That the petitioners their successors and assigns shall pay $SQ0.00 as an administrative fee for this
vacation, which is due and payable within 60 days of the effecdve date of this resolution.
That the peritioner shall pay all costs and expenses for the reconstruction of the intersections at both
ends of vacateci Waseca to eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevazds, storm drains, and street sign removal, all to
the satisfacuon of the Department of Public Works.
That a 3Q foot wide permanent sewer easement shall be retained for the City of Saint Paul,
Department of Public Works, on, over, under and across that portion of vacated Waseca Sueet lying
between W. George Street and W. Robie Street, being 15 feet on both sides of the following
described line:
Beglnning at a point on an existing storm sewer manhole, said point being 22.3 feet north of
the centerline of W. George St. and 6.0 feet east of the centerline of said vacated Waseca St.
produced south; thence north 84.8 feet more or less to the center of an exisung storm sewer
manhole, said point being 105.4 feet north of the centerline of W. George St. and 10 feet west
of the centerline of vacated Waseca St.; thence north pazallel with said centerline of vacated
Waseca St. a distance of 81.5 feet more or less to the center of an existing storm sewer
manhole; thence north 151.5 feet more or less to the center of an existing storm serew
manhole and there temunating, said point of terminauon being 5.8 feet south of the centerline
of W. Robie St. and 6.0 feet east of the centerline of said vacated Waseca St. produced north.
Side easement lines aze to be prolonged or shortened to terminate on the north right-of-way
line of W. George St. and on the south right-of-way of Robie St.
The above described sewer easement is subject to the following conditions:

a. No buildings, structures, trees or any temporary saucture, materiai storage, fixUue, or
any other objects that will prohibit normal access to udlity facilities for maintenance
purposes will be pemritted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City
from e�rcising its reserved rights may be aliawed by obraining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and cosu of such improvements shall be the sole responsibiliry of the
petitioner, its successors and assigns in the event the City exercises its reserved
easement rights.

written permission from the Department of Public Works, Sewer Division.
No change in surfacing within the easement area will be pernutted without written
permission from the Deparanent of Public Works, Sewer Division.
e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless
the City of Saint Paul, its officers, agents, employees, and servants from ail suits,
actions, or claims which shall uise from any injuries or damages received or sustained
by any break in any service pipe or connection in said reserved easement arising out of
or resulting from any action or negligence of the petidoner, its employees, agents, or
business invitees.
That a permanent utility easement shall be retained within the vacated area to protect the interest of
U.S. West Communication, Inc.
28 5. That with the accompanying Utiliry Easement Certificates of Intended Non-Use, filed voluntarily on
29 behaif of Northern States Power Company, District Energy St. Paul, Incorporated, Continental
30 Cablevision, The Water Utility, and The Department of Public Works, made a part hereof by this
31 reference and filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of
32 these corporations and departments, waive the right to the utility easements in the vacated area

City of Saint Paul, its officers, and employees from all suits, actions, or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons, or properry
on account of this vacarion or petitioner's use of this properry, including but not limited to a claim
brought because of any act of omission, neglect, or misconduct of said petitioner or because of any
claims or liability arising from any violation of any law or regulaaon made in accordance with the
law, whether by the peritioner or any of their agents or employees
That the getitioners, their successors and assigns, shall within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and

I am requesting that a date of January $, 1997, be set for the approval of the atiached Council
Resolution. The purpose of the resolution is to vacate Waseca Sueet from the north side of
Robie Street to the south side of George sueet, so that the adjoining propezty owners have
space enough for their planned gazages and driveways.
The utilities and City offices with rights to the subject area have all responded to our inquiries
regarding the proposed vacation. Their responses are with the reso]ution as it is being routed
for signatures. The resolution is currently in the Finance Director's Office.
I have attached photocopies of the Green Sheet, the Council Resolution, and a map of the area
to be vacated. Piease let me Irnow if there is anything eise you might need for this.

