WHEREAS, Public Health has requested the Ciry Council to hold public hearings to consider
the advisability and necessity of ordering the repair or wrecking and removal of a two-story, wood
frame dwelling lacated on property hereinafter referred to as the "Subject Property" and commoniy
known as b08 York Avemie. This praperry is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Hea1W on or before December 10, 1996, the following are the now
known interested or responsible parties for the Subject Property: Christopher C. Anderson, 716

WHEREAS, Public Health has served in accardance with the provisions of Chapter 45 of the
Saint Faul I,egislative Code an order identi�ed as an "Order to Abate Nuisance Building(s)" dated
December 5, 1996; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by 7anuary b, 1996; and
WHEREAS, the enforcement o�cer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Public Health requested that
the City Clerk schedule public hearings before the Legislative Aearing Officer of the City Council
and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, February 4, 1997 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the communiry by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabIlitarion or demolition of the structure to be completed within fifteen {15) days after the
date of the Councii Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council an Wednesday, February
12, 1497 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 608 York Avenue:

That the Subyect Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00}.
T'hat there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been conected.
That Public Heaith has posted a placard on the Subject Praperty which declares it to
be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Vacant/Nuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paui City Council hereby makes the following arder:

The above referenced intcrested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating ttus structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordivances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitarion or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Heating.
2. If the above corrective action is not completed within this period of time the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Ctaapter 45 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fiYtures of any kind which interfere with the demolition and removal
shall be removed from the praperty by the responsibie parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accardance with Chapter 45 of the Saint Paul Izgislative Code.

1. Resolution ordering the owner fo remove or repair the referenced building, located at �89
Conway Street. If the owner fails to wmply wifh the resolution, Public Health is ordered to
remove the building.
Chuck Votel, Public Health, reviewed the staff report. The building had been vacant since May, 1996 and
2�ad been condemned in November, 1996. The property was recently purchased by Mark Murnane who
had previously purchased properties and did a good job at repairing them for resale. A code compliance
inspection had been completed and permits had been issued on January 30, 1997, It was the owner's
intention to have the repairs completed withitt 90 days. He reeommended amending the order from 15 days
to 180 days to allow the new owner to comglete the repazrs.
The property owner did not appear.
Gerry Strathman, Legislative Hearing O�cer, recommended amending the order from 15 days to 180 days
to remove oz repair the structure.
2. Resolution ordering the owner to remove or repair the referenced building, located at 1030
Oxford Street N. If the owner fails to coznply �vith the resolution, Public Health is ordered
to remove the building.
Mr. Votel reviewed the staff report. The building had been vacant slnce June, 1996. The mortgage
comgany was foreclosing on the mortgage with the intention of conveying the property to HUD once the
redemption period expired. The estimated cost to repair the building was approximately $20,000 and the
estimated cost for demolition was $7,20Q.
Beth Assmussen, attorney representing the mortgage company, Chase Mortgage, appeared. Ms.
Assmussen stated that Chase Mortgage purchased the property at a sheriff's sale on September 18, 1996
with a six month redemption period wkuch would expire on Mazch 18, 1997. It was their lntention to then
convey the properry to HUD for sate. She requested an extension of time to be able to convey the property
to HUD for sale.
3ackie Kieger, 1038 Oxford, appeared and stated that she lived next to this property. The exterior of the
house had only two sides which had been painted and the siding was in disrepair. She pointed out that
there wasn't a basement under the main part of the structure and the bottom area had large gaps where
animals went in and out. 5he stated far the record tt�at one of the neighbors shoveted the sidewalk.
Mr. Votel stated that he spoke with the inspectoz on this propezty and he indicated that there were
significant violations, the more serious being problems wzth the foundation and other structural problems.
Mr. Strathman recommended approval of the order. He then explained that the matter would he decided
at the City Council meeting on February 12, 1997.

Chuck Votel, Public Health, reviewed the staff report. The building had been vacant since May, 1996 and
2�ad been condemned in November, 1996. The property was recently purchased by Mark Murnane who
had previously purchased properties and did a good job at repairing them for resale. A code compliance
inspection had been completed and permits had been issued on January 30, 1997, It was the owner's
intention to have the repairs completed withitt 90 days. He reeommended amending the order from 15 days
to 180 days to allow the new owner to comglete the repazrs.
The property owner did not appear.

comgany was foreclosing on the mortgage with the intention of conveying the property to HUD once the
redemption period expired. The estimated cost to repair the building was approximately $20,000 and the
estimated cost for demolition was $7,20Q.
Beth Assmussen, attorney representing the mortgage company, Chase Mortgage, appeared. Ms.
Assmussen stated that Chase Mortgage purchased the property at a sheriff's sale on September 18, 1996
with a six month redemption period wkuch would expire on Mazch 18, 1997. It was their lntention to then
convey the properry to HUD for sate. She requested an extension of time to be able to convey the property
to HUD for sale.
3ackie Kieger, 1038 Oxford, appeared and stated that she lived next to this property. The exterior of the
house had only two sides which had been painted and the siding was in disrepair. She pointed out that
there wasn't a basement under the main part of the structure and the bottom area had large gaps where
animals went in and out. 5he stated far the record tt�at one of the neighbors shoveted the sidewalk.
Mr. Votel stated that he spoke with the inspectoz on this propezty and he indicated that there were
significant violations, the more serious being problems wzth the foundation and other structural problems.
Mr. Strathman recommended approval of the order. He then explained that the matter would he decided
at the City Council meeting on February 12, 1997.

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, February 4, 1997 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Property safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the communiry by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabIlitarion or demolition of the structure to be completed within fifteen {15) days after the
date of the Councii Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council an Wednesday, February
12, 1497 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 608 York Avenue:

That the Subyect Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00}.
T'hat there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been conected.
That Public Heaith has posted a placard on the Subject Praperty which declares it to
be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Vacant/Nuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paui City Council hereby makes the following arder:

The above referenced intcrested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating ttus structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordivances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitarion or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Heating.
2. If the above corrective action is not completed within this period of time the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Ctaapter 45 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fiYtures of any kind which interfere with the demolition and removal
shall be removed from the praperty by the responsibie parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accardance with Chapter 45 of the Saint Paul Izgislative Code.

Saint Paul Public Health has declared this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s).

Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Health that the Ciry Councii pass a resolution ordering the
responsible parties to either repair; or demolish and remove this building in a timely
manner, and failing that, authorize Public Health to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.
