1 BE IT RESOLVED, that, upon the petition of East Como Partnership, as documented in Finance
2 Department File Number i-1997, public properties hereinafter described are hereby vacated and
3 discontinued as public properry: and, subject to the herein stated exceptions, the easements within
4 those public properties are hereby released.
6 The properry to be vacated is described as follows:

8 That part of the northwest-southeast alley, as dedicated in the plat of Humphrey's Addition to
9 Saint Paul, lying between a line 10.00 feet westerly of and parallel to the northerly extension
10 of the center line of Elfelt Street and a line 33.00 feet southeasterly of and parallel to the
11 northeasterly extension of the northwest line of Lot 12, Block 7, said Humphrey's Addition to
12 Saint Paul.

14 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
15 the Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company, District Energy St. Paul, Incorporated, MCI Metro, Continental Cablevision, the
Water Utility, and the Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waive the right to the utility easements in the vacated area
described above.

That the petitioner's their successors, and assigns agree to indemnify, defend and save
hannless the City of Saint Paul, its officers, and empioyees from all suits, actions, or claims of
any chazacter brought as a result of injuries or damages received or sustained by any person,
persons, or property on account of this vacation or petitioner's use of this property, including
but not limited to a claim brought because of any act of omission, negiect, or misconduct of
said petitioner or because of any claims or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents or
employees

I(we), the undersigned, constituting a majority of the owners (or the legalty designated representatives)
of the abu#ircg properkes, do hereby petition the Cnuncii of the City of Sainf Pau! to vacate ifs interests
in the properly(ies) legally described as follows:
That part of the alley accruing to Block 7 as dedicated in the plat of Humphrey's
Addition to St. Paul, Ramsey Coumy, Minnesota lying southeasterly of the
northeasterly extension of the westerly line of the easterly 33.00 feet of Lot 12,
Block 7, said Humphrey's Addiuon to St. Paul and lying westerly of the northerly
extension of the center line of Elfelt Street.
I(we) request this vacation for the following reasnn(s).
Petitioner, East Como Properties, is the sole owner of the property and building
lying southwesterly of the above described alley (see legal description in attached
Exhibit "C"). The alley was dedicated to the public as part of Humphrey's
Addition to St. Paul 'an 1882 (see Exhibit "A"). The alley is unimproved.
Several of the building's fixtures do presenUy and have historically encroached
on the alley, including two ramps, a loading dock, stairs, an air-conditioner, and
the concrete surface adjoining the building. Addiuonally, a portion of the alley
has erroneously been assigned a tas parcel number showing Burlington Northem
Railroad as "owner." Petitioner desires to acquire clear tide Yo the described
alley.

for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company, District Energy St. Paul, Incorporated, MCI Metro, Continental Cablevision, the
Water Utility, and the Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waive the right to the utility easements in the vacated area
described above.

That part of the alley accruing to Block 7 as dedicated in the plat of Humphrey's
Addition to St. Paul, Ramsey Coumy, Minnesota lying southeasterly of the
northeasterly extension of the westerly line of the easterly 33.00 feet of Lot 12,
Block 7, said Humphrey's Addiuon to St. Paul and lying westerly of the northerly
extension of the center line of Elfelt Street.
I(we) request this vacation for the following reasnn(s).
Petitioner, East Como Properties, is the sole owner of the property and building
lying southwesterly of the above described alley (see legal description in attached
Exhibit "C"). The alley was dedicated to the public as part of Humphrey's
Addition to St. Paul 'an 1882 (see Exhibit "A"). The alley is unimproved.
Several of the building's fixtures do presenUy and have historically encroached
on the alley, including two ramps, a loading dock, stairs, an air-conditioner, and
the concrete surface adjoining the building. Addiuonally, a portion of the alley
has erroneously been assigned a tas parcel number showing Burlington Northem
Railroad as "owner." Petitioner desires to acquire clear tide Yo the described
alley.

Company, District Energy St. Paul, Incorporated, MCI Metro, Continental Cablevision, the
Water Utility, and the Department of Public Works, made a part hereof by this reference and

corporations and departments, waive the right to the utility easements in the vacated area

Petitioner, East Como Properties, is the sole owner of the property and building
lying southwesterly of the above described alley (see legal description in attached
Exhibit "C"). The alley was dedicated to the public as part of Humphrey's
Addition to St. Paul 'an 1882 (see Exhibit "A"). The alley is unimproved.
Several of the building's fixtures do presenUy and have historically encroached
on the alley, including two ramps, a loading dock, stairs, an air-conditioner, and
the concrete surface adjoining the building. Addiuonally, a portion of the alley
has erroneously been assigned a tas parcel number showing Burlington Northem
Railroad as "owner." Petitioner desires to acquire clear tide Yo the described
alley.
