That the petitioners, their successors and assigns shatt pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained on behalf of the City of Saint Paul,
Department of Public Works to reserve the right of the City to maintain and operate any sewer
in or upon said easement and to enter upon said easement or any portion thereof at any time
and from time to time, for the purposes of future construction, reconstruction, inspecting,
maintaining or repairing the same or any part thereof on, over, under and across the westerly
portion of the vacated alley in Biock 1$, Oak Viile Park, within the following described line:
Beginning at the southwest corner of Lot 4, Block 18, Oak Ville Park, thence easterly
along the north line of the alley to be vacated in said Biock 18 to a point on said north
line 15 feet easterly from the point of beginning, thence southeasterly to a point on the
south line of said alley 30 feet east of the northwest corner of L,ot 15, said Block 18,
thence northwesteriy to the point of beginning and there terminating.
and shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage fixture, or
any other objects that will prohibit norma] access to utility facilities for maintenance

Improvements in or upon the above described easement that do not prohibit the City �
from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and costs of such improvements shall be the sole responsibility of the
petitioner, its successors and assigns in the event the City exercises its reserved
easement rights.
No change from the existing grade within the easement area will be permitted without
written permission from the Department of Public Works.
No change in surfacing within the easement area will be permitted without written
permission from the Department of Public Works.
e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless
the City of Saint Paui, its officers, agents, employees, and servants from all suits,
actions, or claims which shall arise from any injuries or damages received or sustained
by any break in any service pipe or connection in said reserved easement azising out of
or resulting from any action or neg(igence of the petitioner, its employees, agents, or
business invitees.
3. That the peptioner shall, �vithin 60 days of the effective date of this resolution, dedicate an
area to the Ciry of Saint Paul for use as a public alley for redirection of the vacated alley onto
Geranium Street. The area to be dedicated for public alley is described as follows:
The north 58.0 feet of the west 30.0 feet and except the north 58.0 feet, the west 20.0
feet of L.ot I5, Block 18, Oak Ville Park, Ramsey County, Minnesota.
4. That the petitioner shall, within 60 days of the effective date of this resolution, dedicate a
permanent utility easement to the City of Saint Paul for sewer purposes on, over and across the
following described property:
The west 20.0 feet of Lot 15, Block 18, Oak Ville Park, Ramsey Counry, Minnesota.
S. That the petitioner shall pay all costs and expenses for improvements to the alley which shall
be constructed to City standards and specifications under an ordinance permit issued by Pubiic
Works Street Engineering. An acceptable plan for the alley construction must be submitted to
Street Engineering prior to the approval of the vacation.
6. That the petitioner shall pay all costs and expenses for any reconstruction of the end portions
of the vacated alley to properly eliminate the appearance of a public thoroughfare, including
but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign
removai, all to the satisfaction of the Department of Public Works.

PETITION TO VACATE CITY INTEREST
Petitioner does hereby petition the Council of the City of Saint Paul to vacate its interest in the
property described as foliows:
Part of PIN 29-29-22-11-0101-6, Oak Ville Park lots 15 through Lot 18, Block 18 (Parking
lot);
Along side of PIN 29-29-22-11-0091-0, Oak Ville Park Lots 1 through Lot 4, BLK 78
(building at 1165 Arcade Street).
We request this vacation to accomplish the following:
To partially vacate and turn a portion of the ailey that runs along the south side of the
Face to Face Health and Counseling Service building located at 1165 Arcade Street. The
turned alley will connect with Geranium Avenue instead of Arcade Street as shown on
attached documents.
We request this vacation for the following reasons:
1. The alley as currently routed poses a danger to clients, staff and visitors to the Face to Face
Health and Counseling Service building. The alley runs directly alongside the building, and
persons exiting from the side door or crossing the alley via the street step right into alley
traffic.
2. The alley re-routing is parY of a proposed construction project to (1) improve the commercial
appeal of Arcade Street, (2) provide for a buffer between residential area and the parking lot,
and (3) improve the safety of the area. This project was approved for a Saint Paul STAR
grant and loan.
3. The re-routed alley would propose littfe if any inconvenience to residents along the alley.

