That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation which is due and payable within 60 days of the effecave date of this
resolution.
That an easement shall be retained for Northem States Power Company, Electric, over, under
and across said vacated area for the purpose of protecting its distribution facilities.
That an easement shatl be retained for US West Commuications over, under and accross a
lb foot wide suip from the Southwesterly comer of Lots 6,7 and 8, Block 3, Le�ngton Park
Place Plat 11 to the Northeasterly corner of said Lots, for the purpose of servicing their
facilities.
That the peutioner's their successors, and assigns agree to indemnify, defend and save
harmless the City of Saint Paul, its officers, and employees from all suits, actions, or claims of
any character brought as a result of injuries or damages received or sustained by any person,
persons, or properry on account of this vacation or petitioner's use of this property, including
but not limited to a claim brought because of any act of omission, neglect, or misconduct of
said petitioner or because of any claims or liabiliry azising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents or
employees.

Council of the City of Saint Paut to vacate its interest in the property descn�bed below.

Parcel 1, Those parts of Lots 6,1 and 8, Block 3, and that part af adjoining
Eieanar Avenue, vacated, "Lexington Pazk PlaCS Ramsey County, l4finnesota.",
all described as beginning as a pourt on the West line of said Block 3, distant 25
feet I3arth fros� the Southwest corner of said Block 3; thence East, parallel to the
South line of said Block 3; and its eartension East, to the southeasterly line of said
Block 3; thence Southwesterly, along the Southeasterly line of said $lock its
ea-tension Southwesterly, to the South line of said plat; thence West along the
South line of said plat, to z�ctension South of the West line of said Block 3; thence
I�orth, along the West line of said Block 3 and its extension Soath, to the point
beginning.
PazCel 2. Block 3 and that part of adjoining Eleanor Ave�tue, vacated, lying
between the extensions across said avenue of and Southeasterly lines of said
Block 3, Woodford Park, St. Paul, Minnesota.
2) The reason for the vacation: Ttris is an unusual triangular shaped lot. A duplex
occupies it. Off-atreet parking is accommodated for the upstairs nnit. The
downstairs unit has limited off street pazking. Storage for lawn mowers, etc. is
provided by a storage building adjacent to the duplex. 'Tfiis buildin$ is a concrete
structure and is in need of removat because of uee root anci hydrostatic
pressure pushing the walls down. Rehuilding has not been advised because of the
cantinued risk of such presstues. This wi}1 create a hardship for us. An alternate
glan far constructing a three car garage south of the duplex to accominodate
pazking and storage was devised. The grade will not be attered. The buiiding will
be set back si�een feet from the existing curb as recommended by #he City. The
garage will be set back from the existing tree line and wiii blend in with a
positive esthetic effect.

occupies it. Off-atreet parking is accommodated for the upstairs nnit. The
downstairs unit has limited off street pazking. Storage for lawn mowers, etc. is
provided by a storage building adjacent to the duplex. 'Tfiis buildin$ is a concrete
structure and is in need of removat because of uee root anci hydrostatic
pressure pushing the walls down. Rehuilding has not been advised because of the
cantinued risk of such presstues. This wi}1 create a hardship for us. An alternate
glan far constructing a three car garage south of the duplex to accominodate
pazking and storage was devised. The grade will not be attered. The buiiding will
be set back si�een feet from the existing curb as recommended by #he City. The
garage will be set back from the existing tree line and wiii blend in with a
positive esthetic effect.

Eieanar Avenue, vacated, "Lexington Pazk PlaCS Ramsey County, l4finnesota.",
all described as beginning as a pourt on the West line of said Block 3, distant 25
feet I3arth fros� the Southwest corner of said Block 3; thence East, parallel to the
South line of said Block 3; and its eartension East, to the southeasterly line of said
Block 3; thence Southwesterly, along the Southeasterly line of said $lock its
ea-tension Southwesterly, to the South line of said plat; thence West along the
South line of said plat, to z�ctension South of the West line of said Block 3; thence
I�orth, along the West line of said Block 3 and its extension Soath, to the point
beginning.
PazCel 2. Block 3 and that part of adjoining Eleanor Ave�tue, vacated, lying
between the extensions across said avenue of and Southeasterly lines of said
Block 3, Woodford Park, St. Paul, Minnesota.
2) The reason for the vacation: Ttris is an unusual triangular shaped lot. A duplex
occupies it. Off-atreet parking is accommodated for the upstairs nnit. The
downstairs unit has limited off street pazking. Storage for lawn mowers, etc. is
provided by a storage building adjacent to the duplex. 'Tfiis buildin$ is a concrete
structure and is in need of removat because of uee root anci hydrostatic
pressure pushing the walls down. Rehuilding has not been advised because of the
cantinued risk of such presstues. This wi}1 create a hardship for us. An alternate
glan far constructing a three car garage south of the duplex to accominodate
pazking and storage was devised. The grade will not be attered. The buiiding will
be set back si�een feet from the existing curb as recommended by #he City. The
garage will be set back from the existing tree line and wiii blend in with a
positive esthetic effect.
