This property is legally described as follows, to wit: Lot 7, Block 38, Lyman Dayton's Addition to the City of Saint Paul. WHEREAS, based upon the records in the Ramsey Counry Recorder's O�ce and information obtained by Public Health on or before November 27, 1996, the following are the now known interested or responsible parties for the Subject Properry: DBK Investments Inc., % James A. Snnnin�, 310 Wildwood Avenue, Birchwood, MN 55110-1621; Aaron Rubenstein, Heritage Preservation Commission, % LdEP, 350 St. Peter #300, St. Paul, MN 55102; St. Paul Postal Employees Credit Union, 170 East Kellogg Blvd., St. Paul, MN 55101 WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated November 25, 1996; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by December 26, 1996; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Public Health requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the Ciry Council and the Saint Paul City Council; and VJHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul I.egislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the L,egislative Hearing Officer of the Saint Paul City Council on Tuesday, February 4, 1997 to hear testimony and evidence, and after receiving testunony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrunental to the public peace, health, safety and welfare and remove its blighting influence on the communiry by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure 3n accardance with all applicable codes and ordinances. That the Subject Property comprises a nuisance condirion as defined in Saint Paul I,egislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed three thousand dollars ($3,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to conect the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Public Health has posted a placard on the Subject Properry which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by the VacantJNuisance Buildings Code Enforcement Program. 8. That the known interested parties and owners are as previously stated in this resolution and that the noti�cation requirements of Chapter 45 have been fulfilled. ORDER The Sairn Paul City Council hereby makes the following order: 1. The above referenced interested or responsible parties shall make the Subject Properiy safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternauve by demolishing and removing the structure in accordance with all applicable codes and ordinances. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all personal properry or fixtures of any kind which interfere with the demolition and removal shall be removed from the properiy by the responsible parties by the end of this time period. If all personal properry is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. Resolution ordering the owner to remove or repair the referenced building, located at 68� Conwav Street. If the owner fails to comply with Ehe resolution, Public Health is ordered to remove the bu'slding. Chuck Votel, Public I-Iealth, revaewed the staff report. The building had been vacant since May, 1996 and had been condemned in November, 1996. The property was recently puzchased by Mark Murnane who had previously purchased properties and did a good job at repairing them for resale. A code compliance inspection had been completed and permits had been issued on January 30, 1997. It was the owner's intention to have the repairs comgleted within 90 days. He recommended amending the order from 15 days to 180 days to altow the new owner to complete the repairs. The property owner did not appear. Gerry Strathman, Legislative Hearing O�cer, recommended amending the order from 15 days to 18Q days to remove or repair the structure. 2. Resolution ordering the owner to remove or repair the referenced building, located af 1034 OxFord Street N. If the owner faiis to comply with the resolution, Public Health is ordered fo remove the building. Mr. Votel reviewed the staff report. The building had been vacant since 7une, 1996. The mortgage company was foreclosing on the mortgage with the intention of conveying the praperty to HtID once the redemption period expired. The estimated cost to repair the building was approximately $20,000 and the estimated cost for demolition was $7,200. Beth Assmussen, attorney representing the mortgage company, Chase Mortgage, appeared. Ms. Assmussen stated that Chase Mortgage purchased the property at a sheriff's sale on September 18, 1996 w3th a six month redemption period which would expire on March 18, 1997. It was their inten6on to then convey the properry to HUD for sale. She requested an extension of time to be able to convey the property to HUD for sale. Jackie Kieger, 1038 Oxford, appeared and stated that she lived next to this property. The exterior of the house had only two sides which had been painted and the siding was in disrepair. She pointed out that there wasn't a basement uttder the main part of the structure and the bottom area had large gaps where animals went in and out. She stated for the record that one of the neighbors shoveled the sldewalk. Mr. Vote1 stated that he spoke with the inspector on this property and he indicated that there were significant violations, the more serious being problems with the foundation and other structurai probiems. Mr. Strakhrnan recommended approval of the ordez. He then explained that the matter would be decided at the City Council meetittg on February 12, 1997. A code compliance inspection had been completed and permits had been issued on January 30, 1997. It was the owner's intention to have the repairs comgleted within 90 days. He recommended amending the order from 15 days to 180 days to altow the new owner to complete the repairs. The property owner did not appear. Beth Assmussen, attorney representing the mortgage company, Chase Mortgage, appeared. Ms. Assmussen stated that Chase Mortgage purchased the property at a sheriff's sale on September 18, 1996 w3th a six month redemption period which would expire on March 18, 1997. It was their inten6on to then convey the properry to HUD for sale. She requested an extension of time to be able to convey the property to HUD for sale. Jackie Kieger, 1038 Oxford, appeared and stated that she lived next to this property. The exterior of the house had only two sides which had been painted and the siding was in disrepair. She pointed out that there wasn't a basement uttder the main part of the structure and the bottom area had large gaps where animals went in and out. She stated for the record that one of the neighbors shoveled the sldewalk. Mr. Vote1 stated that he spoke with the inspector on this property and he indicated that there were significant violations, the more serious being problems with the foundation and other structurai probiems.
