The vacated azea is described as follows:
All that part of Leland Street southeasterly of the southeasterly line of Benson Street lying
within the northwesterly 1J4 of the southeasterly 1!4 of Section 15, Township 28 North, Range
23 West; also,
All that part of Parmer Street lying northwesterly and northerly of the northeasterly extension
of the southeasterly line of the vacated alley in Block 3, Ma}or's Addi6on; all in Ramsey
County, Minnesota.
This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of
the Saint Paul Legislative Code as amended, and to the following conditions:
That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation which is due and payable within 60 days oP the effective date of this
resolution.
2. That the petitioner shall pay all costs and expenses for the reconstruction of the intersection at
Benson Sveet to properly eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign removal,
all to the satisfacuon of the Department of Public Works.
That the petifioner shall submit a site plan to the Office of License, Inspection and
Environmentai Protection (LIEP) for Ciry review and approval of the proposed use of the
vacated area, including their building addition andlor their vehicular access via vacated Leland
Street.

That a permanent uuliry easement shall be retained within the vacated azea to to protect the
interest of Northem States Power Company.
That a permanent utiliry easement shall be retained within the vacated area to protect the
interest of U.S. West Communication, Inc.

That with the accampanying Utility Easement Certificates of Intended Non-Use, filed

voluntarily on bel�alf of U.S. West Communications, Incorporated, Northem States Pov�r
Company, District Energy St. Paul, Incorporated, Access Transmission Services Incorporated,
Conrinental Cablevision, The Water Uriliry, and The Aepartment of Public Works, made a
part hereof by trris reference and filed in the office of the Ciry Clerk of Saint Paul, the City,
for itself and on behalf of these corporations and departmenu, waive the right to the utility
easements in the vacated area described above.

harmless the City of Saint Paul, its officers, and employees fmm all suits, actions, or claims of

but not limited to a claim brought because of any act of omission, neglect, or misconduct of
said petitioner or because of any claims or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any of their agents or
employees

this resolution, file with the City Clerk an acceptance in writing of the conditions of this
resolution and shall within the period(s) specified in the terms and conditions of this
resolution, comply in all respects with these terms and conditions.

I am requesring that a date of 7anuary 8, 1997, be set for the approval of the attached Council
Resolution. The purpose of the resolution is to vacate Leland Street southeasterly of Benson
Street and Panner Street southwesterly of Leland Streett, so that the adjoining properiy owners
can buils an addition ti their existing building.
The utiliues and City offices with rights to the subject area have all resQonded to our inquiries
regarding the proposed vacation. Their responses are with the resolution as it is being routed
for signatures. The resolution is currently in the Finance Director's Office.
I have attached photocopies of the Green Sheet, the Council Resolution, and a map of the azea
to be vacated. Please let me know if there is anything else you might need for this.

Vacation of Leland Street southeasteriy of Benson Street
REAL ESTAiE pIVISION
The Department of Public Works has campleted a review of the above referenced
vacation proposal and has no objections to the vacation subject to the following:
1. That the petitioner shall pay all costs and expenses for the reconstructian of the
intersection at Benson Street, to properly eliminate the appearance of a public
thoroughfiare, inciuding bui not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, all to the satisfaction of the Department of Public
Works.
2. That the petitioner shall submit a site plan to the Office of License, Inspection and
Environmental Protection (LfEP) for City review and approva! of the proposed use of
the vacated area, including their building addition and /or their vehicular access via
vacated Leland Street.
There are no easements being retained by the Department of Pubiic Works wiihin
Leland Street southeasterly of Benson and Parmer Street southwesteriy of Leland
Street. As soon as I have the Certificate of Intended Non-Use signed and notariaed,
wiH be forwarding it to you.

The vacated azea is described as follows:
All that part of Leland Street southeasterly of the southeasterly line of Benson Street lying
within the northwesterly 1J4 of the southeasterly 1!4 of Section 15, Township 28 North, Range
23 West; also,
All that part of Parmer Street lying northwesterly and northerly of the northeasterly extension
of the southeasterly line of the vacated alley in Block 3, Ma}or's Addi6on; all in Ramsey
County, Minnesota.
This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of
the Saint Paul Legislative Code as amended, and to the following conditions:
That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation which is due and payable within 60 days oP the effective date of this
resolution.
2. That the petitioner shall pay all costs and expenses for the reconstruction of the intersection at
Benson Sveet to properly eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign removal,
all to the satisfacuon of the Department of Public Works.
That the petifioner shall submit a site plan to the Office of License, Inspection and
Environmentai Protection (LIEP) for Ciry review and approval of the proposed use of the
vacated area, including their building addition andlor their vehicular access via vacated Leland
Street.

