Construction in SPSO, Grade 26 was previously submitted and subsequently amended by the Council placing it in
SPSO, Grade 30. The Mayor vetoed the amended resolution on November 18, 1997 (see attached memo from the
Mayor to the Council). The Council did not reconsider the vetoed resolution. Consequently, we are asking that the
Council pass this resolution which again places the new class iu SPSO, Crrade 26. A rate of pay needs to be
established so that we can fill the position permanently. If this rate of pay does not attract enough qualified
candidates we will submit another resolution establishing a higher pay rate.

I have decided to veto Resolution 97-1347, which was passed by the Council in amended form
November 12, 1997. I request that you reconsider this resolution as submitted. My understanding
is that the resolution was amended to change the rate of pay assigned to the new classification
entitled, "Deputy LIEP Director - Construction". It was changed from SPSO grade 26 to SPSO
gade 30. This, action in my opinion does not reflect sound business judgement and has the
potential of establishing a practice that I can not support.
Before this resolution came before the Council, Human Resources assisted LIEP in restructuring
the office so that it could function in an efficient and cost effective manner. The number of
divisions was reduced from three to two. Two new division manager positions were then
designed, classified and evaluated. This process took approximately thirty hours over a period of
several weeks to complete. The analysis consisted of the application of our iniemal job evaluation
system,, a comparison with the provisions of a sometimes conflicting State Pay Equity Act, a
detemunation of the effects that the grade assignment would have on other classifications and
finally, a local market study. The result was the assignment of the positions to the SPSO
bargaining unit in grade 26. Afier this analysis, both LIEP and the SPSO bargaining unit were
notified of the results. There were discussions with SPSO regazding the proposed minimum
qualifications and, subsequently, a"no substitution for education" requirement was added at their
request. This did not affect the overail evatuation and grade assignment. The LIEP Director and
the President of SPSO agreed to the class specifications and the grade level assignment through
the twenty-day notice process as required by the civii service rules.

On November 12, 1997, the Council was asked, in an open forum, to change the grade
assignment for the new classification by representatives of SPSO who believed the pay was too
low. They based their analysis on the pay for an old classification, that was initially evaluated
under an organizationai structure that no longer e�usts. They also indicated that the City may
have trouble obtaining qualified candidates at the pay levei assigned by Human Resources. I
would like to point out that if that occurs, Human Resources will draft a resolution to adjust the
pay accordingiy.
In conclusion, I believe your decision to amend this resolution was ill advised. There are more
appropriate forums for settling disputes over classification and compensation determinations made
by Human Resources. There is such a process outlined in the Civil Service Grievance Procedures
which SPSO chose not to pursue. I urge you to please consider all of the possible rami8cation of
this action and pass Resolution 97-1347 as it was originally drafted.

Performs responsible managerial work in planning and directing the
administration of the Construction Division of the 0£fice of License,
Inspections and Environmental Protection (LIEP) vhich inclssdes the
approval of construction permits, the inspection o£ construction
projects, and the review of building plans, site plans and zoning use;
and performs duties as assigned.
Supervision Received:
Works under the general direction of the Office Director.
Su�ervision Exercised:
Exercises within the unit, administrative, general, and technical
supervision over supervisory, professional, area skilled inspection,
technical and clerical employees.
TYPICAL DUTIES PERFORMED

Directs the division's planning activities; establishes and implements
construction division policy; prepares annual budget; and evaluates
programs and initiates changes as needed.