RESOLUTION
On this 17"' Day of March, 1997, the Board of Directors of Face to Face Health
and Counseling Service, Inc. at its regularly scheduled meeting does hereby
approve the submission of a petition to the City of St. Paul requesting vacation of
a portion of the alley abutting the agency' building and parking lot properties.
Further, the Board of Directors does hereby authorize Ann Ricketts, Executive
Director, to sign on behalf of the organization — Face to Face Health and
Counse{ing Service, Inc. — in its petition to the City of Saint Paul to vacate its
interest in lands abutting the property of Face to Face Health and Counseling
Service.

Vacation of part of alley in
Slk. 18, Oakvil{e Park
The Department of Public Works has compieted a review of the above referenced
vacation proposal. The existing alley catch basin is approximateiy 152 fieet west of the
west line of Arcade Street and drains south to Geranium Avenue through a 12" Iead in
a 4 foot easement across Lot 15. Therefore, the Department of Public Works wiil not
approve the vacation of the east 162 feet, but has no objections to the vacation as
modified on the attached drawing, subject to the foilowing conditions:
1. The vacated area shall be changed to
"That part of the alley in Block 18, Oakvilie Park Addition within the following
described area; beginning at the southwest corner of Lot 4, in said 61ock 18, thence
easterfy along the north line of the alley 162 feet ±to the southeast corner of Lot 1, in
said Block 18, thence southerly to the northeast corner of Lot 18, in said Block 18,
thence westerly along the south line of the ailey to a point 30 feet east of the northwest
corner of Lot 15, in said Block 18, thence northwesterly to the point of beginning"
2. That a sewer easement with all the usual restrictions (see attached easement
restriction sheet) shall be retained on behalf of the City of Saint Paul, on, over and
across the westem portion of the vacated alley described as follows:
"That park of the alley in Block 18, Oakvil(e Park Addition within the following
described area; beginning at the southwest corner of Lot 4, in said Block 18, thence
easterly along the north line of the alley 15 feet, thence southeasterly to a point on the
south line of the aliey 30 feet easi ofi the northwest corner of Lot 15, in said Block 18,
thence northwesterly to the point of beginning:' �
3. The north-south alley shown on the site plan shail be dedicated as a public alley.
The alley opening shall be described in the vacation resofution and be included as a
part thereof. A description of the proposed alley right-of-way shall be submitted to

Public Works for approval. A survey may be required showing the proposed alley
dedication, vacation and sewer easement, depending on the complexity of the
descriptions.
4. A minimum 20 foot wide alley right-of-way centered on the centerline of the existing
sewer running through Lot 15 is needed. And ten feet on all sides of the catch basin is
needed as aliey or retained sewer easement . Sidewalks are not permitted in a public
a41ey, although they are acceptable in a sewer easement. See attached site pfan and
sewer record sheet.
5. The petitioner shali pay ali costs and expenses for improvements to the alley which
shall be constructed to City standards and specifications under an ordinance permit
issued by Public Works Street Engineering. An acceptable plan for the alley
construction must be submitted to Street Engineering prior to approval of the vacation.
6. The petitioner shaif pay a11 costs and expenses for any reconstruction of the end
portions of the vacated alley to properly eliminate the appearance of a public
thoroughfare, inciuding but not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, ali to the satisfaction of the Department of Public
Works.

That a permanent utility easement shall be retained
on, over, under and across the vacated area on behalf
of the City of Saint Paul, Department of Public Works
to reserve the right of the City to maintain and opezate
any sewer in or upon said easement and to entez upon said
easement or any portion thereof at any tir,.e and from tine
to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the
same or any part thereof and shall_be subject to the
Pollowing conditions: .
a. Xo buildings, structures, or trees are pernitted
within the easement area nor any temporary structure,
material storage, fixture, or other objects that will
prohibit normal access to utility facilities for
maintenance purposes.
b. Improvements in or upon the above described easement
that do not prohibit the City from exercising its
reserved rights may be allowed by obtaining written
permission from the Department oE Public Works �er=
� with the understanding that the restoration
and costs of such improvements shall be the sole
responsibility of the petitioner, its successors and
assigns in the event the City exercises its reserved
easement rights.
c. No change from the existing grade is permitted within
the easement area without the written permission fr,om
the Depart�aent of Public Works.
d. No change in surfacing within the easement area is
permitted without the written permission from the
Department of Public Works.
e. That the petitioner, its successors and assigns shall
indemnify, defend, and save harmless the City of
Saint Paul, its officezs, agents, employees, and
servants from all suits, actions, or claims which
shall arise from any injuries or damages received
or sustained by any break in any service pipe or
connection in said reserved easement arising out of
or zesulting from any action or neqligence of the
petitioner, its employees, agents, or business _
invitees.

the parking lot at this location.

