Tlus property is legally described as follows, to wit: 5 6 Lot 21, Dale Street Addition to the City of St. Paul 7 8 WHEREAS, based upon the records in the Ramsey County Recarder's Office and 9 information obtained by Public Health on or before August 13, 1997, the following are the now 10 known interested or responsible parties for the Subject Property: Mary Bess Fenis, 659 Blair 11 Avenue, St. Paul, MN 55104-1649; Minnesota Housing Finance Agency, 400 Sibley Street Ste. 12 300, St. Paul, MN 55101 13 14 WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the 15 Saint Paul L,egislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated 16 September 8, 1997; and 17 18 WHEREAS, this order informed the then laiown interested or responsible parties that the 19 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and 20 21 WHEREAS, this order informed the interesYed or responsible parties that they must repair or 22 demolish the structure located on the Subject Property by October 8, 1997; and 23 24 WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring 25 this building(s) to constitute a nuisance condition; subject to demoliuon; and 26 27 WHEREAS, this nuisance condition has not been corrected and Public Health requested that 28 the City Clerk schedule public hearings before the L,egislative Hearing Officer of the Ciry Council 29 and the Saint Paul City Council; and 30 31 WHEREAS, the interested and responsible parties have been served notice in accardance 32 with the provisions of Chapter 45 of the Saint Paul L,egislative Code, of the time, date, place and 33 purpose of the public hearings; and 34 35 WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City 36 Council on Tuesday, December 2, 1997 to hear testimony and evidence, and after receiving 37 testimony and evidence, made the recommendauon to approve the request to order the interested or 38 responsible parties to make the Subject Properry safe and not detrimental to the public peace, health, 39 safety and welfare and remove its blighting influence on the community by rehabilitating this 40 structure in accordance with all applicable codes and ordinances, or in the alternative by 41 demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the 43 date of the Council Hearing; and °l� -14.9� WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday, December 10, 1997 and the testimony and evidence includ'mg the acuon taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 659 Blair Avenue: 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed three thousand dollazs ($3,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Public Health has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by the VacanUNuisance Buildings Code Enforcement Program. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: 1. The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. HUD is the current owner. Ms. Weiss spoke with Sophie Hallauer (HLJD) on December 2nd. Ms. Hallauer indicated hids were open November 23` and will be again December 4u. The city has had to board the building. The Vacant Building Registration Fee is past due. Real Estate taxes are paid. No bond has been posted. Estimated cost to repair is $25,000 - cost to demolish, $7,75Q. Gerry Strathman, Legislative Hearing Officer recommends approval of the fifteen (15) day order to repair or remove the structure. 741 Edmund Avenue Reneta Weiss, Public Health, advised that the Certificate of Occupancy was revoked and the structure was condemned by fire in August, 1996. The building has been vacant since April, 1996. The current property owner is Robert Anderson. The city has had to boazd the building. The Vacant Building Registration Fee is past due. Real Estate taYes aze paid. No Certificate of Occupancy has been applied for, nor has a performance bond been posted. Estimated cost to repair is $80,000 - cost to demolish, $28,500. Mr. Anderson advised that he has a purchase agreement and should be closed by weeks-end. The new owner, Xiong S. Vang stated that he applied for liability insurance through the State of Minnesota Insurance Department. Due to the Thanksgiving holiday, this will not be processed until weeks-end. Mr. Vang stated that he intends to begin immediately and requested an ea�tension of time to complete rehabilitation. Gerry Strathman, Legislative Hearing Officer, recommends allowing Mr. Vang six months to rehabilitate the building, contingent on paying the $200 Vacant Building Registration Fee and posting a$2,000 performance bond by Noon, December 10�'. ��_�Yq�- 237 Page Street East Reneta Weiss, Public Health, reported this structure was condemned in November, 1996 and has been vacant since that time. The current owner is HiJD. Gerry Strathman, Legislative Hearing Officer, advised that he received a letter from James Lorenz indicating that his bid was accepted on October 23r to purchase the property to repair and occupy as a personai residence. He is working on financing and plans to close during the first half of January, 1998. At that 6me he will post a performance bond and obtain pemuts. Mr. Strathman recommends laying this matter over to January 20, 1998. 137 Case Avenue Reneta Weiss, Public Health, reported that this structure has been vacant since July, 1997. The current owner is Tom Delisle, who plans to rehabilitate the buiiding. The City has had to board the building. The Vacant Building Registration Fee is paid. Rea1 Estate taates aze paid. On October 20` a Code Compliance Inspection was done. On November 10` a$2,000 performance bond was posted. Estimated cost to repair is $45,000 - cost to demolish, $7,280. Jeffrey Delisle, son of the owner, appeazed, stating that the property was purchased November 6"'. In addition to posting the bond, building permits were obtained. Since that time, a great deal of repairs have been made. The house is insured and there is maintenance for grass and snow removal. Iv1�. Delisle estimates that the house will be ready for sale sometime in January, 1998. Gerry Strathman, Legislative Heazing Officer, recommends allowing the owner six months to rehabilitate the building. 659 Blair Avenue Reneta Weiss, Public Health, reported this structure was condemned in Mazch, 1997 and had been vacant since December, 1996. The current property owner is Mary Bess Ferris who cannot be located. The City has had to boazd the building. The Vacant Building Registrarion Fee is past due. Real Estate taxes are unpaid. No Code Compliance has been applied for or performance bond posted. Estimated cost to repair is $55,000 - cost to demolish $7,320. Donna Dematteo, Minnesota Fair Housing Agency (MFHA) of Saint Paul, appeared. MFHA is the first lien-holder of the building. Ms. Dematteo indicated that a realtor has done a drive-by. She also indicated that a contractor has been secured to give MFHA an estimate to rehabilitate. If feasible, they plan to foreclose on this property. Ms. Dematteo advised that MFHA has been unable to locate the owner as well. Gerry Strathman, Legisla6ve Hearing O�cer, recommends approval of the order to remove or repair the building with fifteen (15) days. �'1-1 y �a 9 Acker Street West Reneta Weiss, Public Health, reported that this structure has been vacant since June, 1997. The current property owner is Larry Kaztak. The City has had to boazd the building. The Vacant Buiiding Registration Fee is past due. Real Estate taYes aze unpaid. A Code Compliance Inspection has not been applied for, nor has a performance bond been posted. Estimated cost to repair is $15,000 - cost to demolish, $6,700. James Geske, attomey for Standard Federal Bank (SFB}, appeazed, stating that the bank intends to begin rehabilitation as soon as the property comes out of redemption - January 26, 1498. There has been no contact with Mr. Kartak.. Until January 26`�, SFB is only permitted to secure and winterize the properiy. SFB is asking for an ea�tension of time to allow the redemption period to expire, at which time they will post a bond and begin rehabilitation.