That a permanent uuliry easement shall be retained within the vacated azea to to protect the
interest of Northem States Power Company.
That a permanent utiliry easement shall be retained within the vacated area to protect the
interest of U.S. West Communication, Inc.

Company, District Energy St. Paul, Incorporated, Access Transmission Services Incorporated,

I am requesring that a date of 7anuary 8, 1997, be set for the approval of the attached Council
Resolution. The purpose of the resolution is to vacate Leland Street southeasterly of Benson
Street and Panner Street southwesterly of Leland Streett, so that the adjoining properiy owners
can buils an addition ti their existing building.
The utiliues and City offices with rights to the subject area have all resQonded to our inquiries
regarding the proposed vacation. Their responses are with the resolution as it is being routed
for signatures. The resolution is currently in the Finance Director's Office.
I have attached photocopies of the Green Sheet, the Council Resolution, and a map of the azea
to be vacated. Please let me know if there is anything else you might need for this.

Vacation of Leland Street southeasteriy of Benson Street
REAL ESTAiE pIVISION
The Department of Public Works has campleted a review of the above referenced
vacation proposal and has no objections to the vacation subject to the following:
1. That the petitioner shall pay all costs and expenses for the reconstructian of the
intersection at Benson Street, to properly eliminate the appearance of a public
thoroughfiare, inciuding bui not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, all to the satisfaction of the Department of Public
Works.
2. That the petitioner shall submit a site plan to the Office of License, Inspection and
Environmental Protection (LfEP) for City review and approva! of the proposed use of
the vacated area, including their building addition and /or their vehicular access via
vacated Leland Street.
There are no easements being retained by the Department of Pubiic Works wiihin
Leland Street southeasterly of Benson and Parmer Street southwesteriy of Leland
Street. As soon as I have the Certificate of Intended Non-Use signed and notariaed,
wiH be forwarding it to you.

The vacated azea is described as follows:
All that part of Leland Street southeasterly of the southeasterly line of Benson Street lying
within the northwesterly 1J4 of the southeasterly 1!4 of Section 15, Township 28 North, Range
23 West; also,
All that part of Parmer Street lying northwesterly and northerly of the northeasterly extension
of the southeasterly line of the vacated alley in Block 3, Ma}or's Addi6on; all in Ramsey
County, Minnesota.
This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of
the Saint Paul Legislative Code as amended, and to the following conditions:
That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee
for this vacation which is due and payable within 60 days oP the effective date of this
resolution.
2. That the petitioner shall pay all costs and expenses for the reconstruction of the intersection at
Benson Sveet to properly eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street sign removal,
all to the satisfacuon of the Department of Public Works.
That the petifioner shall submit a site plan to the Office of License, Inspection and
Environmentai Protection (LIEP) for Ciry review and approval of the proposed use of the
vacated area, including their building addition andlor their vehicular access via vacated Leland
Street.

That a permanent uuliry easement shall be retained within the vacated azea to to protect the
interest of Northem States Power Company.
That a permanent utiliry easement shall be retained within the vacated area to protect the
interest of U.S. West Communication, Inc.

Company, District Energy St. Paul, Incorporated, Access Transmission Services Incorporated,

I am requesring that a date of 7anuary 8, 1997, be set for the approval of the attached Council
Resolution. The purpose of the resolution is to vacate Leland Street southeasterly of Benson
Street and Panner Street southwesterly of Leland Streett, so that the adjoining properiy owners
can buils an addition ti their existing building.
The utiliues and City offices with rights to the subject area have all resQonded to our inquiries
regarding the proposed vacation. Their responses are with the resolution as it is being routed
for signatures. The resolution is currently in the Finance Director's Office.
I have attached photocopies of the Green Sheet, the Council Resolution, and a map of the azea
to be vacated. Please let me know if there is anything else you might need for this.

Vacation of Leland Street southeasteriy of Benson Street
REAL ESTAiE pIVISION
The Department of Public Works has campleted a review of the above referenced
vacation proposal and has no objections to the vacation subject to the following:
1. That the petitioner shall pay all costs and expenses for the reconstructian of the
intersection at Benson Street, to properly eliminate the appearance of a public
thoroughfiare, inciuding bui not limited to, costs for new curbs, sidewalks, boulevards,
storm drains, and street sign removal, all to the satisfaction of the Department of Public
Works.
2. That the petitioner shall submit a site plan to the Office of License, Inspection and
Environmental Protection (LfEP) for City review and approva! of the proposed use of
the vacated area, including their building addition and /or their vehicular access via
vacated Leland Street.
There are no easements being retained by the Department of Pubiic Works wiihin
Leland Street southeasterly of Benson and Parmer Street southwesteriy of Leland
Street. As soon as I have the Certificate of Intended Non-Use signed and notariaed,
wiH be forwarding it to you.