Analysis of Salary Survey for Deputy Positions in LIEP

(Note: All salary figures are "per yeat".)
None of the jurisdictions had a totally comparable structure to LIEP in Saint Paul, nonetheless,
some comparisons can be made.
Comparabie positions in Richfield and St. Cloud top out at less than $ 60,000 per year but these
positions have a less demanding workload. Specifically, more residential, less commercial, and a
slower rate of development. (Note: Organizationally, the position in St. Cloud is a good match
for the construction deputy.)
In Bloomington there is a significant difference between the building position and the zoning
position. The equivalent to the license position would be the City Clerk which tops out at
$ 64,000. The equivalent to the building position tops out at $ 75,000.
In Rochester there is a similar disparity. The equivalent to the license position tops out at
$ 53,500 while the building position tops out at $ 84,000.
In Duluth, even if we factor in a raise for 1997 the position equivalent to a deputy for
construction would top out at $ 65,000. If we compared a Saint Paul Sergeant the customer
service deputy wou]d top out at $ 52,000.
Minneapolis is in transition, however it appeazs that the position equivalent to deputy for
construction will will top out at $ 72,000.
Crrade 26 in Saint Paul tops out at $ 72,000. This is equivalent to all positions except the one in
Rochester.
Cttade 28 tops out at $ 78,352.
The market indicates that likely candidates should be available at grade 26.

Due to reorganization, the impact oftechnotogy, the need to reduce costs, and the need to
unprove the speed of service to customers LIEP has been reorganizing and streamlining. This
proposal will reduce the tota] number of management positions and wi11 prod�ce some savissgs.

I have decided to veto Resolution 97-1347, which was passed by the Council in amended form
November 12, 1997. I request that you reconsider this resolution as submitted. My understanding
is that the resolution was amended to change the rate of pay assigned to the new classification
entitled, "Deputy LIEP Director - Construction". It was changed from SPSO grade 26 to SPSO
gade 30. This, action in my opinion does not reflect sound business judgement and has the
potential of establishing a practice that I can not support.
Before this resolution came before the Council, Human Resources assisted LIEP in restructuring
the office so that it could function in an efficient and cost effective manner. The number of
divisions was reduced from three to two. Two new division manager positions were then
designed, classified and evaluated. This process took approximately thirty hours over a period of
several weeks to complete. The analysis consisted of the application of our iniemal job evaluation
system,, a comparison with the provisions of a sometimes conflicting State Pay Equity Act, a
detemunation of the effects that the grade assignment would have on other classifications and
finally, a local market study. The result was the assignment of the positions to the SPSO
bargaining unit in grade 26. Afier this analysis, both LIEP and the SPSO bargaining unit were
notified of the results. There were discussions with SPSO regazding the proposed minimum
qualifications and, subsequently, a"no substitution for education" requirement was added at their
request. This did not affect the overail evatuation and grade assignment. The LIEP Director and
the President of SPSO agreed to the class specifications and the grade level assignment through
the twenty-day notice process as required by the civii service rules.

On November 12, 1997, the Council was asked, in an open forum, to change the grade
assignment for the new classification by representatives of SPSO who believed the pay was too
low. They based their analysis on the pay for an old classification, that was initially evaluated
under an organizationai structure that no longer e�usts. They also indicated that the City may
have trouble obtaining qualified candidates at the pay levei assigned by Human Resources. I
would like to point out that if that occurs, Human Resources will draft a resolution to adjust the
pay accordingiy.
In conclusion, I believe your decision to amend this resolution was ill advised. There are more
appropriate forums for settling disputes over classification and compensation determinations made
by Human Resources. There is such a process outlined in the Civil Service Grievance Procedures
which SPSO chose not to pursue. I urge you to please consider all of the possible rami8cation of
this action and pass Resolution 97-1347 as it was originally drafted.

Analysis of Salary Survey for Deputy Positions in LIEP

(Note: All salary figures are "per yeat".)
None of the jurisdictions had a totally comparable structure to LIEP in Saint Paul, nonetheless,
some comparisons can be made.
Comparabie positions in Richfield and St. Cloud top out at less than $ 60,000 per year but these
positions have a less demanding workload. Specifically, more residential, less commercial, and a
slower rate of development. (Note: Organizationally, the position in St. Cloud is a good match
for the construction deputy.)
In Bloomington there is a significant difference between the building position and the zoning
position. The equivalent to the license position would be the City Clerk which tops out at
$ 64,000. The equivalent to the building position tops out at $ 75,000.
In Rochester there is a similar disparity. The equivalent to the license position tops out at
$ 53,500 while the building position tops out at $ 84,000.
In Duluth, even if we factor in a raise for 1997 the position equivalent to a deputy for
construction would top out at $ 65,000. If we compared a Saint Paul Sergeant the customer
service deputy wou]d top out at $ 52,000.
Minneapolis is in transition, however it appeazs that the position equivalent to deputy for
construction will will top out at $ 72,000.
Crrade 26 in Saint Paul tops out at $ 72,000. This is equivalent to all positions except the one in
Rochester.
Cttade 28 tops out at $ 78,352.
The market indicates that likely candidates should be available at grade 26.