Robie, surrounded by the foilowing properties:
1.) Nefson-Stevens and King's addition to West Saint Paul, west 1!2 of lot 7, block 2.
2.) Lot 8, block 2 Nelson-Stevens and King's addition to West Saint Paul.
3.} Haas subdivision, south 35 feet of lots 1 and 2 and except west 15 feet lot 7 and all
of lot 8 Doorhardt rearrangement and in said Haas sub lots i through 6.
Ail properties are in the county of Ramsey. The addresses of the respective
properties are as follows:

Vacation of Waseca St. between
George and Robie Streets W.
The Department of Pub(ic Works has completed a review of the above referenced
vacation proposal and has no objections to the vacation subject io the following:
1. That the petitioner shall pay all costs and expenses for the reconstruction of the
intersections at both ends of vacated Waseca to properly eliminate the appearance of
a public tharoughfare, including but not limited to, costs for new curbs, sidewalks,
boulevards, storm drains, and street sign removai, al� to the satisfaction of the
Department of Pubiic Works.
2. That a 30 ft. wide permanent sewer easement shall be retained for the City of Saint
Paui, Department of Pubfic Works, on, over, under and across that portion of vacated
Waseca Street lying between W. George St. and W. Robie St., being 15 feet on both
sides of the following described line:
Beginning at a point on an existing storm sewer manhole, said point being 22.3 feet
north of the centerline of W. George St. and 6,0 feet east ofi the centerfine ofi said
vacated Waseca St. produced south; thence north 84.8 feet more or less to the center
of an existing storm sewer manhole, said point being 105.4 feet north of the centerline
of W. George St. and 10 feet west of the centerfine of vacated Waseca St.; thence
north parallel with said centeriine of vacated Waseca St. a distance of 81.5 feet more
or less to the center of an existing storm sewer manhole; thence north 151.5 feet more
or less to the center of an existing storm sewer manhofe and there terminating, said
point of termination being 5.8 feet south of the centeriine of W. Fiobie St. and 6.0 feet

a. No buildings, structures, trees or any temporary saucture, materiai storage, fixUue, or
any other objects that will prohibit normal access to udlity facilities for maintenance
purposes will be pemritted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City
from e�rcising its reserved rights may be aliawed by obraining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and cosu of such improvements shall be the sole responsibiliry of the
petitioner, its successors and assigns in the event the City exercises its reserved
easement rights.

written permission from the Department of Public Works, Sewer Division.
No change in surfacing within the easement area will be pernutted without written
permission from the Deparanent of Public Works, Sewer Division.
e. The petitioner, its successors and assigns shall indemnify, defend, and save harmless
the City of Saint Paul, its officers, agents, employees, and servants from ail suits,
actions, or claims which shall uise from any injuries or damages received or sustained
by any break in any service pipe or connection in said reserved easement arising out of
or resulting from any action or negligence of the petidoner, its employees, agents, or
business invitees.
That a permanent utility easement shall be retained within the vacated area to protect the interest of
U.S. West Communication, Inc.
28 5. That with the accompanying Utiliry Easement Certificates of Intended Non-Use, filed voluntarily on
29 behaif of Northern States Power Company, District Energy St. Paul, Incorporated, Continental
30 Cablevision, The Water Utility, and The Department of Public Works, made a part hereof by this
31 reference and filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of
32 these corporations and departments, waive the right to the utility easements in the vacated area

City of Saint Paul, its officers, and employees from all suits, actions, or claims of any character

brought because of any act of omission, neglect, or misconduct of said petitioner or because of any
claims or liability arising from any violation of any law or regulaaon made in accordance with the
law, whether by the peritioner or any of their agents or employees
That the getitioners, their successors and assigns, shall within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and

I am requesting that a date of January $, 1997, be set for the approval of the atiached Council
Resolution. The purpose of the resolution is to vacate Waseca Sueet from the north side of
Robie Street to the south side of George sueet, so that the adjoining propezty owners have
space enough for their planned gazages and driveways.
The utilities and City offices with rights to the subject area have all responded to our inquiries
regarding the proposed vacation. Their responses are with the reso]ution as it is being routed
for signatures. The resolution is currently in the Finance Director's Office.
I have attached photocopies of the Green Sheet, the Council Resolution, and a map of the area
to be vacated. Piease let me Irnow if there is anything eise you might need for this.

