WHEREAS, a sanitary sewer owned and maintained by the Metropolitan Council Environmenta]
Services (MCFS, fka MWCC) exists on City of Saint Paul property, and;
WHEREAS, for said sanitary sewer to exist, the Ciry of Saint Paul, Department of Public
Works, acquired property rights when said sanitary sewer was originally constructed, said property
rights are described in Exhibit "A", a copy which is attached hereto, and;
WHEREAS, in order for the MCES to maintain its sanitary sewer, conveyance of the said
0 property rights to the MCES is necessary and recommended by the City of Saint Paul, Department of
1 Public Works, so:

3 THEREFORE BE IT RESOLVED, that the proper City officials are hereby authorized and
4 directed to accept the attached Quit Claim Deeds; and that the MCES their successors and assigns, by
5 acceptance of the terms ar�d condition of this resolution, agree to idemnify, defend and save harmless
6 the Ciry of Saint Paul, its officers and employees from all suits, actions or claims of any character
7 brought as a result of injuries or damages received or sustained by any person, persons, or property
8 on account of this easement or MCES use of this properry, including, but not limited to a ciaim
9 brought because of any act of omission, neglect, or misconduct of said petitioner or because of any
0 claims of liability arising from any violation of any law or regulation made in accordance with the
1 law, whether by the petitioner or any of its agents or employees.

A while back, i was approached by the Metropoiitan Council Environmental Services
(MCES fka MWCC),
Apparently we got some easement rights in Battle Creek Park for a sanitary sewer
back in 1958 ( I found the Council Resolution). Currently, this +s part of MCES' sewer
known as 1-5P-20o.
They were wondering if Pubtic Works wouid quit ciaim its interest in this easement -
they need to get in there and maintain the sewer.
Also, there is a small portion of property purchased to the west of this easement
where their sewer Iine aiso exsists. They woufd like this property conveyed to them
also.
MCES is wondering if we could look at fhis as soon as possibfe.

WHEREAS, a sanitary sewer owned and maintained by the Metropolitan Council Environmenta]
Services (MCFS, fka MWCC) exists on City of Saint Paul property, and;
WHEREAS, for said sanitary sewer to exist, the Ciry of Saint Paul, Department of Public
Works, acquired property rights when said sanitary sewer was originally constructed, said property
rights are described in Exhibit "A", a copy which is attached hereto, and;
WHEREAS, in order for the MCES to maintain its sanitary sewer, conveyance of the said
0 property rights to the MCES is necessary and recommended by the City of Saint Paul, Department of
1 Public Works, so:

3 THEREFORE BE IT RESOLVED, that the proper City officials are hereby authorized and
4 directed to accept the attached Quit Claim Deeds; and that the MCES their successors and assigns, by
5 acceptance of the terms ar�d condition of this resolution, agree to idemnify, defend and save harmless
6 the Ciry of Saint Paul, its officers and employees from all suits, actions or claims of any character
7 brought as a result of injuries or damages received or sustained by any person, persons, or property
8 on account of this easement or MCES use of this properry, including, but not limited to a ciaim
9 brought because of any act of omission, neglect, or misconduct of said petitioner or because of any
0 claims of liability arising from any violation of any law or regulation made in accordance with the
1 law, whether by the petitioner or any of its agents or employees.

A while back, i was approached by the Metropoiitan Council Environmental Services
(MCES fka MWCC),
Apparently we got some easement rights in Battle Creek Park for a sanitary sewer
back in 1958 ( I found the Council Resolution). Currently, this +s part of MCES' sewer
known as 1-5P-20o.
They were wondering if Pubtic Works wouid quit ciaim its interest in this easement -
they need to get in there and maintain the sewer.
Also, there is a small portion of property purchased to the west of this easement
where their sewer Iine aiso exsists. They woufd like this property conveyed to them
also.
MCES is wondering if we could look at fhis as soon as possibfe.

WHEREAS, a sanitary sewer owned and maintained by the Metropolitan Council Environmenta]
Services (MCFS, fka MWCC) exists on City of Saint Paul property, and;
WHEREAS, for said sanitary sewer to exist, the Ciry of Saint Paul, Department of Public
Works, acquired property rights when said sanitary sewer was originally constructed, said property
rights are described in Exhibit "A", a copy which is attached hereto, and;
WHEREAS, in order for the MCES to maintain its sanitary sewer, conveyance of the said
0 property rights to the MCES is necessary and recommended by the City of Saint Paul, Department of
1 Public Works, so:

3 THEREFORE BE IT RESOLVED, that the proper City officials are hereby authorized and
4 directed to accept the attached Quit Claim Deeds; and that the MCES their successors and assigns, by
5 acceptance of the terms ar�d condition of this resolution, agree to idemnify, defend and save harmless
6 the Ciry of Saint Paul, its officers and employees from all suits, actions or claims of any character
7 brought as a result of injuries or damages received or sustained by any person, persons, or property
8 on account of this easement or MCES use of this properry, including, but not limited to a ciaim
9 brought because of any act of omission, neglect, or misconduct of said petitioner or because of any
0 claims of liability arising from any violation of any law or regulation made in accordance with the
1 law, whether by the petitioner or any of its agents or employees.

A while back, i was approached by the Metropoiitan Council Environmental Services
(MCES fka MWCC),
Apparently we got some easement rights in Battle Creek Park for a sanitary sewer
back in 1958 ( I found the Council Resolution). Currently, this +s part of MCES' sewer
known as 1-5P-20o.
They were wondering if Pubtic Works wouid quit ciaim its interest in this easement -
they need to get in there and maintain the sewer.
Also, there is a small portion of property purchased to the west of this easement
where their sewer Iine aiso exsists. They woufd like this property conveyed to them
also.
MCES is wondering if we could look at fhis as soon as possibfe.