Directs the construction and inspection of City-owned buildings and
facilities.
Directs the inspection and certification of all elevators in the City.
Acts on behalf of the Office of LIEP and represents the Director in his
or her absence.
Develops reports, prepares special studies, and makes recommendations to
the Director.
Directs the administration of the City's zoning ordinance and appeals
process.
Directs the enforcement of the City's sign control ordinance.
KNOWLEDGE, SKILLS AND ABILITIES
Thorough knowledge of National, State, and Local building and 2oning
codes and ordinances.
Thorough knowledge of legal aspects of building and zoning code and
ordinance enforcement.
Thorough knowledge of management and human resource development
principles and practices.

and techniques, including specialty engineering.

Bachelor's degree from an accredited college or university in
architecture, building construction management, or a closely related
£ield; and either five (S)years of experience in construction, at least
three (3) years of which must have been as a contractor or superintendent
of projects that required the management and coordination of multiple
building trades disciplines; or five (5) years of experience as a Building
Official in a municipality with a population of at least 20,000, and must
be certified, or become certi£ied within six (6) months of appointment, as
a Certified Building Official by the State of Minnesota. (No substitution
for education or certification. Continued employment is contingent upon
maintaining certification.)

Analysis of Salary Survey for Deputy Positions in LIEP
August 5, 1997
(Note: All salary figures are "per yeat".)
None of the jurisdictions had a totally comparable structure to LIEP in Saint Paul, nonetheless,
some comparisons can be made.
Comparabie positions in Richfield and St. Cloud top out at less than $ 60,000 per year but these
positions have a less demanding workload. Specifically, more residential, less commercial, and a
slower rate of development. (Note: Organizationally, the position in St. Cloud is a good match
for the construction deputy.)
In Bloomington there is a significant difference between the building position and the zoning
position. The equivalent to the license position would be the City Clerk which tops out at
$ 64,000. The equivalent to the building position tops out at $ 75,000.
In Rochester there is a similar disparity. The equivalent to the license position tops out at
$ 53,500 while the building position tops out at $ 84,000.
In Duluth, even if we factor in a raise for 1997 the position equivalent to a deputy for
construction would top out at $ 65,000. If we compared a Saint Paul Sergeant the customer
service deputy wou]d top out at $ 52,000.
Minneapolis is in transition, however it appeazs that the position equivalent to deputy for
construction will will top out at $ 72,000.
Crrade 26 in Saint Paul tops out at $ 72,000. This is equivalent to all positions except the one in
Rochester.
Cttade 28 tops out at $ 78,352.
The market indicates that likely candidates should be available at grade 26.

Summary of Study for Deputy LIEP Director - Construction

Due to reorganization, the impact oftechnotogy, the need to reduce costs, and the need to
unprove the speed of service to customers LIEP has been reorganizing and streamlining. This
proposal will reduce the tota] number of management positions and wi11 prod�ce some savissgs.
The Director of LIEP requested the creation of two new positions to act as deputy directors, one
for construction and one for customer service.

The proposed duties for the Deputy LIEP Director - Construction were compared to the ciass
specifications for Building Inspector, Senior Building Inspector, Building and Housing Inspection
Supervisor, and Building Code Officer. None ofthese specs described the duties accurately.

The proposed duties were compazed to the duties of the positions actually assigned to the classes
listed above. None were found to perform this particular mi�c of duties.
