22 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and

R�IEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, December 2, 1997 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Properry safe and not detrimental to the public peace, health,
safety and welfaze and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitarion or demolition of the structure to be completed within ��a °°^ ;T� aay� after the

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
December 10, 1997 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public heazings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 137 Case Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
L.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properry.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacanUNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resoluuon and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul Ciry Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
struciure in accordance with all applicable codes and ordinances. The rehabilitauon or
demolidon and removal of the structure must be completed within�€iift��e� after the

In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fistures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If ail personal property is not removed, it shall be considered to be abandoned and the Ciry
of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

5aint Paul Public Health has declared this buiiding(s) to constitute a"nuisance" as defined by
Le�islative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of Public Health that the City Council pass a resoiution ordering the
responsible parties to either repair, or demolish and remove this building in a timely manner,
and failing that, authorize Public Health to proceed to demolition and removal, and to assess
the costs incurred against the real estate as a special assessment to be collected in the same
manner as taxes.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
1331 Bush Avenue
Reneta Weiss, Public Health advised this structtue has been vacant since Mazch, 1997. HUD is
the current owner. Ms. Weiss spoke with Sophie Hallauer (HUD) on December 2" Ms.
Hallauer indicated bids were open November 23Ta and will be again December 4th. The city has
had to boazd the building. The Vacant Building Registration Fee is past due. Real Estate tases
are paid. No bond has been posted. Estimated cost to repair is $25,000 - cost to demolish,
$7,750.
Gerry Strathman, Legislative Hearing Officer recommends approval of the fifteen (15) day order
to repair or remove the structure.
741 Edmund Avenue
Reneta Weiss, Public Health, advised that the Certificate of Occupancy was revoked and the
strucYure was condemned by fire in August,1996. The building has been vacant since April,
1996. The current property owner is Robert Anderson. The city has had to board the building.
The Vacant Building Registration Fee is past due. Real Estate taYes aze paid. No Certificate of
Occupancy has been applied for, nor has a performance bond been posted. Estimated cost to
repair is $80,000 - cost to demolish, $28,500.
Mr. Anderson advised that he has a purchase agreement and should be closed by weeks-end. The
new owner, Xiong S. Vang stated that he applied for liability insurance through the State of
Minnesota Insurance Department. Due to the Thanksgiving holiday, this will not be processed
until weeks-end. Mr. Vang stated that he intends to begin immediately and requested an
extension of time to complete rehabilitation.
Gerry Strathman, Legislative Hearing O�cer, recommends allowing Mr. Vang six months to
rehabilitate the building, contingent on paying the $200 Vacant Building Registration Fee and
posting a$2,000 performance bond by Noon, December 10�'.

Reneta Weiss, Public Health, reported this structure was condemned in November, 1996 and has
been vacant since that time. The current owner is HLJD.
Gerry Strathman, Legislative Hearing Officer, advised that he received a letter from James
Lorenz indicating that his bid was accepted on October 23` to purchase the property to repair and
occupy as a personal residence. He is working on financing and plans to close during the first
half of January, 1998. At that time he will post a performance bond and obtain pemvts.
Mr. Strathman recommends laying this matter over to January 20, 1998.
137 Case Avenue
Reneta Weiss, Public Health, reported that this structure has been vacant since July, 1997. The
current owner is Tom Delisle, who plans to rehabilitate the buiiding. The City has had to board
the building. The Vacant Building Registration Fee is paid. Real Estate taxes aze paid. On
October 20`� a Code Compliance Inspection was done. On November 10�' a$2,000 performance
bond was posted. Estimated cost to repair is $45,000 - cost to demolish, $7,280.
Jeffrey Delisle, son of the owner, appeazed, stating that the property was purchased November
6th. In addition to posting the bond, building permits were obtained. Since that time, a great deal
of repairs have been made. The house is insured and there is maintenance for grass and snow
removal. Mr. Delisle estimates that the house will be ready for sale sometime in January, 1998.
Gerry Strathman, Legislative Hearing Officer, recommends allowing the owner six months to
rehabilitate the building.
659 Blair Avenue
Reneta Weiss, Public Health, reported this structure was condemned in Mazch, 1997 and had
been vacant since December, 1996. The current property owner is Mary Bess Ferris who cannot
be located. The City has had to board the building. The Vacant Building Registration
Fee is past due. Real Estate taxes are unpaid. No Code Compliance has been applied for or
performance bond posted. Estimated cost to repair is $55,000 - cost to demolish $7,320.
Donna Dematteo, Minnesota Fair Housing Agency (MFHA) of Saint Paul, appeazed. MFHA is
the first lien-holder of the building. Ms. Dematteo indicated that a realtor has done a drive-by.
She also indicated that a contractor has been secured to give MFHA an estimate to rehabilitate.
If feasible, they plan to foreclose on this property. Ms. Dematteo advised that MFHA has been
unable to locate the owner as well.
Gerry Strathman, Legislative Hearing Officer, recommends approval of the order to remove or
repair the buiiding with fifteen (IS) days.

