1 BE TT RESOLVED, that, upon the petition of River Town Homes, as documented in Finance
2 Department File Number 19-1997, public properties hereinafter described are hereby vacated and
3 discontinued as public property: and, subject to the herein stated exceptions, the easements within
4 those public properties are hereby released.
6 The property to be vacated is described as follows:

8 that part of Cohansey Street lying southerly of a line 100.Q0 feet southerly of and parallel to
9 the north line of Section 24, Township 29 North, Range 23 West and northerly of a circle
10 having a radius of 55.00 feet and centered on a point on the centerline of said Cohansey Street
11 distant 358.32 feet northerly of the centerline of Idaho Avenue.

13 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of
14 the Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shail gay $500.00 as an administrative fee
for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company, District Energy St. Paul, Incorporated, MCI Metro, Cont9nental Cablevision, the
Water Utiliry, and the Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waive the right to the utility easements in the vacated area
described above.
The petirioner sha11 dedicate a cul-de-sac, having a radius of SS.OQ feet and subject to approval
of the Street Engineer, at the south end of the proposed street vacation.
The petitioner shall be responsible for constn�ction of street improvements to City standards
and specifications.

5 provide continuiry of improvements, all to the satisfaction of the Depar[ment of Public Works.

Tha petirioner shall install street lighting to City of Saint Paul standards and specificarions.
The petitioner shall replat the property described as:
Subject to Larpenteur Avenue, Lots 1, 2, 3 and 4, Block 3, and I.ots 1, 2, 3, G and, except the
east 120.00 feet, Lot 5, Block 4, all in Edwin M. Ware's Cumberland Addition.
That the petitioner's their successors, and assigns agree to indemnify, defend and save
harmless the City of Saint Paul, its of6cers, and empioyees from all suits, actions, or claims of
any character brought as a result of injuries or damages received or sustained by any person,
persons, or property on account of this vacation or petitioner's use of this property, including
but not limited to a claim brought because of any act of omission, neglect, or misconduct of
said petitioner or because of any claims or liabiliry arising from any violation of any law or
regularion made in accordance with the law, whether by the petitioner or any of their agents or
empioyees

That the petitioner's, their successors and assigns shail gay $500.00 as an administrative fee
for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company, District Energy St. Paul, Incorporated, MCI Metro, Cont9nental Cablevision, the
Water Utiliry, and the Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waive the right to the utility easements in the vacated area
described above.
The petirioner sha11 dedicate a cul-de-sac, having a radius of SS.OQ feet and subject to approval
of the Street Engineer, at the south end of the proposed street vacation.
The petitioner shall be responsible for constn�ction of street improvements to City standards
and specifications.

for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company, District Energy St. Paul, Incorporated, MCI Metro, Cont9nental Cablevision, the
Water Utiliry, and the Department of Public Works, made a part hereof by this reference and
filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waive the right to the utility easements in the vacated area
described above.
The petirioner sha11 dedicate a cul-de-sac, having a radius of SS.OQ feet and subject to approval

The petitioner sha11 dedicate a cul-de-sac, having a radius of 55.00 T'eet and subject to approval
of the Street Engineer, atthe south end of the proposed street vacation.
The petitioner shai3 be responsible for construction of street improvements to City standards
and specifications.
The petitioner shall bear all costs and expenses for reconstruction of the intersection of
Cohansey Street and Laspenteur, including but not limited to curbing, sidewalks, boulevards,
drainage and signage, to eliminate the appearance of public right-of-way, and to provide
continuiry of improvements all to the satisfaction of the Department of Public Works.
The petitioner shall install street lighting to City of Saint Paul standards and specifications.
The petitioner shall replat the propeny.