The Department of Pub(ic Works has completed a review of the above referenced
vacation proposal and has no objections to the vacation subject io the following:
1. That the petitioner shall pay all costs and expenses for the reconstruction of the
intersections at both ends of vacated Waseca to properly eliminate the appearance of
a public tharoughfare, including but not limited to, costs for new curbs, sidewalks,
boulevards, storm drains, and street sign removai, al� to the satisfaction of the
Department of Pubiic Works.
2. That a 30 ft. wide permanent sewer easement shall be retained for the City of Saint
Paui, Department of Pubfic Works, on, over, under and across that portion of vacated
Waseca Street lying between W. George St. and W. Robie St., being 15 feet on both
sides of the following described line:
Beginning at a point on an existing storm sewer manhole, said point being 22.3 feet

vacation, which is due and payable within 60 days of the effecdve date of this resolution.
That the peritioner shall pay all costs and expenses for the reconstruction of the intersections at both
ends of vacateci Waseca to eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevazds, storm drains, and street sign removal, all to
the satisfacuon of the Department of Public Works.
That a 3Q foot wide permanent sewer easement shall be retained for the City of Saint Paul,
Department of Public Works, on, over, under and across that portion of vacated Waseca Sueet lying
between W. George Street and W. Robie Street, being 15 feet on both sides of the following
described line:

a. No buildings, structures, trees or any temporary saucture, materiai storage, fixUue, or
any other objects that will prohibit normal access to udlity facilities for maintenance
purposes will be pemritted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City
from e�rcising its reserved rights may be aliawed by obraining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and cosu of such improvements shall be the sole responsibiliry of the
petitioner, its successors and assigns in the event the City exercises its reserved
easement rights.

written permission from the Department of Public Works, Sewer Division.
No change in surfacing within the easement area will be pernutted without written

the City of Saint Paul, its officers, agents, employees, and servants from ail suits,
actions, or claims which shall uise from any injuries or damages received or sustained
by any break in any service pipe or connection in said reserved easement arising out of
or resulting from any action or negligence of the petidoner, its employees, agents, or
business invitees.
That a permanent utility easement shall be retained within the vacated area to protect the interest of
U.S. West Communication, Inc.
28 5. That with the accompanying Utiliry Easement Certificates of Intended Non-Use, filed voluntarily on
29 behaif of Northern States Power Company, District Energy St. Paul, Incorporated, Continental
30 Cablevision, The Water Utility, and The Department of Public Works, made a part hereof by this
31 reference and filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of

I am requesting that a date of January $, 1997, be set for the approval of the atiached Council
Resolution. The purpose of the resolution is to vacate Waseca Sueet from the north side of
Robie Street to the south side of George sueet, so that the adjoining propezty owners have
space enough for their planned gazages and driveways.
The utilities and City offices with rights to the subject area have all responded to our inquiries
regarding the proposed vacation. Their responses are with the reso]ution as it is being routed
for signatures. The resolution is currently in the Finance Director's Office.

The Department of Pub(ic Works has completed a review of the above referenced
vacation proposal and has no objections to the vacation subject io the following:
1. That the petitioner shall pay all costs and expenses for the reconstruction of the
intersections at both ends of vacated Waseca to properly eliminate the appearance of
a public tharoughfare, including but not limited to, costs for new curbs, sidewalks,
boulevards, storm drains, and street sign removai, al� to the satisfaction of the
Department of Pubiic Works.
2. That a 30 ft. wide permanent sewer easement shall be retained for the City of Saint
Paui, Department of Pubfic Works, on, over, under and across that portion of vacated
Waseca Street lying between W. George St. and W. Robie St., being 15 feet on both
sides of the following described line:
Beginning at a point on an existing storm sewer manhole, said point being 22.3 feet
north of the centerline of W. George St. and 6,0 feet east ofi the centerfine ofi said
vacated Waseca St. produced south; thence north 84.8 feet more or less to the center
of an existing storm sewer manhole, said point being 105.4 feet north of the centerline
of W. George St. and 10 feet west of the centerfine of vacated Waseca St.; thence
north parallel with said centeriine of vacated Waseca St. a distance of 81.5 feet more
or less to the center of an existing storm sewer manhole; thence north 151.5 feet more
or less to the center of an existing storm sewer manhofe and there terminating, said
point of termination being 5.8 feet south of the centeriine of W. Fiobie St. and 6.0 feet