4 Acker Street West
Reneta Weiss, Public Health, reported that this structure has been vacant since 7une, 1997. The
current property owner is Larry Kartak. The City has had to board the buiiding. The Vacant
Building Registration Fee is past due. Real Estate taxes aze unpaid. A Code Compliance
Inspecrion has not been applied for, nor has a performance bond been posted. Estimated cost to
repair is $15,000 - cost to demolish, $6,700.
James Geske, attorney for Standazd Federal Bank (SFB), appeazed, stating that the bank intends
to begin rehabilitation as soon as the properry comes out of redemption - January 26, 1998.
There has been no contact with Mr. Kartak.. Until January 26�', SFB is only permitted to secure
and winterize the properiy. SFB is asking for an extension of time to allow the redemption
period to expire, at which rime they will post a bond and begin rehabilitation.
Gerry Strathman, Legisiative Hearing Officer, recommends laying this matter over to February 3,
1998.

Reneta Weiss, Public Health advised this structtue has been vacant since Mazch, 1997. HUD is
the current owner. Ms. Weiss spoke with Sophie Hallauer (HUD) on December 2" Ms.
Hallauer indicated bids were open November 23Ta and will be again December 4th. The city has
had to boazd the building. The Vacant Building Registration Fee is past due. Real Estate tases
are paid. No bond has been posted. Estimated cost to repair is $25,000 - cost to demolish,
$7,750.
Gerry Strathman, Legislative Hearing Officer recommends approval of the fifteen (15) day order
to repair or remove the structure.
741 Edmund Avenue
Reneta Weiss, Public Health, advised that the Certificate of Occupancy was revoked and the
strucYure was condemned by fire in August,1996. The building has been vacant since April,
1996. The current property owner is Robert Anderson. The city has had to board the building.
The Vacant Building Registration Fee is past due. Real Estate taYes aze paid. No Certificate of
Occupancy has been applied for, nor has a performance bond been posted. Estimated cost to
repair is $80,000 - cost to demolish, $28,500.
Mr. Anderson advised that he has a purchase agreement and should be closed by weeks-end. The
new owner, Xiong S. Vang stated that he applied for liability insurance through the State of
Minnesota Insurance Department. Due to the Thanksgiving holiday, this will not be processed
until weeks-end. Mr. Vang stated that he intends to begin immediately and requested an
extension of time to complete rehabilitation.

rehabilitate the building, contingent on paying the $200 Vacant Building Registration Fee and
posting a$2,000 performance bond by Noon, December 10�'.

been vacant since that time. The current owner is HLJD.
Gerry Strathman, Legislative Hearing Officer, advised that he received a letter from James
Lorenz indicating that his bid was accepted on October 23` to purchase the property to repair and
occupy as a personal residence. He is working on financing and plans to close during the first
half of January, 1998. At that time he will post a performance bond and obtain pemvts.
Mr. Strathman recommends laying this matter over to January 20, 1998.
137 Case Avenue