We are approving the reference aliey vacation and redesign of the existing parking
lot subject to the foilowing conditions:
• The existing alley curb-cut on Arcade Street to be abandoned is removed and the
curb and sidewalk restored to city specifications with a permit from Public Works.
/t is assumed that Public Works wi// iequire the new a//ey rea/ignment be
dedicated as pub/ic �ight-of-way.
• The parking lot is striped as shown on the approved plan with handicapped spaces
designated with appropriate signage. Depending on the fina/ dedication of right-of
-way for new a/ley alignment, the western most parking spaces may need to be
e/iminated. See enclosed approved site plan.
• Seven(7) trees shall be planted as shown on the plan. Based on discussion with
your Architect, the City is recommending a variety of ornamental crabapple tree,
known as "Spring Snow". The area should be prepared and filled with suitable
soil to maintain healthy growing environment.

Council Resolution. The purpose of the resolution is to vacate part of the alley in Block
18, Oak Ville Park and re-route the alley traffic to Geranium, creating a safer parking
area for the Face to Face Health and Counse]ing Ciinic.
The utiliries and City offices with rights to the suUject area have all responded to our
inquiries regarding the proposed vacation. Their responses are with the resolution as it is

this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained on behalf of the City of Saint Paul,
Department of Public Works to reserve the right of the City to maintain and operate any sewer
in or upon said easement and to enter upon said easement or any portion thereof at any time
and from time to time, for the purposes of future construction, reconstruction, inspecting,
maintaining or repairing the same or any part thereof on, over, under and across the westerly
portion of the vacated alley in Biock 1$, Oak Viile Park, within the following described line:
Beginning at the southwest corner of Lot 4, Block 18, Oak Ville Park, thence easterly
along the north line of the alley to be vacated in said Biock 18 to a point on said north
line 15 feet easterly from the point of beginning, thence southeasterly to a point on the
south line of said alley 30 feet east of the northwest corner of L,ot 15, said Block 18,

a. No buildings, structures, trees or any temporary structure, material storage fixture, or

Improvements in or upon the above described easement that do not prohibit the City �
from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and costs of such improvements shall be the sole responsibility of the
petitioner, its successors and assigns in the event the City exercises its reserved
easement rights.
No change from the existing grade within the easement area will be permitted without
written permission from the Department of Public Works.
No change in surfacing within the easement area will be permitted without written
permission from the Department of Public Works.
e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless
the City of Saint Paui, its officers, agents, employees, and servants from all suits,
actions, or claims which shall arise from any injuries or damages received or sustained
by any break in any service pipe or connection in said reserved easement azising out of
or resulting from any action or neg(igence of the petitioner, its employees, agents, or
business invitees.
3. That the peptioner shall, �vithin 60 days of the effective date of this resolution, dedicate an
area to the Ciry of Saint Paul for use as a public alley for redirection of the vacated alley onto
Geranium Street. The area to be dedicated for public alley is described as follows:
The north 58.0 feet of the west 30.0 feet and except the north 58.0 feet, the west 20.0
feet of L.ot I5, Block 18, Oak Ville Park, Ramsey County, Minnesota.
4. That the petitioner shall, within 60 days of the effective date of this resolution, dedicate a
permanent utility easement to the City of Saint Paul for sewer purposes on, over and across the
following described property:
The west 20.0 feet of Lot 15, Block 18, Oak Ville Park, Ramsey Counry, Minnesota.
S. That the petitioner shall pay all costs and expenses for improvements to the alley which shall
be constructed to City standards and specifications under an ordinance permit issued by Pubiic
Works Street Engineering. An acceptable plan for the alley construction must be submitted to
Street Engineering prior to the approval of the vacation.
6. That the petitioner shall pay all costs and expenses for any reconstruction of the end portions
of the vacated alley to properly eliminate the appearance of a public thoroughfare, including
but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign
removai, all to the satisfaction of the Department of Public Works.

