Monette, as documented in Technology Department File Number 1997-13, the public propeny hereinafter described is hereby vacated and discontinued as public properry and, subject to the herein stated exceptions. The properry to be vacated is described as follows: See Attached E�ibit "A" This vacation shall be subject to the terms and condition of Chapter 130, codified March i, 1981, of the Saint Paul L.egislative Code as amended, and to the following conditions: 1. That the petitioner's, their successors and assigns shall pay $SOO.OQ as an administrative fee for this vacation which is due and payable within 60 days of the effective date of this resolution. 2. That the land described above is vacated to accommodate a building encroachment and that upon removal, reconstruction, alteration demolition or otherwise non-existence of the encroaching building, the vacated land shall revert to the City of Saint Paul as street right of way without charge or cost to the City of Saint Paul. 3. That an easement shall be retained for Northern States Power Company, Electric, over, under and across said vacated area for the purpose of protecting its distribution facilities. 4.
