signage for that purpose in this specific case.The fact that other cars were parked adjacent to the tag and tow location indicates that other residents were and are also not aware of the status of this half a block on Hythe. (2)The tag and tow enforcement was arbitrary.Over i2 other cars were parked in that immediate area on the west side of Hythe towards Doswell and not one other car had a ticket on the windshield or was towed on 2/ii/i3.If the City intends to tag and tow it is incumbent on the City to post and enforce its ordinances on all citizens.Why should adjacent blocks have multiple snow emergency postings but not in this half block?If tag and tow is City ordinance,why was not even one other car of over r2 was not towed or at least tagged by 7:45am? (3)The Ciry proclaims that it is the most livable city in America,but failure to honor this claim would be evidence that this tag is not supported by City actions.For example,in 2oio when a huge limb fell on one of the cars on the city street in front of 213i Doswell(one that was towed on 2/ii/i3)from a dangerous tree on the City boulevard and caused over$5,00o in damage the City claimed"an act of God"and declined reimbursement.When the City receives complaints that the i-hour limit on-street parking in front of 2i3i Doswell is never enforced any more, nothing is done.Indeed,the City explains that the traffic enforcement staff has been diverted to other priorities, resulting in university student parking in such force and seeming impunity that it often prevents resident parking due to a lack of space due to cars parked a day at a time.Thus,cars who do not display resident permits displace those residents who do buy and display such permits.Finally,the City is known to make a margin over cost of towing from snow emergencies,but profit from towing that does not result in plowing seemingly is just another disguised t�on city residents. (4)To balance the"livability"quotient and take responsibility for its own actions,the City must reimburse for those inadvertent actions wherein the City and the resident both acted in good faith,but City sign posting was incomplete or changed over time from the original installation and other factors. (5)To save on the time,person power and cost that will go into the appeal and political process that will follow denial of a reasonable request for reimbursement in this claim as citizens exercise their due process rights in the administrative and political channels available. 3 • _ __ _ _ 2/18/13.