PETITION TO VACATE CITY INTEREST
Petitioner does hereby petition the Council of the City of Saint Paul to vacate its interest in the
property described as foliows:
Part of PIN 29-29-22-11-0101-6, Oak Ville Park lots 15 through Lot 18, Block 18 (Parking
lot);
Along side of PIN 29-29-22-11-0091-0, Oak Ville Park Lots 1 through Lot 4, BLK 78
(building at 1165 Arcade Street).
We request this vacation to accomplish the following:
To partially vacate and turn a portion of the ailey that runs along the south side of the
Face to Face Health and Counseling Service building located at 1165 Arcade Street. The
turned alley will connect with Geranium Avenue instead of Arcade Street as shown on
attached documents.
We request this vacation for the following reasons:
1. The alley as currently routed poses a danger to clients, staff and visitors to the Face to Face
Health and Counseling Service building. The alley runs directly alongside the building, and
persons exiting from the side door or crossing the alley via the street step right into alley
traffic.
2. The alley re-routing is parY of a proposed construction project to (1) improve the commercial
appeal of Arcade Street, (2) provide for a buffer between residential area and the parking lot,
and (3) improve the safety of the area. This project was approved for a Saint Paul STAR
grant and loan.
3. The re-routed alley would propose littfe if any inconvenience to residents along the alley.

On this 17"' Day of March, 1997, the Board of Directors of Face to Face Health
and Counseling Service, Inc. at its regularly scheduled meeting does hereby
approve the submission of a petition to the City of St. Paul requesting vacation of
a portion of the alley abutting the agency' building and parking lot properties.
Further, the Board of Directors does hereby authorize Ann Ricketts, Executive

Vacation of part of alley in
Slk. 18, Oakvil{e Park
The Department of Public Works has compieted a review of the above referenced
vacation proposal. The existing alley catch basin is approximateiy 152 fieet west of the
west line of Arcade Street and drains south to Geranium Avenue through a 12" Iead in
a 4 foot easement across Lot 15. Therefore, the Department of Public Works wiil not
approve the vacation of the east 162 feet, but has no objections to the vacation as
modified on the attached drawing, subject to the foilowing conditions:
1. The vacated area shall be changed to
"That part of the alley in Block 18, Oakvilie Park Addition within the following
described area; beginning at the southwest corner of Lot 4, in said 61ock 18, thence
easterfy along the north line of the alley 162 feet ±to the southeast corner of Lot 1, in
said Block 18, thence southerly to the northeast corner of Lot 18, in said Block 18,
thence westerly along the south line of the ailey to a point 30 feet east of the northwest
corner of Lot 15, in said Block 18, thence northwesterly to the point of beginning"
2. That a sewer easement with all the usual restrictions (see attached easement
restriction sheet) shall be retained on behalf of the City of Saint Paul, on, over and
across the westem portion of the vacated alley described as follows:
"That park of the alley in Block 18, Oakvil(e Park Addition within the following
described area; beginning at the southwest corner of Lot 4, in said Block 18, thence
easterly along the north line of the alley 15 feet, thence southeasterly to a point on the
south line of the aliey 30 feet easi ofi the northwest corner of Lot 15, in said Block 18,
thence northwesterly to the point of beginning:' �
3. The north-south alley shown on the site plan shail be dedicated as a public alley.
The alley opening shall be described in the vacation resofution and be included as a
part thereof. A description of the proposed alley right-of-way shall be submitted to

Public Works for approval. A survey may be required showing the proposed alley
dedication, vacation and sewer easement, depending on the complexity of the
descriptions.
4. A minimum 20 foot wide alley right-of-way centered on the centerline of the existing
sewer running through Lot 15 is needed. And ten feet on all sides of the catch basin is
needed as aliey or retained sewer easement . Sidewalks are not permitted in a public
a41ey, although they are acceptable in a sewer easement. See attached site pfan and
sewer record sheet.
5. The petitioner shali pay ali costs and expenses for improvements to the alley which
shall be constructed to City standards and specifications under an ordinance permit
issued by Public Works Street Engineering. An acceptable plan for the alley
construction must be submitted to Street Engineering prior to approval of the vacation.
6. The petitioner shaif pay a11 costs and expenses for any reconstruction of the end
portions of the vacated alley to properly eliminate the appearance of a public
thoroughfare, inciuding but not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, ali to the satisfaction of the Department of Public
Works.

