WI3EREAS, blic Health s requested the Ciry Council to hold public hearings to consider
the advisability and nec rdering the repair or wrecking and removal of a one-story, wood
frame structure and shed located on property hereinafter referred to as the "Subject Property" and
commonly known as 404 Erie Street. This property is legally described as follows, to wit:
South 10 feet of L,ot 11 and North 1/2 of Lot 12, Block 2, Stinson and Ramseys Sub-
division of the West half of Block SiYteen (16) of Stinson, Brown and Ramsep's
Addition to St. Paul.
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Healffi on or before August 20, 1997, the following are the now
known interested or responsible parties for the Subject Properry: City & Counry Employee Credit
Union, 144 East ilth Street, St. Paul, MN 55501, Attn: Foreclosure Dept.
WHEREAS, Public Health has served in accardance with the provisions of Chapter 45 of the
5aint Paul I.egislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated
August 13, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order ]nformed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by September 12, 1997; and
WfiEREAS, the enforcement officer has posted a placard on the Subject Property deciaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Public Health requested that
the City Clerk schedule public hearings before the I.egislative Hearing Officer of the City Council
and the Saint Paul Ciry Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the tune, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the L.egisiative Hearing Officer of the Saint Paul City
Council on "Il�esday, November 4, 1997 to hear testunony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Properry safe and not deuunental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation ar demolition of the structure to be compieted within fifteen (15) days after the
date of the Conncii Hearing; and

WHEREAS, a hearing was held before the Saint Paul City Councii on Wednesday,
November 12, 1997 and the testimony and evidence including the action taken by the I,egislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Councii hereby adopts the foliowing Findings and
Order concerning the Subject Praperiy at 404 Erie Street:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
I.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to conect the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Propeny which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacanUlVuisance Buiidings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrirnental to the public peace, health, safety and welfaze and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all agplicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above correcrive action is not completed within this period of tune the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.

the recommendation of Public Heaith that the City Councii pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Health to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.

Gerry Strathman, Legislative Hearing Officer, cailed the meeting to order at 10:00 a.m.
404 Erie Street
Chuck Votel, Public Health, reported that this property is owned by the City and County
Employee Credit Union. No decision has been made as to how they will proceed with this
building. Real Estate taYes aze unpaid in the amount of $2,980. Code Enforcement Inspectors
estimate the cost to repair is $50,000 - cost to demolish is $5,800. Public Health submitted
orders that the property owner repair or remove tlus shucture within fifteen (15) @ays, otherwise
Public Heatth is authorized to demolish and assess the cost to the property taxes.

Chuck Votel, Public Health, reported that this properry is owned by Mid America Bank.
Mr. Votel advised that the bank is undecidec2 as to how they will proceed with tlus building.
Reai Estate taxes are unpaid in the amount of $1,382. Code Enforcement Inspectors estimate the
cost to repair is $60,000 - cost to demolish is $10,000. Mr. Votel stated that Pablic Health has
received many comp2aints from Riverview Crime Prevention and neighborhood associations
with respect to ttus properiy. Public Health submitted orders that the properry owner repair or
remove this strucrizre within fifteen (15) days, otherwise Public Healtk is autkorized to demolish
and assess the cost fo the property tases.

Robert Anderson, the current owner, stated that he has a signed purchase agreement.
Closing is schedu2ed for November 19�'. The new owner, Yee Lee, advised that she and her
husband intend to rehabilitate the inside of the building during the winter months and complete
the outside work in the spring. Chuck Votel, Public Heaith, stated that the Reai Estate ta2ces are
paid.

Greg von Rothkirch, representing the Ramsey County Property Records and Revenue
Department stated that this property is scheduled for auction December 11�' and that there are a
number of interested parties.

Inasmuch as this Order to Abate has not been complied �vith the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is
the recommendation of Public Heaith that the City Councii pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize Public Health to proceed to demolition and removal, and
to assess the costs incurred against the real estate as a special assessment to be collected in
the same manner as taxes.

Gerry Strathman, Legislative Hearing Officer, cailed the meeting to order at 10:00 a.m.
404 Erie Street
Chuck Votel, Public Health, reported that this property is owned by the City and County
Employee Credit Union. No decision has been made as to how they will proceed with this
building. Real Estate taYes aze unpaid in the amount of $2,980. Code Enforcement Inspectors
estimate the cost to repair is $50,000 - cost to demolish is $5,800. Public Health submitted
orders that the property owner repair or remove tlus shucture within fifteen (15) @ays, otherwise
Public Heatth is authorized to demolish and assess the cost to the property taxes.

Chuck Votel, Public Health, reported that this properry is owned by Mid America Bank.
Mr. Votel advised that the bank is undecidec2 as to how they will proceed with tlus building.
Reai Estate taxes are unpaid in the amount of $1,382. Code Enforcement Inspectors estimate the
cost to repair is $60,000 - cost to demolish is $10,000. Mr. Votel stated that Pablic Health has
received many comp2aints from Riverview Crime Prevention and neighborhood associations
with respect to ttus properiy. Public Health submitted orders that the properry owner repair or
remove this strucrizre within fifteen (15) days, otherwise Public Healtk is autkorized to demolish
and assess the cost fo the property tases.

Robert Anderson, the current owner, stated that he has a signed purchase agreement.
Closing is schedu2ed for November 19�'. The new owner, Yee Lee, advised that she and her
husband intend to rehabilitate the inside of the building during the winter months and complete
the outside work in the spring. Chuck Votel, Public Heaith, stated that the Reai Estate ta2ces are
paid.

WI3EREAS, blic Health s requested the Ciry Council to hold public hearings to consider
the advisability and nec rdering the repair or wrecking and removal of a one-story, wood
frame structure and shed located on property hereinafter referred to as the "Subject Property" and
commonly known as 404 Erie Street. This property is legally described as follows, to wit:
South 10 feet of L,ot 11 and North 1/2 of Lot 12, Block 2, Stinson and Ramseys Sub-
division of the West half of Block SiYteen (16) of Stinson, Brown and Ramsep's
Addition to St. Paul.
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Public Healffi on or before August 20, 1997, the following are the now
known interested or responsible parties for the Subject Properry: City & Counry Employee Credit
Union, 144 East ilth Street, St. Paul, MN 55501, Attn: Foreclosure Dept.
WHEREAS, Public Health has served in accardance with the provisions of Chapter 45 of the
5aint Paul I.egislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated
August 13, 1997; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order ]nformed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by September 12, 1997; and
WfiEREAS, the enforcement officer has posted a placard on the Subject Property deciaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Public Health requested that
the City Clerk schedule public hearings before the I.egislative Hearing Officer of the City Council
and the Saint Paul Ciry Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the tune, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the L.egisiative Hearing Officer of the Saint Paul City
Council on "Il�esday, November 4, 1997 to hear testunony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested or
responsible parties to make the Subject Properry safe and not deuunental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation ar demolition of the structure to be compieted within fifteen (15) days after the
date of the Conncii Hearing; and

WHEREAS, a hearing was held before the Saint Paul City Councii on Wednesday,
November 12, 1997 and the testimony and evidence including the action taken by the I,egislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Councii hereby adopts the foliowing Findings and
Order concerning the Subject Praperiy at 404 Erie Street:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
I.egislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to conect the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Propeny which declares it to
be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by the VacanUlVuisance Buiidings
Code Enforcement Program.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrirnental to the public peace, health, safety and welfaze and remove its blighting
influence on the community by rehabilitating this structure and conecting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all agplicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above correcrive action is not completed within this period of tune the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.

personal properry or fixtures of any Idnd which interfere with the demolition and removal
