1 WHEREAS, The Legislature of the State of Minnesota, passed enabling legislation
2 (Laws 1997, Chapter 231, Articie 1, Section 11) which authorizes the City of Saint Paul, after
3 notice to the owner and an opportunity to correct violarions, to reclassify residential rental
4 properry that is found to be out of compliance with the city's applicable rental licensing
5 requirements and housing codes, from t� classification 4bb to 4b; and
WHEREAS, the enabling legislation provides that it is effective the day after the
governing body of the city of Saint Paul approves the enabling legislation in compliance with
Minnesota Statutes, secfion 645.021, subdivision 3.

NOW THEREFORE BE IT RESOLVED, that the Council of the City of Saint Paul,
upon the recommendation of the Mayor, does hereby approve Laws 1997, Chapter 231, Article 1,
Section 11; and be it fiuther
RESOLVED, that the city clerk is hereby directed to file with the secretary of state the
appropriate certificate and a copy of this resolution.

The State Legislature passed a,law that enables (onYy) the cities of �Saint Paul and
N.inneapo]is to have residential properties pay higher properCy taxes pf they fail to
comply with correction orders issued for compliance with local property maintenance codes.
This will provide another incentive for residential property owners to maintain their
properties. The reward is retaining a lower property tax rate.

We will have not made use of this specizl,legislation that provides landlords with a
non-criminal incentive to maintain ther residential vrooerties.