That a permanent utility easement shall be retained
on, over, under and across the vacated area on behalf
of the City of Saint Paul, Department of Public Works
to reserve the right of the City to maintain and opezate
any sewer in or upon said easement and to entez upon said
easement or any portion thereof at any tir,.e and from tine
to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the
same or any part thereof and shall_be subject to the
Pollowing conditions: .
a. Xo buildings, structures, or trees are pernitted
within the easement area nor any temporary structure,
material storage, fixture, or other objects that will
prohibit normal access to utility facilities for
maintenance purposes.
b. Improvements in or upon the above described easement
that do not prohibit the City from exercising its
reserved rights may be allowed by obtaining written
permission from the Department oE Public Works �er=
� with the understanding that the restoration
and costs of such improvements shall be the sole
responsibility of the petitioner, its successors and
assigns in the event the City exercises its reserved
easement rights.
c. No change from the existing grade is permitted within
the easement area without the written permission fr,om
the Depart�aent of Public Works.
d. No change in surfacing within the easement area is
permitted without the written permission from the
Department of Public Works.
e. That the petitioner, its successors and assigns shall
indemnify, defend, and save harmless the City of
Saint Paul, its officezs, agents, employees, and
servants from all suits, actions, or claims which
shall arise from any injuries or damages received
or sustained by any break in any service pipe or
connection in said reserved easement arising out of
or zesulting from any action or neqligence of the
petitioner, its employees, agents, or business _
invitees.

the parking lot at this location.
Ms. Ricketts:
We are approving the reference aliey vacation and redesign of the existing parking
lot subject to the foilowing conditions:
• The existing alley curb-cut on Arcade Street to be abandoned is removed and the
curb and sidewalk restored to city specifications with a permit from Public Works.
/t is assumed that Public Works wi// iequire the new a//ey rea/ignment be
dedicated as pub/ic �ight-of-way.
• The parking lot is striped as shown on the approved plan with handicapped spaces
designated with appropriate signage. Depending on the fina/ dedication of right-of
-way for new a/ley alignment, the western most parking spaces may need to be
e/iminated. See enclosed approved site plan.
• Seven(7) trees shall be planted as shown on the plan. Based on discussion with
your Architect, the City is recommending a variety of ornamental crabapple tree,
known as "Spring Snow". The area should be prepared and filled with suitable
soil to maintain healthy growing environment.

Council Resolution. The purpose of the resolution is to vacate part of the alley in Block
18, Oak Ville Park and re-route the alley traffic to Geranium, creating a safer parking
area for the Face to Face Health and Counse]ing Ciinic.
The utiliries and City offices with rights to the suUject area have all responded to our
inquiries regarding the proposed vacation. Their responses are with the resolution as it is

That the petitioners, their successors and assigns shatt pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained on behalf of the City of Saint Paul,
Department of Public Works to reserve the right of the City to maintain and operate any sewer
in or upon said easement and to enter upon said easement or any portion thereof at any time
and from time to time, for the purposes of future construction, reconstruction, inspecting,
maintaining or repairing the same or any part thereof on, over, under and across the westerly
portion of the vacated alley in Biock 1$, Oak Viile Park, within the following described line:
Beginning at the southwest corner of Lot 4, Block 18, Oak Ville Park, thence easterly
along the north line of the alley to be vacated in said Biock 18 to a point on said north
line 15 feet easterly from the point of beginning, thence southeasterly to a point on the
south line of said alley 30 feet east of the northwest corner of L,ot 15, said Block 18,

a. No buildings, structures, trees or any temporary structure, material storage fixture, or

