WHEREA5, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Health on or before August 27, 1997, the following are the now
known interested or responsible parties for the Subject Property: Mid America Bank, 1815 North St.
Paul Road., St. Paul, MN 55109-4700, Attn: Richard Brignet
WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the
Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
August 18, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by September 17, 1997; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
this building(s) to constitute a nuisance condition; suhject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Pubiic Health requested that
the City Clerk schedule public hearings before the Legislative Hearing O�cer of the City Council
and the Saint Paul Ciry Council; and
WAEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the tisne, date, piace and
purpose of the public hearings; and
WHEREAS, a hearing was held before the L,�gislauve Hearing Officer of the Saint Paul City
Council on Tuesday, November 4, 1997 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make ffie Subject Property safe and not deunnental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
1 WHEREAS, Public Health has requested the City Council to hold public heazings to consider
2 the advisability and necessity of ordering the repair or wrecking and removal of a two-story, wood
3 frame structure located on properiy hereinafter referred to as the "Subject Properry" and commonly
4 known as 9b Robie Street VJest. This properry is legally described as follows, to wit:

The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the
date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul Ciry Council on VJednesday,
November 12, 1997 and the testimony and evidence including the action taken by the L,egislative
Hearing Off'icer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 96 Robie Street West:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
I.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Buiiding code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the defaciencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacandNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilied.
ORDER
The Saint Paul City Council hereby makes the following order:
i. The above referenced interested or responsible parties shall make ffie Subject Property safe
and not deirimental to the public peace, health, safery and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
ail applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

1 2. If the above correcrive acuon is not completed within this period of time the Public Health,
2 Code Enforcement Program is hereby authorized to take whatever steps are necessary to
3 demolish and remove this structure, fill the site and charge the costs incurted against the
4 Subject Property pursuant to the provisions of Chapter 45 of the Saint Pau1 L.egislative Code.

3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

the recommendation of Public Health that the City Councii pass a resolution ordering the
responsible parties to either repair, or demolish and remove this buildin� in a tunely
manner, and failing that, authorize Public Health to proceed to demolition and removal, and
to assess the costs incuned against the real estate as a special assessment to be collected in
the same manner as ta�ces.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:00 a.m.
404 Erie Street
Chuck Votel, Public Heaith, reporfed that tfiis property is owned by the City and County
Employee Credit Union. No decision has been made as to how they will proceed wiYh this
building. Rea1 Estate taxes aze unpaid in the amount of $2,980. Code Enforcement Inspectors
estimaYe the cost to repair is $50,000 - cost to demolish is $5,800. Public Health submitted
orders that the property owner repair or remove this structure within fifteen (15) days, otherwise
Public Healtl� is authorized to demolish and assess the cost to the property t�es.
Gerry Strathman, Legislative Hearing officer recommended approval.
96 Robie Street West
Chuck Votel, Public Healttt, reported that this property is owned by Mid America Bank.
Mr. Votel advised that the bank is undecided as to how they will proceed with this building.
Real Estate tases are unpaid in the amount of $1,382. Code Enforcement Inspectors estimate the
cost to repair is $60,000 - cost to demolish is $10,000. Mr. Votel stated thaY Public Health has
received many complaints from Riverview Crime Prevention and neighborhood associations
with respect to this properly. Public Aealth submitted orders that the property owner repair or
remove this structure within fifteen (15) days, otherwise Public Heaitii is authorized to demolish
and assess the cost to the property taxes.

Robert Anderson, the current owner, stated that he has a signed purchase agreement.
Closing is scheduled for November 19�'. The new owner, Yee Lee, advised that she and her
husband intend to rehabilitaYe the inside of the building during tke winter months and complete
the outside work in the spring. Chuck V otel, Public Health, stated that the Real Estate taxes aze
paid.

December 2"° Legislative Hearing.

Employee Credit Union. No decision has been made as to how they will proceed wiYh this
building. Rea1 Estate taxes aze unpaid in the amount of $2,980. Code Enforcement Inspectors
estimaYe the cost to repair is $50,000 - cost to demolish is $5,800. Public Health submitted
orders that the property owner repair or remove this structure within fifteen (15) days, otherwise
Public Healtl� is authorized to demolish and assess the cost to the property t�es.

received many complaints from Riverview Crime Prevention and neighborhood associations

WHEREAS, a hearing was held before the Saint Paul Ciry Council on VJednesday,

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 96 Robie Street West:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
I.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Buiiding code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the defaciencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacandNuisance Buildings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilied.
ORDER
The Saint Paul City Council hereby makes the following order:
i. The above referenced interested or responsible parties shall make ffie Subject Property safe
and not deirimental to the public peace, health, safery and welfare and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
ail applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal property is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.