current owner is Tom Delisle, who plans to rehabilitate the buiiding. The City has had to board
the building. The Vacant Building Registration Fee is paid. Real Estate taxes aze paid. On
October 20`� a Code Compliance Inspection was done. On November 10�' a$2,000 performance
bond was posted. Estimated cost to repair is $45,000 - cost to demolish, $7,280.
Jeffrey Delisle, son of the owner, appeazed, stating that the property was purchased November
6th. In addition to posting the bond, building permits were obtained. Since that time, a great deal
of repairs have been made. The house is insured and there is maintenance for grass and snow
removal. Mr. Delisle estimates that the house will be ready for sale sometime in January, 1998.
Gerry Strathman, Legislative Hearing Officer, recommends allowing the owner six months to
rehabilitate the building.
659 Blair Avenue
Reneta Weiss, Public Health, reported this structure was condemned in Mazch, 1997 and had
been vacant since December, 1996. The current property owner is Mary Bess Ferris who cannot
be located. The City has had to board the building. The Vacant Building Registration
Fee is past due. Real Estate taxes are unpaid. No Code Compliance has been applied for or
performance bond posted. Estimated cost to repair is $55,000 - cost to demolish $7,320.
Donna Dematteo, Minnesota Fair Housing Agency (MFHA) of Saint Paul, appeazed. MFHA is
the first lien-holder of the building. Ms. Dematteo indicated that a realtor has done a drive-by.
She also indicated that a contractor has been secured to give MFHA an estimate to rehabilitate.
If feasible, they plan to foreclose on this property. Ms. Dematteo advised that MFHA has been
unable to locate the owner as well.
Gerry Strathman, Legislative Hearing Officer, recommends approval of the order to remove or
repair the buiiding with fifteen (IS) days.

Reneta Weiss, Public Health, reported that this structure has been vacant since 7une, 1997. The
current property owner is Larry Kartak. The City has had to board the buiiding. The Vacant
Building Registration Fee is past due. Real Estate taxes aze unpaid. A Code Compliance
Inspecrion has not been applied for, nor has a performance bond been posted. Estimated cost to
repair is $15,000 - cost to demolish, $6,700.
James Geske, attorney for Standazd Federal Bank (SFB), appeazed, stating that the bank intends
to begin rehabilitation as soon as the properry comes out of redemption - January 26, 1998.
There has been no contact with Mr. Kartak.. Until January 26�', SFB is only permitted to secure
and winterize the properiy. SFB is asking for an extension of time to allow the redemption
period to expire, at which rime they will post a bond and begin rehabilitation.
Gerry Strathman, Legisiative Hearing Officer, recommends laying this matter over to February 3,
1998.

WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
December 10, 1997 and the testimony and evidence including the action taken by the Legislative

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public heazings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 137 Case Avenue:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
L.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Properry.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacanUNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resoluuon and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul Ciry Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting

prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with

Jeffrey Delisle, son of the owner, appeazed, stating that the property was purchased November
6th. In addition to posting the bond, building permits were obtained. Since that time, a great deal
of repairs have been made. The house is insured and there is maintenance for grass and snow
removal. Mr. Delisle estimates that the house will be ready for sale sometime in January, 1998.

Reneta Weiss, Public Health, reported this structure was condemned in Mazch, 1997 and had
been vacant since December, 1996. The current property owner is Mary Bess Ferris who cannot
be located. The City has had to board the building. The Vacant Building Registration
Fee is past due. Real Estate taxes are unpaid. No Code Compliance has been applied for or
performance bond posted. Estimated cost to repair is $55,000 - cost to demolish $7,320.
Donna Dematteo, Minnesota Fair Housing Agency (MFHA) of Saint Paul, appeazed. MFHA is
the first lien-holder of the building. Ms. Dematteo indicated that a realtor has done a drive-by.
She also indicated that a contractor has been secured to give MFHA an estimate to rehabilitate.
If feasible, they plan to foreclose on this property. Ms. Dematteo advised that MFHA has been
unable to locate the owner as well.
Gerry Strathman, Legislative Hearing Officer, recommends approval of the order to remove or
repair the buiiding with fifteen (IS) days.

repair is $15,000 - cost to demolish, $6,700.
James Geske, attorney for Standazd Federal Bank (SFB), appeazed, stating that the bank intends
to begin rehabilitation as soon as the properry comes out of redemption - January 26, 1998.
There has been no contact with Mr. Kartak.. Until January 26�', SFB is only permitted to secure
and winterize the properiy. SFB is asking for an extension of time to allow the redemption
period to expire, at which rime they will post a bond and begin rehabilitation.