Improvements in or upon the above described easement that do not prohibit the City �
from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and costs of such improvements shall be the sole responsibility of the
petitioner, its successors and assigns in the event the City exercises its reserved
easement rights.
No change from the existing grade within the easement area will be permitted without
written permission from the Department of Public Works.
No change in surfacing within the easement area will be permitted without written
permission from the Department of Public Works.
e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless
the City of Saint Paui, its officers, agents, employees, and servants from all suits,
actions, or claims which shall arise from any injuries or damages received or sustained
by any break in any service pipe or connection in said reserved easement azising out of
or resulting from any action or neg(igence of the petitioner, its employees, agents, or
business invitees.
3. That the peptioner shall, �vithin 60 days of the effective date of this resolution, dedicate an
area to the Ciry of Saint Paul for use as a public alley for redirection of the vacated alley onto
Geranium Street. The area to be dedicated for public alley is described as follows:
The north 58.0 feet of the west 30.0 feet and except the north 58.0 feet, the west 20.0
feet of L.ot I5, Block 18, Oak Ville Park, Ramsey County, Minnesota.
4. That the petitioner shall, within 60 days of the effective date of this resolution, dedicate a
permanent utility easement to the City of Saint Paul for sewer purposes on, over and across the
following described property:
The west 20.0 feet of Lot 15, Block 18, Oak Ville Park, Ramsey Counry, Minnesota.
S. That the petitioner shall pay all costs and expenses for improvements to the alley which shall
be constructed to City standards and specifications under an ordinance permit issued by Pubiic
Works Street Engineering. An acceptable plan for the alley construction must be submitted to
Street Engineering prior to the approval of the vacation.
6. That the petitioner shall pay all costs and expenses for any reconstruction of the end portions
of the vacated alley to properly eliminate the appearance of a public thoroughfare, including
but not limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign
removai, all to the satisfaction of the Department of Public Works.

interest of Northern States Power Company.

interest of US West Communications, Inc.

PETITION TO VACATE CITY INTEREST
Petitioner does hereby petition the Council of the City of Saint Paul to vacate its interest in the
property described as foliows:
Part of PIN 29-29-22-11-0101-6, Oak Ville Park lots 15 through Lot 18, Block 18 (Parking
lot);
Along side of PIN 29-29-22-11-0091-0, Oak Ville Park Lots 1 through Lot 4, BLK 78
(building at 1165 Arcade Street).
We request this vacation to accomplish the following:
To partially vacate and turn a portion of the ailey that runs along the south side of the
Face to Face Health and Counseling Service building located at 1165 Arcade Street. The
turned alley will connect with Geranium Avenue instead of Arcade Street as shown on
attached documents.
We request this vacation for the following reasons:
1. The alley as currently routed poses a danger to clients, staff and visitors to the Face to Face
Health and Counseling Service building. The alley runs directly alongside the building, and
persons exiting from the side door or crossing the alley via the street step right into alley
traffic.
2. The alley re-routing is parY of a proposed construction project to (1) improve the commercial
appeal of Arcade Street, (2) provide for a buffer between residential area and the parking lot,
and (3) improve the safety of the area. This project was approved for a Saint Paul STAR
grant and loan.
3. The re-routed alley would propose littfe if any inconvenience to residents along the alley.

On this 17"' Day of March, 1997, the Board of Directors of Face to Face Health
and Counseling Service, Inc. at its regularly scheduled meeting does hereby
approve the submission of a petition to the City of St. Paul requesting vacation of
a portion of the alley abutting the agency' building and parking lot properties.
Further, the Board of Directors does hereby authorize Ann Ricketts, Executive
Director, to sign on behalf of the organization — Face to Face Health and

Vacation of part of alley in
Slk. 18, Oakvil{e Park
The Department of Public Works has compieted a review of the above referenced
vacation proposal. The existing alley catch basin is approximateiy 152 fieet west of the
west line of Arcade Street and drains south to Geranium Avenue through a 12" Iead in
a 4 foot easement across Lot 15. Therefore, the Department of Public Works wiil not
approve the vacation of the east 162 feet, but has no objections to the vacation as
modified on the attached drawing, subject to the foilowing conditions:
1. The vacated area shall be changed to
"That part of the alley in Block 18, Oakvilie Park Addition within the following
described area; beginning at the southwest corner of Lot 4, in said 61ock 18, thence
easterfy along the north line of the alley 162 feet ±to the southeast corner of Lot 1, in
said Block 18, thence southerly to the northeast corner of Lot 18, in said Block 18,
thence westerly along the south line of the ailey to a point 30 feet east of the northwest
corner of Lot 15, in said Block 18, thence northwesterly to the point of beginning"
2. That a sewer easement with all the usual restrictions (see attached easement
restriction sheet) shall be retained on behalf of the City of Saint Paul, on, over and
across the westem portion of the vacated alley described as follows:
"That park of the alley in Block 18, Oakvil(e Park Addition within the following
described area; beginning at the southwest corner of Lot 4, in said Block 18, thence
easterly along the north line of the alley 15 feet, thence southeasterly to a point on the
south line of the aliey 30 feet easi ofi the northwest corner of Lot 15, in said Block 18,
thence northwesterly to the point of beginning:' �
3. The north-south alley shown on the site plan shail be dedicated as a public alley.
The alley opening shall be described in the vacation resofution and be included as a
part thereof. A description of the proposed alley right-of-way shall be submitted to

