1 WHEREAS, the Minnesota Department of Human Rights brought an action against the City of Saint Paul claiming
2 that the physicai portion of the City's firefighter examination had disparate impact on women and that Yne test
3 was not a valid examination; and
4 WHEREAS, the City, by resolution C.F. 94218, approved a settlement of said action, the terms of which included
5 among other things, that the City, with the agreement of the parties to the settlement, would retain an expert to
6 study, and make recommendations, regarding the scoring process for the physical portion of the firefighter
7 examination, including its relationship to the written portion of the examination; and
8 WHEREAS, pursuant to the terms of that settlement, the City, with the agreement of the parties to the
9 settlement, has identified Jenneret and Associates, Inc. as the expert to do the study and make the recommendations;
10 and
11 WHEREAS, City staff has negotiated a wntten agreement with Jenneret and Associates, inc., a copy of
12 which is on file with the Office of Financiai Services, whereby it agrees to do the study and mske recommendations
13 regarding the scoring of the physical portion of the firefighter examination in accordance with the terms of the settlement,
14 for a fee not to exceed $98,000;
15 WHEREAS, the Mayor, pursuant to Section 10.07.A of the City ChaAer does certify that there are avaiiable for
16 appropriation, revenues in excess of those estimated in the 1997 budget; and
17 WHEREAS, the Mayor recommends the following changes to the 1997 budget:
