INITIATING PROBLEM, ISSUE, OPPOHTUNITY (Who, Whet, When, NTere, Why):
Cynthia Guidaboni, a former St. Paul Police Reserve Officer,
brought suit in United States district court against her former
supervisor, Sergeant Steven Golden, the St. Paul Police Department,
and the City of St. Paul (defendants). Aer complaint set forth
incidents of alleged sexual harassment that violated both state and
federal constitutions, the Minnesota Human Rights Aot, as well as
claims of ne li ent retention and supervision by the Police
ADVANTAGESIF�POIIC�:t3Ilent and the City. Guidaboni claims Sergeant Golden's

conduct caused her emotional and physical injuries, medical
expenses of $9,200 for asthma attacks and psychiatric treatment for
depression, and $10,000 for six months of lost wages. She also
claims that her complaints to the Police Department caused her to
be terminated as a reserve officer. Sergeant Golden admits to some
behavior but asserts he had a personal relationship with Guidaboni
and the behavior was not unwelcome. Guidaboni seeks compensatory
DISADVANTAGE t and intentional. Additionally, if Guidaboni were to
prevail at trial on the constitutional or Human Rights Aat
violations, the City would be liable for her attorney fees.
The City brought a summary judgment motion on all claims on
February 12, 1997. The judge indicated he was reluatant to grant
the motion in its entirety which would have resulted in a trial on
some claims. The judge also advised the City that he would

encouraged settlement negotiations between the parties. The
parties eventually agreed to a payment of $24,000.00 in exchange
for a release of all claims against all parties subjected to
approval by the City Council. Given the judge's rulings and the
risk of an adverse result at trial, this office recommends approval
of the settlement.