Public Works for approval. A survey may be required showing the proposed alley
dedication, vacation and sewer easement, depending on the complexity of the
descriptions.
4. A minimum 20 foot wide alley right-of-way centered on the centerline of the existing
sewer running through Lot 15 is needed. And ten feet on all sides of the catch basin is
needed as aliey or retained sewer easement . Sidewalks are not permitted in a public
a41ey, although they are acceptable in a sewer easement. See attached site pfan and
sewer record sheet.
5. The petitioner shali pay ali costs and expenses for improvements to the alley which
shall be constructed to City standards and specifications under an ordinance permit
issued by Public Works Street Engineering. An acceptable plan for the alley
construction must be submitted to Street Engineering prior to approval of the vacation.
6. The petitioner shaif pay a11 costs and expenses for any reconstruction of the end
portions of the vacated alley to properly eliminate the appearance of a public
thoroughfare, inciuding but not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, ali to the satisfaction of the Department of Public
Works.

That a permanent utility easement shall be retained
on, over, under and across the vacated area on behalf
of the City of Saint Paul, Department of Public Works
to reserve the right of the City to maintain and opezate
any sewer in or upon said easement and to entez upon said
easement or any portion thereof at any tir,.e and from tine
to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the
same or any part thereof and shall_be subject to the
Pollowing conditions: .
a. Xo buildings, structures, or trees are pernitted
within the easement area nor any temporary structure,
material storage, fixture, or other objects that will
prohibit normal access to utility facilities for
maintenance purposes.
b. Improvements in or upon the above described easement
that do not prohibit the City from exercising its
reserved rights may be allowed by obtaining written
permission from the Department oE Public Works �er=
� with the understanding that the restoration
and costs of such improvements shall be the sole
responsibility of the petitioner, its successors and
assigns in the event the City exercises its reserved
easement rights.
c. No change from the existing grade is permitted within
the easement area without the written permission fr,om
the Depart�aent of Public Works.
d. No change in surfacing within the easement area is
permitted without the written permission from the
Department of Public Works.
e. That the petitioner, its successors and assigns shall
indemnify, defend, and save harmless the City of
Saint Paul, its officezs, agents, employees, and
servants from all suits, actions, or claims which
shall arise from any injuries or damages received
or sustained by any break in any service pipe or
connection in said reserved easement arising out of
or zesulting from any action or neqligence of the
petitioner, its employees, agents, or business _
invitees.

RE: 1165 Arcade Street - Alley Vacation and Site Plan Review for reconfiguring
the parking lot at this location.
Ms. Ricketts:
We are approving the reference aliey vacation and redesign of the existing parking
lot subject to the foilowing conditions:
• The existing alley curb-cut on Arcade Street to be abandoned is removed and the
curb and sidewalk restored to city specifications with a permit from Public Works.
/t is assumed that Public Works wi// iequire the new a//ey rea/ignment be
dedicated as pub/ic �ight-of-way.
• The parking lot is striped as shown on the approved plan with handicapped spaces
designated with appropriate signage. Depending on the fina/ dedication of right-of
-way for new a/ley alignment, the western most parking spaces may need to be
e/iminated. See enclosed approved site plan.
• Seven(7) trees shall be planted as shown on the plan. Based on discussion with
your Architect, the City is recommending a variety of ornamental crabapple tree,
known as "Spring Snow". The area should be prepared and filled with suitable
soil to maintain healthy growing environment.

I am requesring a date of DecemUer 22, 1997 for a Public Hearing to approve the attached
Council Resolution. The purpose of the resolution is to vacate part of the alley in Block
18, Oak Ville Park and re-route the alley traffic to Geranium, creating a safer parking
area for the Face to Face Health and Counse]ing Ciinic.
The utiliries and City offices with rights to the suUject area have all responded to our
inquiries regarding the proposed vacation. Their responses are with the resolution as it is
being routed for signatures. The resolution is cun•ently in Martha Larson's office.
I have enclosed photocopies of the Green Sheet, the Council Resolution, and a map of the
