Flainti� Tayyibah Amatuliah was a veiled Mnslim woman walking in a St. Paul skyway when police
officers approached her and informed her she could not proceed without removing her facial
covering. Plaintiffrefused, and was cited for a violation under Mmn. Stat. § 609.735 which prohihits
persons from cornsaling their identities, by means of °robe, mask ar other disguise" unless 'sncidental
to amusement or entertainment.
Amafu�ah n�itiated this action in Federal District Court, alleging Officers Meyer, Jacobssoq Gray and
Pinonemi disciiminated against her on the basis of her religious beliefs, 'sllegally detained her and used
excessive force in violation of 42 U. S.C. § 1983. Plaintiff also alleged the City of St. Paul had failed
to train, supervise and control the officers. Plaintiff claims emotional injuries as a result of this
incident.
The defendants have denied Plainti�s claicns and asserted various defenses. The Defendants brought
�en4 smnmary�u gement w e. was em m rts entarety. ecause t e c aun anses un er t e
constitution ofthe United States, Plaintiffmay recover reasonahle attorney's fees. To date Plaintiff
has incurred more that $70,000 in fees. This case is ready for trial. Our office has entered into a
settlement agreemem with Amatullah for the sum of $13,500.00 in exchange for a release of all claims
against the defendants. Our office recommends approval of this settlement.
